Sheldon Acting Chairman Board of Appeals Lexington, Massachusetts 02173 Dear Mr. Sheldon: Please be advised that the Board of Selectmen voted at its meeting held last evening to re -appoint George P. Wadsworth a member of the Board of Appeals for a five year term expiring March 31, 1979. The Board also voted to re -appoint the following as Associate Mem- bers of the Board of Appeals for terms expiring March 31, 1975: Logan Clarke, Jr., Haskell W. Reed, Irving H. Mabee, Robert Cataldo, Robert M. Gary and Thomas G. Taylor. These individuals have been requested to call at the office of the Town Clerk to be sworn to the faithful performance of their duties. Kenney Chairman iBOARD OF APPEALS BEARINGS April 23, 1974 A regular meeting of the Lexington Board of Appeals was held on Tuesday, April 23, 1974 at 8:00 p.m. in the Selectmen's Meeting Room of the Town Office Building. Present were George Sheldon (Vice Chairman), chairing the meeting, W. Brodhead and G. Wadsworth both regular members, and associate members H. Reed and L. Clarke, as well as, a Minute -man Publications' reporter, a LWV's observer and an audience of townspeople. Public hearings were held on the following petitions, notice having been mailed to those who should legally receive them and to town boards and officials who will or might be affected by decisions made and also advertised in the Lexington Minuteman newspaper. Nicholas A._Cannalonga, Trustee for Wagon Whe6l Realty Trust - special permit under Section 25.31 of the Lexington zoning by-law to erect and maintain a greenhouse (dimensions 16' by 20') attached to side of existing building at 927 Waltham Street. It will be constructed of glass, wood and aluminum frame. Rosina Busa for Sun Valley Farms - special permit to build a greenhouse show- room extension to the existing farm stand at 52 Lowell Street. It will be 26' wide by 48' long, approximately 11' high at the peak and will be constructed of wooden greenhouse bars, concrete blocks and 20" glass panes. The showroom will be for display of nursery plants grown on the farm. The petitioner claims that the existing farm stand is not sufficient for this purpose and that the new addition will block from view the buildings to the rear creating a more esthetically pleasing sales area for customers and neighbors. Constantine J. Eliades and Nancy Eliades - variance from the Lexington zoning by-law in order to establish as two legal building lots, lots 8 and 9 Winter Street: said lots being presently known and numbered 88 Winter Street, each lot having had adequate frontage and area according to the plan dated May 19, 1927, which created them, but the plan was not recorded until November 14, 1929 when the zoning requirements had been increased. SMM Realty Corp. - (1) finding and determination and site plan review pursuant to Section 13 of the zoning by-laws that two multi-purpose office buildings proposed to be constructed and located on property on the westerly side of Forbes Road containing 5.46 acres of land (town of Lexington Property Map 43, Lot 23), parking areas, drives and other improvements shown on plans submitted will constitute a suitable development and will not result in a substantial detriment to the neighborhood. (2) special permit pursuant to Section 12.2 of the zoning by-laws to allow the construction of the buildings shown on the plans to be used for the purposes set forth in Sections 25.40, 25.41, 25.42 and 25.71 of the Use Regulation Schedule. (3) variance pursuant to Section 12.3 of the zoning by-laws to allow: (a) the construction of Building B shown on plans which has a rear yard of less than 100 feet abutting an RO District (closest point of building is 40 feet from RO District) and a front yard of less than 100 feet abutting Forbes Road (closest point of building is 75 feet from Road), which conditions vary from Section 27, Schedule of Dimensional Controls; (b) the use of 16 park- ing spaces servicing Building B which are located within 50 feet of an RO Dis- trict in variance with Section 32.2, Schedule of Dimensional Restrictions for Parking and Loading; and (c) the design of parking spaces having a 9 foot width 1 1 April 23, 1974 (continued) Page 2 in variance with the definition of Parking Space in Part 4. (4) variance pursuant to Section 8 of Article II of the Lexington Building By-laws to allow construction of two second-class construction buildings, one containing approximately 37,500 sq. ft. of space on 3 floors of 12,500 sq. ft. each, and the other containing approximately 25,000 sq. ft. of space on 2 floors of 12,500 sq. ft. each in variance with Article X, Section 1 which allows a maximum of 10,000 sq. ft. between fire walls. The petitioner included a copy of a Certificate of Completion issued by the Massachusetts Department of Natural Resources regarding the completed site work preparation. Following the hearings the Board made the following decisions, all in public open meeting: Cannalonga - Granted unanimously with certain conditions. Busa - Denied unanimously. Eliades - Denied unanimously. SMM Realty Corp. - Granted, 4 to 0 (Mr. Clarke abstaining from voting); permit is subject to certain conditions. All pertinent material is on file.
