HomeMy WebLinkAbout1973-08-14BOARD OF APPEALS HEARINGS August 14, 1973 A regular meeting of the Lexington Board of Appeals was held on Tuesday, August 14, 1973 at 7.30 p.m. in the Selectmen's Meeting Room of the Town Office Building. Present were Chairman Nickerson, regular members, G. Sheldon, R. Morey, W. Brodhead and G. Wadsworth, a Minute -man Publications' reporter and an audience of townspeople. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards and officials who will or might be affected by decisions made, and also advertised in the Lexington Minute -man. William Z. Lemnios - variance of section 27 of the Lexington zoning by-law in order to build a one car garage on property located at 36 Independence Avenue, which garage will have a setback of 20 ft. instead of the required 30 ft. John G. Crowe - variance from section 27 of the Lexington zoning by-law to build an addition, approximately 3 ft. by 14 ft. to the front yard of the existing dwelling at 43 Woodcliffe Road, which addition will have a front yard setback of 27 ft. instead of the required 30 ft. William J. Hartery - for relief from the order of the Building Inspector of the town of Lexington to vacate the premises and by granting a special permit for such storage. Said permit to apply for a period of one year. It is not requested that business be conducted on the premises. Said inventory consists of approximately twenty-five (25) small plastic boats of nominal eight (8) feet to twelve (12) ft. size. The 115 Kendall Corporation - variance from the Lexington zoning by-law to reduce the size of the lots from five acres to the following: Lot 1, 427 acres, 280ft. on Bedford St., 82.8 ft. on Hartwell Avenue; Lot 2, 3.15 acres, 360 ft. on Hartwell Avenue; Lot 3, 3.01 acres, 440 ft. on Hartwell Avenue; Lot 4, 3.20 acres, 240 ft. on Mico Road, a proposed street; all as shown on plans submitted. The land is at the corner of Bedford Street and Hartwell Avenue. Following the hearings the Board made the following decisions, all in public meeting: Lemnios - Granted, unanimously, with certain conditions. Crowe - Granted, unanimously, with certain conditions. Hartery - Denied, unanimously. The 115 Kendall Corp. - Granted, unanimously with the following conditions: 1. The site design must respect the 233 -foot setback required by Section 27 Footnote (j) of the zoning by-law and be able to meet dimensional restric- tions for parking given in Section 32.2 when Bedford St. is widened. ' 2. 3. Each lot must be confined to office and research park use only. Parking shall be provided at the rate of 1 parking space for 200 s.f. of gross floor area of the building on each lot. 4. No more than 65% of the area of each lot may be covered by buildings, driveways, parking or street surfaces. 5. There shall be no direct passage through the development between Hartwell Avenue and Bedford Street.
