HomeMy WebLinkAbout1973-06-19BOARD OF APPEALS HEARINGS ' June 19, 1973 A regular meeting of the Lexington Board of Appeals was held on Tuesday, June 19, 1973 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office Building. Present were Chairman Nickerson, regular members, G. Sheldon, R. Morey, W. Brodhead and G. Wadsworth. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards and officials who will or might be affected by decisions made, and also advertised in the Lexington Minute -man. Eva Jonas and Jan Jonas - variance of the zoning by-law (section 27) in order to build an addition 23 ft. by 11 ft. to the existing house at 2 Burns Road. The addition will leave a set back of 28 ft. instead of the required 30 ft. Lois B. May and Edward A. May - variance of section 27 of the Lexington zon- ing by-law to maintain the existing dwelling with a set back of 28 ft. instead of the required 30 ft. and to build an addition to the side of the present dwelling which will have a set: back of 29 ft, instead of the required 30 ft. Living and Learning Centres, Inc., George A. Naddoff, President - permission to build a Gunite pool (in -ground, filtered, concrete, with dimensions 18 ft. by 36 ft., minimum depth 2 ft. maximum depth 4 ft.) on property located at 80 Maple Street as shown on plot plan. Appeal is made under Section 12.1 of Lexington Zoning By -Law as a result of our inability to obtain a building permit from the building inspector, and for the purpose of expanding the use of the current facility as granted by previous special permit. Campanelli, Inc.(Tyco Laboratories) - variance of Article X, Sections 1 and 2 of the town of Lexington building by-laws for Tyco Laboratories at 4 Hartwell Place as follows: That the allowable area between fire walls be increased from 16,667 s.f. to 23,000 s.f. The petitioner is the designer and builder for Tyco Laboratories for a 40,000 s.f, single story office and light manufac- turing building. Schumacher Realty Trust - variance of section 27 of the Lexington zoning by- law in order to build a house on the property at 1 Valley Road which will have a set back of 24 ft. instead of the required 30 ft. Following the hearings the Board made the following decisions, all in public meeting and all unanimous. Jonas - Granted, with a set back of 27 ft. Construction must begin before one year from date. May - Granted, to maintain present dwelling with a set back of 27 ft. 6 in. and to build an addition with a set back of 28 ft. 6 in. Construction must ' begin before one year from date. Living and Learning - Granted with the following conditions: June 19, 1973 hearings (continued) Page 2 'conditions: 1. The pool shall be completely fenced. 2. The pool shall be operated only during school hours and in conjunction with the school program. 3. There shall be no less than one supervisor for every 5 children. 4. Services and utilities for draining and filling shall be installed according to the town engineer's specifications. 5. All rules and regulations of the board of health shall be followed. 6. Construction shall be started within one year from date. Before acting on this permit, it will be necessary to secure a building permit from the building inspector. Campanelli, Inc. (Tyco) - Granted with the condition that the building must be fully sprinklered to the satisfaction of the town of Lexington building and fire departments. Schumacher - granted with the condition that construction must be started within one year from date. All pertinent material is on file under the name of each petitioner in the Board of Appeals' office. The meeting adjourned at 10:35 p.m. 1 Evelyn F. Cole Clerk
