HomeMy WebLinkAbout1972-12-12BOARD OF APPEALS HEARINGS December 12, 1972 A regular meeting of the Lexington Board of Appeals was held on Tuesday, December 12, 1972 at 7:30 p.m. in the selectmen's meeting room of the Town Office Building. Present were Chairman Nickerson, regular members Sheldon, Wadsworth and Mrs. Morey, and associate member Brodhead. Public hearings were held on the following petitions, notice having been mailed to the petitioners, to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, to town boards and officials who will or might be affected by decisions made, and also advertised in the Lexington Minute -man, except that the first two listed below were withdrawn officially as indicated under decisions, notices of those withdrawn having been mailed to the abutters of the petitioner's property involved and others interested. Hearings scheduled as follows: F. Meade Reynolds - petition for a variance of the zoning by-law to allow the use of land as a building lot for a one -family dwelling. The land is numbered 3 Aaron Road and shown as lots 8-B and 9 on a plan entitled "Plan of Land in Lexington", dated December 3, 1968, by Albert A. Miller and Wilbur C. Nylander, containing 15,000 square feet of land and having a frontage on Aaron Road of 120 feet. The applicant has an option to purchase. This hearing officially withdrawn by the applicant. Notice of this fact was declared at this hearing. ' Robert A. Patterson, Coordinator of Special Education * petition for a special permit, under Section 25.21 of the zoning by-law to conduct a co-educational prevocational life care training program on the premises known as 45 Forest Street withdrawn. It requested a maximum of twelve young adults (17 to 22 years). This school will be in session from 9 a.m. to 4 p.m., Monday through Friday from September through June. There will be one teacher and two aides. This property, owned by Lexington Friends Community Residence, will be leased to the school. Notice that this petition was withdrawn was made at this hear- ing and all abutters and others interested were notified prior to this meeting. Albert R. Piantedosi - petition for a variance from the zoning by-law to allow for the temporary parking of not more than fifteen (15) motor vehicles on the lot owned by the applicant at 443 Lincoln Street. Edward F. and Shirley L. Donnelly - petition for a variance of the zoning by- law to build a one-story addition (12' x 18') to the existing house at 19 Emerald Street, which will leave a side yard of 15.7 feet instead of the re- quired 20 feet. The proposed addition will be for a dining area and family room. William E. Maloney - petition for a special permit under Sections 12.2 and 24.5 of the zoning by-law for permission for the applicant, his lessee or nominee, to conduct a nursery on premises located at 661 Lowell Street, con- sisting of approximately 5.1 acres. The applicant has an option to purchase the premises. Peter S. and Betty A. Milinazzo - petition for a variance to maintain a tree house on property at 27 Ewell Avenue. r -2 ' Following the hearings the Board made the following decisions, all in open meeting: F. Meade Reynolds - petition was WITHDRAWN by the petitioner. U Robert A. Patterson - petition was WITHDRAWN by the petitioner. Albert R. Piantedosi - granted subject to town counsel's reviewing the word- ing of the permit. The vote was unanimous. Edward F. and Shirley L. Donnelly - granted subject to the condition that construction begin within one year. The vote was unanimous. William E. Maloney - denied. Mr. Sheldon made the motion to grant the peti- tion. Mr. Brodhead seconded the motion. After discussion the petition was denied. The vote was three in favor, two in opposition. Dr. Wadsworth and Mr. Dawes voted in opposition. At least a 4 to 1 vote in favor is necessary to grant this permission. Peter S. and Betty A. Milinazzo - denied unanimously.
