A regular meeting of the Lexington Board of Appeals was held on Tuesday,
May 8, 1973 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office
Building. Present were Chairman Nickerson, regular members, G. Sheldon, R.
Morey and G. Wadsworth, and associate member H. Reed. An audience of inter-
ested townspeople were also present, as well as, a reporter from the Lexing-
ton Minute -man Publications.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards and officials who will or might be affected by decisions made,
and also advertised in the Lexington Minute -man.
Mary -Brenda Cortell - variance of the Lexington zoning by-law under section
27 in order to build an addition to the existing dwelling at 12 Partridge
Road, which will leave a 14 ft. 3 in. side yard instead of the required 15
ft. side yard.
Mildred E. Whitney - renewal of the special permit approving as an accessory
use, in accordance with section 25.81 of the zoning by-law of the town of
Lexington, as amended to September 15, 1972, the use of a portion of her
residence located at 1415 Massachusetts Avenue for the operation of a profes-
sional secretarial service, incidental to her residence.
Hayg and Brigitte Boyad_jian - variance to maintain the existing dwelling with
a 15 ft. front yard instead of 30 ft. and the garage with no frontage at 43
Fern Street and to build an addition to the existing dwelling which will leave
a side yard of 10 ft. instead of 15 ft. and a front yard of 13 ft. instead of
30 ft. The addition will have a basement, bedroom and two bathrooms. Also,
the dining area will be enlarged. Changes will be made in the existing porch
and stairway.
Lexington Investment & Development Corporation, John M. Hamilton & Craig A.
Foster - finding and determination that the proposed location of building,
the proposed major topographical changes, if any, and the planned provisions
for waste disposal, surface and ground water drainage, erosion control, park-
ing areas, loading areas, maneuvering areas,driveways, and the location of
intersections of driveways and streets are such that the proposed construction
of a new building will constitute a suitable development and will not result
in substantial detriment to the neighborhood. Said parcel of land is located
at 4 Militia Drive. Petitioners also request a variance of the minimum park-
ing requirements under sections 31 and 32 to permit the construction of a
lesser number of parking spaces all as shown on plans. The building to be
constructed is to be used for office purposes, that is, offices for adminis-
trative, executive, professional and similar purposes.
Following the hearings the Board made the following decisions, all in
open meeting:
Mary -Brenda Cortell - granted unanimously, subject to certain conditions.

' Mildred E. Whitney - denied by a vote of 2 to 3, Mr. Sheldon and Mr. Reed
voting in favor. Mr. Nickerson, Dr. Wadsworth and Mrs Morey voting in
opposition.

Hayg and Brigitte Boyadiian - granted unanimously with certain conditions.
Lexington Investment & Development Corporation - granted subject to the
following conditions:
1. Hours of operation shall be 8 a.m. to 5 p.m. five days a week with
occasional 8 a.m. to 1 p.m. on Saturdays.
2. Signs must conform to the Sign By -Law unless subsequent permission is
obtained. No flashing or unduly bright signs are allowed.
3. Rules and regulations of the Fire and Health Departments must be
followed.
4. No advice has been received from the Conservation Commission that this
area is under its control or that Hatch Act permission is required.
5. Copy of the Assistant Town Engineer's letter dated May 3, 1973 and re-
ceived May 8, 1973 is appended with the agreement that the petitioner
will conform to the first ten items.
6. Construction must start within one year from this date.
Before acting on this permit, it will be necessary to secure a building per-
mit from the Building Inspector and in accordance with State law, before
this permit becomes effective, notice that such a permit has been issued
must be recorded at the Registry of Deeds by the Petitioner.
All pertinent materia] is on file under the name of each petitioner in
the Board of Appeals' office.
