HomeMy WebLinkAbout1973-12-18BOARD OF APPEALS HEARINGS I December 18, 1973 A regular meeting of the Lexington Board of Appeals was held on Tuesday, December 18, 1973 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office Building. Present were Chairman Nickerson, Vice Chairman Sheldon, regular members W. Brodhead and R. Morey, associate member Robert M. Gary, a Minute -man Publications' reporter, a League of Women Voters' observer and an audience of townspeople. At the beginning of this meeting a photograph was taken for the Annual Town Report. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property abutting the petition- er's land and to all abutters of the abutters as they appear on the most recent local tax list, to town boards and officials who will or might be affected by decisions made and also advertised in the Lexington Minute -man newspaper. Follen Church Society - permission, as required under section 25.34 of the Lexington zoning by-law, to sell Christmas trees on the premises at 764 Massa- chusetts Avenue. Sun Valley Farms, John and Rosina Busa - permission, as required under section 25.34 of the Lexington zoning by-law, to sell Christmas trees and wreaths on the premises at 52 Lowell Street. Emilio Lyons - variance from the Lexington zoning by-law to build a pool 20 ft. by 40 ft. which will have a front yard setback of 21 ft. instead of the required 30 ft. The easement going through the yard on this property at 4 Hickory Street does not allow for placement of the pool in any other direction. The small house which is behind the proposed pool is on a foundation and has flagstone patios around it. Middlesex Hellenic Orthodox Association (St. Nicholas Greek Orthodox Church) - permission to build an addition to the existing non -conforming building at 17 Meriam Street which will have insufficient side yard. Trustees of Lexington Office Center Trust, Boston, Mass. (Cabot, Cabot, & Forbes) - reference is made to Petition of the undersigned dated September 15, 1972 and Board of Appeals' Permit and Finding and Determination granted October 17, 1972 and Petition of the undersigned for Variance from the Lexington Building By -Law and Board of Appeals Permit therefor granted November 28, 1972, said Finding and Determination and said Permits having been granted after hearings duly held and persons entitled to notice properly notified, except certain abutters to abutters of the premises in favor of which said Permits and Finding and Deter- mination were granted as required by General Laws, Chapter 40A, Section 17. Accordingly, in order to afford such parties proper notice, the undersigned hereby repetitions the Lexington Board of Appeals appointed under the General Laws, Chapter 40A, Section 13 to 19 as amended, for the followingiPermits and Variance as previously granted: (a) a Special Permit (Sec. 12.2 of the Lexing- ton Zoning By -Laws) permitting the construction and use by Honeywell Radiation Center of the premises shown on the Site Plan enclosed, (b) a Finding and Deter- mination that the 18,070 square foot (2 -story Building) located on a 15.2 acre December 18, 1973 (continued) Page 2 lot, southwesterly side of Forbes Road in the Cabot, Cabot & Forbes Minuteman Research Park, all as shown on plans submitted herewith, constitutes a suitable development and will not result in substantial detriment to the neighborhood, in accordance with Section 13 of said Zoning By -Laws, and (c) for a variance from Article 10 of the Lexington Building By -Law and other applicable provisions thereof, to permit construction and use on said lot of said 2 -story building of Second -Class construction with an area between firewalls not exceeding 40,533 sq. ft., the area limit now being 16,667 sq. ft. when certain sprinklers and exterior fire fighting space are installed and provided as set forth in said Article. Following the hearings the Board made the following decisions, all in public meeting: Follen Church Society - Granted unanimously for December 1973 and December 1974. Sun Valley Farms, John and Rosina Buss. - Granted unanimously for December 1973 and December 1974. Emilio Lyons.- Granted unanimously. Middlesex Hellenic Orthodox Association - Granted unanimously. Trustees of Lexington Office Center Trust, Boston, Mass. - Granted unanimously. All pertinent material is on file under the name of each petitioner in the Board of Appeal's office. Dawes, 72, former service »<_manager of the General Radio Company of Concord until his retirement in 1986, were held on Monday, December 17, at the First Parish Church. Rev. Robert Zoerheide officiated. Mr. Dawes, who lived at 10 Bar. as st., had resided in Lexington for 92 years. A graduate of Arfl4iion High hool, he was a member of M.I. T. Class of 1829 and attended Boston University College of Business' Administration. A *member of the First Parish Church, he had served as its treasurer and finance chairman. He. was active in town affairs, having served as Community Fnnd , chairman in 1950, Chairman of the .Ward of Public welfare (ltd preeidenp of tjo.4,exingto. . Active in the field of electronics, he was a life member of the IEEE and chairman of NEREM in 190 and 1956. Mr. Dawes is survived by his wife, Mildred (Salmon) Dawes and a daughter, Priscilla, both of Lex. ington; a son, David C. Dawes and three grandchildren of Pepperell; a brother, Chester L. Dawes, of Winchester; and five sisters, Ethel Smeaton, of Quincy, M a r f a n Roberts of Plymouth, Hazel Price of Andover; Ruth Dawes and Dorothy Dawes of Lexington.
