HomeMy WebLinkAbout1975-01-16BOARD OF APPEALS HEARINGS ' January 16, 1975 A regular meeting of the Board of Appeals was held on Thursday, January 16, 1975 in the Selectmen's Meeting Room of the Town Office Building at 7:30 p.m. Present were: Chairman, D. E. Nickerson; Vice Chairman, G. P. Wadsworth; regular members: W. Brodhead and Ruth Morey; and associate member, Robert Cataldo. Also present were: Petitioners or their representatives, newspaper reporters, League of Women Voters observers, and a room full of townspeople. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards, and also advertised in the Lexington Minute -Man. All hearings and decisions were made in open public hearing with specta- tors present. Roland B. Greeley, President of the Lexington Historical Society, representing the Lexington Historical Society and the Lexington Bicentennial Committee - for permission for the installation of three series of historical markers, in east Lexington, in the Munroe-Muzzey area, and in and near Lexington Center. These will serve to guide and interpret a 3 -part "Walking Tour" of Lexington. We anticipate a total of 34 markers, or less, to be used temporarily during the Bicentennial period from about April 1, 1975 to October 31, 1976. Each marker will contain up to 50 words of explanatory material on a sign ' 15" x 15" (225 sq. inches); some will also have pictures, in which cases the signs will be 15" x 25". Signs will be of durable plastic material or photo- engraved metal, in contrasting dull tones, of a design to be approved by the Historic Districts Commission, inasmuch as three-fourths of them will be in Historic Districts. Most will be mounted on waist -high concrete pedestals, set back from 5 to 10 feet from the sidewalk or street line. A few may be mounted on free-standing poles, or large trees. one or two,may be affixed to the faces of buildings to which they relate. (see Historic Markers, Board of Appeals' files The 115 Kendall Corporation - special permit pursuant to Section 12.2 that the proposed second floor addition to the existing building numbered 29 Hartwell Avenue will not result in substantial detriment to the neighborhood. The pro- posed use of the addition is installation of mechanical and electronic equip- ment for existing tenant. Paul W. Nelson - special permit pursuant to section 38.2 of the Lexington Zon- ing By-law for the development of 70 dwelling units comprising the first phase of Drummer Boy Green, approved at Town Meeting on May 6, 1974. The development is described in the materials accompanying the application and complies in all respects, according to the petitioner, with the requirements of the RD multi- dwelling district except to the extent that a variance is requested. The property involved is located on Bedford Street and Winter Street, as shown on plan submitted. Having been denied a building permit, the petitioner also requests a vari- ance from the provisions of Section 27 of the Lexington Zoning By-law (Schedule of Dimensional Controls) to permit the minimum distance between buildings to be reduced below the 30 feet required by said section. (According to the Building Inspector in a letter to the Board of Appeals, the petitioner was NOT denied a building permit.) January 16, 1975 hearings (continued) -2 ' Historic markers - granted unanimously, subject to the following findings: (1) No signs shall be installed on property without the pwner's per- mission, as well as that of the Board of Selectmen and, where they will be in a Historic District, they shall have the approval of the Historic Districts Commission. (2) The sizes originally petitioned for are to be the sizes used. (15" x 15" and those with pictures, 15" x 25") The number of words used may be increased if this is possible without increasing the size of marker. (3) They will be installed principally on 12" in diameter posts instead of on concrete pedestals and be constructed of sufficiently thick and strong material to resist deterioration. (4) It is understood that these markers are to be used temporarily, to be installed in April 1975, and to be discontinued no later than the fall of 1976. The 115 Kendall Corp. - granted unanimously subject to the condition that it will be used for the installation of mechanical and electronic equipment. Paul W. Nelson, Drummer Boy Green - granted unanimously, subject to the follow- ing conditions: (1) That formal approval shall be secured from the State Department of Public Works for the access off the jug handle on Bedford Street. (2) That a 50 foot right of way will be maintained, cleared to a width of 30 feet, and with a 24 foot pavement width for traffic. (3) The common land to be conveyed or reserved for recreation purposes or other Town use shall be designated at this time. If the project does not proceed to phase 2, this designated land shall be conveyed to either the Town or to an association of the residents, whichever is agreed upon, and if the conveyance is to the association of residents, it should be made with an easement for the Town's use. (4) It is understood that the petitioner shall comply with all the rules and conditions required under Section 38. (5) A building permit must be obtained from Lexington's Building Inspector. This Board of Appeals Permit and the Variances granted do not exempt the Petitioner from obtaining any other permit which might be required by statute.
