July 24, 1975
A regular meeting of the Lexington Board of Appeals was held on Thursday,
July 24, 1975 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office
Building. Present were four regular members and one associate: Chairman D. E.
Nickerson, Vice-chairman G. Wadsworth, Ruth Morey and Woodruff M. Brodhead, all
regular members; and Haskell W. Reed, associate. Also present were a room full
of townspeople and a Minute -Man reporter in addition to petitioners and/or their
attorneys.
Public open hearings were held on the following petitions, notice having
been mailed as required by law to abutters, etc. and to town boards and officials.
Notices were published in the Lexington Minute -Man newspaper as required. See
permits and denials for more information on all those listed below.
Peter C. Waterman and Katherine A. Waterman - variance of Section 27 to maintain
the existing single family dwelling at 10 Brigham Road with a front yard setback
of 29.3 ft. instead of the required 30 ft.
Ronald E. Gaumont - variance of Section 27 to build an addition to an existing
dwelling at 3 Demar Road with a rear yard of 12 ft. instead of the required 15 ft.
Rowe Chevrolet, Inc. - special permit to use the premises located on Camelia Place
(containing 22,500 sq. ft. of land and the building thereon) for garage, automobile
' and truck business under the provisions of Sections 25.50, 25.51, 25.52, 25.53 and
25.54. Said land is shown as parcel 127 on Assessors' Map 57 and is known as and
numbered 47-49 Bedford Street (Rear). Petitioner has signed a Purchase Sales
Agreement to purchase the property from Bonnie L. Graham, present owner.
Ruth G. McCormack and Maryelene R. Dailey - permission to erect five signs, each
approximately 5'8" in length and approximately 10" high on the property at 1620
Massachusetts Avenue. The signs will be hung from the roof of the existing porch.
Lexington Arts and Crafts Society, Inc. - erect a free-standing sign on the front
lawn of its property at 130 Waltham Street.
Following the hearings the Board made the following decisions, all in open
public meeting:
Waterman - granted unanimously,
Gaumont - granted unanimously,
Rowe Chevrolet, Inc. - granted unanimously with certain conditions,
1. Suitable,dense, non -deciduous screening be installed.
2. Any additional lighting shall be directed away from the residential
neighborhood.
3. It is understood that reasonable safety precautions will be taken to
keep the operation from becoming a traffic hazard.
McCormack & Dailey - granted unanimously with certain conditions: length of signs
may vary from 5 to 6 ft., be approx. 10" high or less, be hung from the soffits of
the porch beams and be fixed not swinging or movable; the design shall be in accord-
ance with drawings submitted; artistic details and coloring shall be subject to
Historic Districts Commission approval.
All pertinent material is on file in the Board of Appeals' office.
Other business: Mrs. Morey brought to the attention of the Board certain sign
violations around Town. The chairman agreed to discuss sign violations with Mr.
Kelley, Building Inspector.
The Board delegated the responsibility of responding to Mr. D. Michael Gill's
request (see hearings dated July 10, 1975 and folder for D. M. Gill dated 6/19/75)
to the chairman, who dictated the following letter:

Re: Denial of your request for Variance
' Dear Sir:
The intent of the Board of Appeals' negative vote was not to require you to
remove the garage but simply not to legalize a non -conforming building. The Board
of Appeals will not take any action to prosecute you for maintaining this non-
conforming building, but it cannot guarantee that some other body or person will
not do so.

Town Counsel has agreed (by telephone) that the following note shall be
attached to petitions for hearings:
"If it is required that we notify more than 20 abutters, an additional fee of 75
cents for each notification over that number will be due and payable prior to the
hearing." (see page 1 of July 10, 1975 minutes)
The meeting adjourned at 10:30 p.m.

be located in the center of the grass plot on

face the building from Waltham Street. The petitioner has agreed to
plant
attractive shrubs along the base of the sign and the projected edges
of the sign.
