October 2, 1975
A regular meeting of the Lexington Board of Appeals was held on Thursday,
October 2, 1975 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office
Building. Present were the five regular members of the Board: Chairman Donald
E. Nickerson, Vice Chairman George P. Wadsworth, Ruth Morey, Woodruff M. Brod-
head, and Logan Clarke, Jr. Also present in addition to petitioners and/or
their attorneys, were a Lexington Minute -Man reporter, two representatives from
the League of Women Voters, and a room overflowing with townspeople. A request
from Sam Silverman to be allowed to tape the hearings was granted.
Public open hearings were held on the following petitions, notice having
been mailed as required by law to abutters, etc. and to town boards and officials.
Notices were published in the Lexington Minute -Man newspaper as required. See
copies of the permits and denials which were issued for more details.
Francis H. Bussey - variance of the Lexington Zoning By-law, Section 27, to build
a pool on his property at 12 Bowker Street with a rear yard of 10 ft. instead of
the required 15 ft.
Robert and Paul Mammola - special permit, pursuant to Section 25.69, to serve
food at Rosina's Kitchen Deli on the street floor of the building at 363A Massa-
chusetts Avenue. Rosina's Kitchen is owned and operated by Robert and Paul
Mammola.
Anthony R. Cataldo - renewal of special permit to continue to process and sell
fruits and vegetables at premises located at Gold Ribbon Farms, 1265 Massachu-
setts Avenue.
F. William Smith - for variances with respect to his property at 1009 and 1037
Massachusetts Avenue: (1) from Section 26 of the Zoning By-law to allow three
one -family dwellings and four two-family dwellings to be located on a lot con-
taining more than 108,500 square feet of land and located in a Two-family Dwell-
ing (RT) District, and (2) from Section 25.80 to allow an accessory garage build-
ing containing parking spaces for four automobiles to be located in a Two-family
Dwelling (RT) District.
Following the hearings the Board made the following decisions, all in open
public meeting:
Bussey granted unanimously.
Mammola - granted unanimously "to sell delicatessen -type products at Rosin's
Deli on the street floor of the building at 363A Mass. Ave. according to draw-
ing submitted, permitting the use of 11 tables each accommodating 3 people, sub-
ject to conditions: (1) All cooking will be done during the morning hours 8:30
- 11 a.m. and the food kept warm by means of steam tables or heated by radar
range. (2) No more than eleven tables may be used, each to accommodate 3 people.
(3) The hours of operation shall be from 9 a.m. to 6:30 p.m., 7 days a week.
(4) There will be no obtrusive signs displayed.
Cataldo - granted unanimously with the 8 conditions imposed by previous permit.
F. William Smith - granted on a vote of 4 to 1. See permit for conditions, etc.
All pertinent material is on file in the Board of Appeals' office.
The meeting adjourned at 11:30 p.m.
