Note: For clarification it is here stated that Mrs. Morey,
formerly an associate member became, officially, a regular
member on June 20, 1972. On that same date Mr. Cataldo
was appointed an associate member. Both were appointed to
these positions by the Board of Selectmen. (see May 23, 1972)

The annual organization meeting for 1973 was held January 30, 1973.
BOARD OF APPEALS HEARINGS
January 2, 1973
' At 7:15 p.m. regular board members, Nickerson, Sheldon, Wadsworth and
Mrs. Morey, and associate members Brodhead, Reed and Clarke met in public
session in Room G 15 of the Town Office Building. The first order of busi-
ness was to continue discussion of the Albert R. Piantedosi petition for a
variance from the zoning by-law to allow for the temporary parking of not
more than fifteen (15) motor vehicles on the lot owned by the applicant at
443 Lincoln Street. The Board voted unanimously on December 12, 1972 to
grant the petition subject to town counsel's reviewing of the wording of
the permit. Advice from Town Counsel indicated that the Board had the right
to make the decision. The permit will be filed as usual with the Town Clerk.
At this meeting a picture, which was later rejected, was taken for the
town report.
At 7:30 p.m. hearings were held on the following petitions,': notice hav-
ing been mailed to the petitioners, to the owners of all property deemed by
the Board to be affected thereby as they appear on the most recent local tax
list, to town boards and officials who will or might be affected by decisions
made, and also advertised in the Lexington Minute -man:
The Lexington Professional Building Trustees, Alfred P. Tropeano and Gladys E.
Tropeano, Trustees --permission to maintain two approximately 24" by 29" two
faced hanging signs, one bearing the inscription "The Professional Building"
' and the other being a directional and parking sign, as presently exists at the
land with the buildings thereon numbered 114 Waltham Street. This petition is
filed to vary the applicable provisions of the Town of Lexington Sign By -Law.
The 115 Kendall Corporation - permission to erect a standing sign at 27-29
Hartwell Avenue, Lexington.
Alan W. Ricketts, Jr. and Anne Ricketts - permission to vary the zoning by-law
so as to maintain on the property known as and numbered 90B Hancock Street an
existing dwelling house 12'8" from the northwesterly side line instead of the
required 15' and an existing attached greenhouse 8'8" from the said northwesterly
side line instead of the required 15'.
Louis W. Slocomb and Pauline J. Slocomb - variance from the present zoning by-
law requirements, allowing the petitioners to obtain a building permit to con-
struct a single family residence on a parcel of land at 54 Dexter Road. Said
parcel is shown as lots 36 and 37 on Block 22, on a plan of land recorded in
the Land Court. All of said boundaries are determined by the Court to be loca-
ted as shown on a subdivision plan, as approved by the Court, filed in the
Land Registration Office, a copy of which is filed in the Registry of Deeds for
the South Registry District of Middlesex County in Registration Book 118, Page
85, with Certificate 17512.

Following the hearings the Board made the following decisions, all in
open meeting:
The Lexington Professional Building Trustees - granted unanimously with the
following conditions:
1. The 3'10" high sign shall be protected by bushes.
2. Both signs shall be fixed instead of swinging.
3. No lighting shall be permitted.
The 115 Kendall Corporation - granted unanimously. Signs shall be in accord-
ance with drawing submitted by Metal Letters Corporation and located as shown
on the drawings.
Alan W. Ricketts, Jr. and Anne Ricketts - granted unanimously.
Louis W. Slocomb and Pauline J. Slocomb - denied unanimously.
' Kellikian - withdrawn
Marion H. Snow - granted unanimously, after much discussion and deliberation
and with the provision that we receive a letter from the Planning Board stat-
ing that this is not a subdivision. The Chairman left the Board of Appeals'
meeting to request the letter from the Planning Board, who were meeting in
regular session. No letter was forthcoming. The Chairman wrote a letter to
the Planning Board requesting that they comment on the Snow petition. A let-
ter was received but did not contain what the Board of Appeals had requested.
The permit was held and not filed with the Town Clerk pending further discus-
sion by the Board of Appeals. On January 30, 1973 the decision was discussed
again at length and finally the permit for variance was filed with the Town
Clerk allowing Marion H. Snow to subdivide her property located on a right of
way. The Planning Board letter was attached as part of the decision and the
following statement is on the permit: This decision is rendered by the Board
of Appeals because it believes Mrs. Hagedorn's (attorney) statement that a
hardship exists. Furthermore the Board believes that because of lack of any
opposition no detriment to the neighborhood will result.
All pertinent material is on file under the name of each petitioner in
the Board of Appeals' office.
