January 2, 1975
A regular meeting of the Board of Appeals was held on Thursday, January 2,
1975 in the Selectmen's Meeting Room of the Town Office Building at 7:30 p.m.
Present were: Chairman, D. E. Nickerson; Vice Chairman, G. P. Wadsworth;
regular members: W. Brodhead and Ruth Morey; and associate member, Robert M.
Gary. Also present were: Petitioners or their representatives, newspaper
reporters, League of Women Voters observers, and a room full of townspeople.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board to
be affected thereby as they appear on the most recent local tax list, to town
boards, and also advertised in the Lexington Minute -Man.
All hearings and decisions were made in open public hearing with specta-
tors present.
Henry and Natalia Stojanow - variance of section 27 to maintain the existing
dwelling at 8 Essex Street with a side yard of 7 ft. instead of the required
10 ft. on the easterly side of the premises.
Moore Homes, Inc. - to vary sections 25.10 and 25.11 of the zoning by-laws of
the Town of Lexington to allow two-family dwellings to be built on Lots 1, 2,
3, 4, 5, 12, 13, and 14 with access from Bedford Street between numbers 75 and
77 Bedford Street. The lots are shown on a plan entitled Centre Estates Sec-
tion 2, dated Oct. 18, 1974, drawn by Miller & Nylander, Civil Engineers and
Surveyors, Lexington, Mass. Said lots are located in an RO one -family dwelling
zoning district. (RO should be RS)
SM Realty Corporation, 1-5 Forbes Road, Lexington - (1) A finding and determina-
tion pursuant to Section 13 of the zoning by-laws that the buildings, parking
areas, drives and other improvements shown on the site plan submitted will con-
stitute a suitable development and will not result in a substantial detriment to
the neighborhood. (2) A special permit pursuant to Section 12.2 of the zoning
by-laws to allow the construction of the buildings shown on plans submitted, to
be used for the purposes set forth in Sections 25.40, 25.41, 25.42 and 25.71 of
the Use Regulation Schedule. (3) A variance pursuant to Section 12.3 of the
zoning by-laws to allow: (a) the construction of Building B shown on plans sub-
mitted, which building has a rear yard of less than 100 ft. abutting an RO dis-
trict (closest point to Building B is 30 ft. from RO district) and a front yard
of less than 100 ft. abutting Forbes Road (closest point of Building B is 75 ft.
from road), which conditions vary from Section 27, Schedule of Dimensional Con-
trols; (b) the use of 14 parking spaces servicing Building B which are located
within 50 ft. of an RO district in variance with Section 32.2, Schedule of Dim-
ensional Restrictions for Parking and Loading; and (c) the design of parking
spaces having a 9 -foot width in variance with definition of parking space in
part 4.
The Petitioner proposes to build two buildings (designated as Building A
and Building B on the site plan submitted, dated 12/9/74) on its property located
on the westerly side of Forbes Road containing 5 46 acres of land. Building A,
a multi-purpose office/laboratory building will initially contain 30,000 sq. ft.
and may be expanded to contain up to an additional 10,000 sq. ft. Building B. a
multi-purpose office building, will contain up to 20,000 sq. ft.
Attached to the petition is a copy of a Certificate of Completion issued
by the Massachusetts Department of Natural Resources regarding the completed site

Hewlett Packard, 32 Hartwell Avenue - special permit pursuant to Section 25
(Use Regulations Schedule) to utilize an area, presently unoccupied, as an
automobile, mechanical and electrical maintenance area. There will be no stor-
age of combustible material on the premises. The existing building is presently
being leased from Hartwell Lexington Trust.
Following the hearings the Board made the following decisions, all in
public open meeting:
Sto snow - granted unanimously.
Moore Homes, Inc. - 4 to 0 granted, Mrs. Morey abstaining.
SMM Realty Corp. - granted unanimously, subject to the following conditions:
1. All utilities shall be placed underground.
2. Existing trees and plantings shall be maintained as displayed in the
architect's drawings presented to the Planning Board and the Board of
Appeals.
3. Grease traps shall be placed in the catch basins.
4. Sewer service connections shall be a minimum of 6" in diameter.
5. All two-way roadways shall be a minimum of 24' wide.
6. A cleanout or manhole shall be installed at the bend in the sewer
service to Building "B", if required by the Town Engineer.
7. Use of these buildings are restricted to those listed under Sections
25.40, 25.41, 25.42 and 25.71 of the Lexington Zoning By-laws.
8. Construction must start within one year from date of this permit.
The issuance of this conditional permit shall not in any manner affect the
requirement that a building permit must be obtained from Lexington's Building
Inspector and any other permit which might be required by statute.

Hewlett Packard - granted unanimously, subject to the following conditions:
1. There will be no storage of combustible material on the premises.
2. Only minor electrical and mechanical work will be done: no greasing,
but some oiling, no body work or acetylene, no lifts or pits. The
work will be mostly tune-up for the 63 cars owned by the company.
All pertinent material is on file in the Board of Appeals' office.
The meeting adjourned at 10:30 p.m.
