HomeMy WebLinkAbout1974-09-10BOARD OF APPEALS HEARINGS ' September 10, 1974 A regular meeting of the Lexington Board of Appeals was held on Tuesday, September 10, 1974 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office Building. Present were four regular members and one associate member as follows: Chairman,Donald E. Nickerson; Vice Chairman, George P. Wadsworth; regular members: Ruth Morey and Woodruff M. Brodhead; and associate member Thomas G. Taylor. Also present were: a Minute -Man reporter, LWV Observer and a room full of townspeople. Before any hearings were held, a representative of Spring Street Trust withdrew the petition which follows, it having been advertised in the Lexing- ton Minute -Man and notices having been mailed to all who should legally re- ceive notices. LEGAL NOTICE August 22 and 29, 1974 The Board of Appeals will hold a public hearing on the petition of SPRING STREET TRUST for a special permit and for a finding and determination that the construction of a 22,500 square foot office building and a 7,850 square foot parking structure on LOT 19 ON HAYDEN AVENUE, all as shown on plans submitted, will constitute a suitable development and will not result in substantial detri- ment to the neighborhood in accordance with Sections 13 and 25 of the Town of Lexington Zoning By-law. Also the petitioner requests a variance from Section 27 to reduce the mini- mum lot area from five (5) acres to 1.9 acres since this is the amount of land enclosed by Route 2 and its ramp system and Hayden Avenue; and to reduce the required front yard (Hayden Avenue) of 100 feet to 40 feet and the rear yard (Route 2) from 50 feet to 30 feet. Nickerson, Chairman Board of Appeals Aug. 22, 29 The fact that the petition was withdrawn was brought to the attention of all present,again,at 7:35 p.m. and also after the first hearing was concluded. Public hearings were held on the following petitions, notice having been mailed to those who should legally receive them and to town boards and offi- cials who will or might be affected by decisions made and also advertised in the Lexington Minute -Man newspaper Tennis Club Guarantors Trust, Eldred L. Field and Walter Levison, Trustees for permission to the present owners, their successors and assigns to: ' 1. (a) add gutter to roof on front of building facing the street over the patio located at 475 Bedford Street, Lexington. (b) add awning to front of building length of patio. (same address). (c) add brick planter under each set of windows on present patio. September 10, 1974 (continued) -2 ' 2. add new entryway and canopy at rear of building located at 475 Bedford Street, all as shown on plans submitted. All subject to the existing conditions established by the Board of Appeals on previous petitions of Lexington Indoor Tennis Club Corp. and/or The Middlesex Tennis & Swim Club and/or Thomas R. Aldrich, Jr. Spring Street Trust - withdrawn. Rodney W. Poling, D.V.M. - pursuant to Section 12.3, a variance from Section 25.69 to erect and maintain a building to be used as a hospital for the prac- tice of veterinary medicine adjoining the dwelling at 519 Lowell Street which is to be used for his residence and for a variance of Section 27 to maintain an existing dwelling at 519 Lowell Street which has a front yard setback on Lowell Street of approximately 20 ft. instead of the required 30 ft. and a side yard of approximately 7 ft. instead of the required 15 ft. and for per- mission to subdivide the premises at 519 Lowell Street in such a manner so as to create two legal building lots, one of which will have an area of 19,200 square feet more or less instead of the required 30,000 square feet 6f land. William H. Hamilton and Marilyn H. Hamilton, Trustees of Volunteer Associates Realty Trust - variance to permit the construction of a single family dwell- ing on a lot of land shown as Parcel "B" on Plan Filed, which has sufficient area of 5 acres, more or less, with insufficient frontage on Concord Avenue, Lexington. Said parcel of land is located between the dwellings at 303 and 311 Concord Avenue and extends to the rear of the property at said 311 Concord Avenue. Following the hearings the Board made the following decisions, all in public open meeting: Tennis Club - granted unanimously. Spring Street Trust - withdrawn. Rodney W. Poling, D.V.M. - denied unanimously. Hamilton - granted unanimously, subject to the condition that a driveway to the back land of Parcel "B" over the 50 ft. passageway shall not come closer than 25 feet of the land of the abutters, Joseph L. and Marion C. Hyatt. A vote to appeal the "turned -over" decision by the Department of Community Affairs on the St. Brigid's low and moderate income housing (Planning Office for Urban Affairs) passed 4 to 0. (Mr. Taylor,abstaining) Copies of the decisions made in regard to hearings are on file in the Board of Appeals' office. Originals are filed with the Town Clerk.
