BOARD OF APPEALS HEARINGS
' March 20, 1973
A regular meeting of the Lexington Board of Appeals was held on Tuesday,
March 20, 1973 at 7:30 p.m. in the selectmen's meeting room of the Town Office
Building. Present were Chairman Nickerson, regular members Mr. Sheldon and
Mrs. Morey and associate members Mr. Mabee and Mr. Reed.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards and officials who will or might be affected by decisions made, and
also advertised in the Lexington Minute -man:
James B. Catalano - permission to continue operations of retail business of
selling flowers, produce and plants grown on the premises at 643 Waltham Street.
Waltham American Trust, c/o Cabot, Cabot & Forbes Company - finding and deter-
mination that the construction of additional parking for 118 cars on the 8
acre lot at 45 Hartwell Avenue, located as shown on site plan submitted to
the Board of Appeals, will constitute a suitable development and will not re-
sult in substantial detriment to the neighborhood in accordance with section
13 of the zoning by-law.
Robert A. Marasca - variance from the zoning by-law in order to build a garage
(20 ft. by 24 ft.) on the property at 240 Woburn Street. The proposed garage
would leave a sideyard of five (5) ft. instead of the required fifteen (15)
ft. The reason for the proposed location of the garage is to avoid the neces-
sity of cutting down a 40 ft. tree.
Alden L. and Judith A. Webster - to vary the zoning by-law so as to maintain
the existing non -conforming dwelling with its easterly side yard of 8.80 ft.
to 9.26 ft. and front yard of 15 ft. on the property known as 113 North Street
and to construct a proposed extension of said dwelling continuing the noncon-
forming easterly side yard ranging from 8.42 ft. to 9.26 ft. reduced by the
proposed roof overhang of up to 1.5 ft., all as shown on the plans submitted.
Lawrence G. Trebino, Trustee of Trinda Realty Trust - variance to maintain the
existing building located at 33 Blake Road, having a front yard setback of
nineteen (19) ft. instead of the required thirty (30) ft., a side street set-
back of seventeen (17) ft. instead of the required twenty (20) ft. and a side
yard setback of fourteen (14) ft. instead of the required fifteen (15) ft.,
all as shown on the plot plan prepared by Miller & Nylander dated February 9,
1973.
The 115 Rendall Corporation - site plan review and approval for a special
permit pursuant to section 13 and related subsections of the zoning by-law
of the town of Lexington, and to make a finding and determination that the
proposed placement of buildings, major topographic changes, provisions for
waste disposal, surface and ground water drainage, erosion control, parking
areas, loading areas, maneuvering areas, driveways, and the location of inter-
sections of driveways and streets will constitute a suitable development and
will not result in substantial detriment to the neighborhood. The proposed
use of the addition to the building numbered 29 Hartwell Avenue is office and

research and development; is for the use of the present tenant, Data Resources,
Inc.; and is shown as phase 3 on the plans submitted. The proposed use of the
canopy for the building numbered 27 Hartwell Avenue is to permit passengers to
enter and exit at the front entrance to Signatron, Inc. under cover.
Following the hearings the Board made the following decisions, all in
open meeting:
James B. Catalano - granted unanimously subject to the following conditions
1. The premises shall be kept in a neat and orderly condition at all times.
2. No flood lights shall be used.
3. Sufficient parking space shall be provided so that cars shall not be parked
on the street.
4. Only one sign shall be permitted.
5. This permit shall expire March 20, 1975.
Waltham American Trust, c/o Cabot, Cabot & Forbes Compare - granted unanimously
subject to the following conditions:
1. Oil and grease traps and catch basins should be provided in all parking
areas to reduce pollutants intering the swamp.
2. Salt shall not be used to melt snow and ice in the wintertime.
3. Approved methods of erosion control should be used in all disturbed areas.
4. All provisions of the Hatch Act shall be observed.
5. Construction shall begin within one year from date.
Robert A. Marasca - denied. The vote was 1 in favor, 4 in opposition to the
petition, Mr. Sheldon voting in favor.
Alden L. and Judith A. Webster - granted unanimously subject to the condition
that construction shall begin within a period of 18 months from this date.
The reduction of the side yard because of roof overhangs was also included.
Lawrence G. Trebino, Trustee of Trinda Realty Trust - granted unanimously.
The 115 Kendall Corporation - granted unanimously subject to the following
conditions:
1. The present parking area may be grassed over and the whole parking area
moved to the back of the lot as shown on the plan.
2. The drain line shall be shown as a straight line on the utility plot plan
between the catch basins with inverts of 122.61 and 123.45.
3. The utilities should be labeled existing and proposed.
4. The construction of the above areas and utilities shall conform to the
Engineering Department as to the exact location, size, materials and
manner of installation.
5. Approved methods of erosion control should be used in all disturbed
areas.

parking areas to reduce pollutants entering the swamp.
7. Salt shall not be used to melt snow and ice in wintertime.
8. Construction shall begin within one year from date.
All pertinent material is on file under the name of each petitioner in the
Board of Appeals' office. The meeting adjourned at 10:30 p.m.
