HomeMy WebLinkAbout1973-04-03BOARD OF APPEALS HEARINGS ' April 3, 1973 A regular meeting of the Lexington Board of Appeals was held on Tuesday, April 3, 1973 at 7:30 p.m. in the G 15 meeting room of the Town Office Build- ing. Present were Chairman Nickerson, regular members G. Wadsworth and G. Sheldon and associate members R. Cataldo and L. Clarke. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards and officials who will or might be affected by decisions made, and also advertised in the Lexington Minute -man. Clifford and Sandra E. Larson - variances to maintain the present dwelling at 25 Outlook Drive with a 7 ft. side yard, instead of the required 7.5 ft., and to build an addition at the rear of dwelling. The addition will leave a side yard of 6.4 ft., all according to plan submitted. Ralph D. Cataldo - permission to continue the operation of a roadside stand at 61 Bow Street for the sale of vegetables, flowers, plants and other nursery and farm goods and for the sale of Christmas trees, wreaths, etc. in the appropriate season. Ralph D. Cataldo - permission to remove excess loam from the area on the easterly side of Bow Street, now being filled; the loam to be removed is that ' which is not necessary for continued use of the premises at 61 Bow Street for agricultural purposes. Campanelli, Inc. - site plan review for a special permit under Section 13 of the Lexington zoning by-law and for a finding and determination on a proposed facility for Tyco Laboratories, Inc. at 4 Hartwell Place, in accordance with plans submitted; that the proposed construction will constitute a suitable development, and will not result in substantial detriment to the neighborhood. Land presently owned by Hartwell Realty is under purchase and sale agreement with Campanelli. Following the hearings the Board made the following decisions, all in open meeting: Clifford and Sandra E. Larson - granted unanimously. Ralph D. Cataldo (roadside stand) - granted on a vote of 4 to 0, Mr. Cataldo abstaining. This permit is subject to the following conditions: 1. The premises shall be kept in a neat and orderly condition. 2. No flood lights shall be installed. 3. There shall be no parking on Bow Street. 4. The stand will operate 7 days a week during the daylight hours except during the period November 15 through December 25 when closing hours will be 7 p.m. ' S. Christmas trees and wreaths may be sold during the period of November 15 through December 25. 6. No large quantities of bags of fertilizer or wood shall be stored out- side for sale. April 3, 1973 hearings (continued) M? 7. This permission will terminate April 3, 1975. Ralph D. Cataldo (remove loam) - granted on a vote of 4 to 0, Mr. Cataldo abstaining. This permit is subject to the following conditions: I. No holes that would constitute a safety hazard shall be left unfilled for more than a working day. 2. A surface of 15" of loam will be required with a minimum of 12" of clean subsoil below. A maximum of 2,500 yards of loam may be removed. 3. Trucks removing and introducing loam and fill shall operate only between the hours of 8:00 a.m. to 5 p.m. weekdays and from 8 a.m. to 12 noon on Saturdays. 4. All provisions of the Hatch Act shall be observed. 5. This permit is subject to Board of Health regulations. Campanelli, Inc. (Tyco Labs) - no decision was made to grant or deny the request. The Board of Appeals voted to hold a special meeting on April 11th at 7:30 p.m. to extend the discussion and to hear reports from the Planning Board, Engineering Department and Conservation Commission.
