HomeMy WebLinkAbout1973-02-20r BOARD OF APPEALS HEARINGS February 20, 1973 At 7:25 p.m. Vice Chairman Sheldon opened the meeting in Room G 15 of the Town Office Building to discuss further the Curve Trust Decision (see minutes of January 30, 1973). Robert Tillinghast was present to inform the Board members that the third floor tenants would be moving out of his build- ing at 703-705 Massachusetts Avenue. Debate and discussion on this petition continues as the Board becomes more aware of the complex establishment on this property. The decision was deferred until the Board could meet in ex- ecutive session after the scheduled hearings for this evening. At that time the Board voted to grant the petition and file it with the Town Clerk. Present were Vice Chairman Sheldon, regular members Wadsworth, Dawes and Mrs. Morey, and associate member Brodhead. At 7:30 p.m. the regular meeting of the Lexington Board of Appeals was held. Several interested townspeople remained throughout the public hear- ings held on the following petitions, notice having been mailed to the peti- tioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards who will or might be affected by decisions made, and also advertised in the Lexington Minute -man: Bernard Huang - variance of the zoning by-law in order to build, on the prop- erty at 8 Tricorne Road, a greenhouse (16 ft. by 14 ft.) which will leave a side yard of 11 ft. instead of the required 15 ft. Varian Associates - special permission for the construction of a standing sign at 121 Hartwell Avenue according to drawings submitted. The petitioner, Varian Associates, is the owner of the referenced parcel. Robert E. Burbidge - variance to maintain the existing dwelling and proposed 20' by 24'2" addition at 8 Manning Street with a side yard of 4'3" instead of the required 10', all in accordance with plot plan submitted. Guiseppe M. Vitale - variance of the zoning by-law to maintain the existing dwelling at 11 Rindge Avenue which has a 5.8 ft. sideyard instead of the required 10 ft. Louise M. Gauthier, Elise G. Palis, and Louis B. Gauthier - variance from the zoning by-law to allow for the maintenance of the existing dwelling facing on Milliken Road, so-called, with insufficient front yard of 22 feet, more or less, and being numbered 55 Pleasant Street, said dwelling to be on a lot containing 46,857 square feet, more or less, being shown as Lot 58A, and to allow for the existence of a separate lot, containing 35,907 square feet more or less, to the southeast of said dwelling, said lot to have frontage of 150 feet on Pleasant Street and to have its entrance on Pleasant Street, being shown as Lot 58B, all as shown on plan dated November 1, 1972, said plan filed with the application. ' N. A. McLeod, "International Conservatory of Music" - for permission to main- tain an existing free standing sign "International Conservatory of Music" in front of my home, 375 Lowell Street, Lexington. The sign is wooden, approxi- mately 30" wide by 18" long. This home is leased by myself with an option to L r February 20, 1913 hearings continued: ' purchase in September 1973. 1 Page 2 Following the hearings the Board made the following decisions, all in open meeting. Bernard Huang - granted unanimously subject to the condition that it be erected within one year from date. Varian Associates - granted unanimously. Robert E. Burbidge - denied on a vote of 4 to 1, Mr. Sheldon voting in favor. Guiseppe M. Vitale - granted unanimously. Louise M. Gauthier, Elise G. Palis, and Louis B. Gauthier - granted unanimously subject to the following conditions: 1. Milliken Road is to continue to be a private driveway, over which the owners of lot 58A are to retain rights of access. 2. No additional houses are to be constructed with frontage on Milliken Road, whatever the division of land, except in conformance with a subdivision approved under the Subdivision Control Law. 3. This variance is subject to any rules or regulations that the Board of Health might impose for an adequate septic system. N. A. McLeod - denied unanimously.
