October 3, 1972
A regular meeting of the Lexington Board of Appeals was held on Tuesday,
October 3, 1972 at 7:30 p.m. in the selectmen's meeting room of the Town Office
Building. Present were Chairman Donald E. Nickerson, regular members Howard H.
Dawes, George C. Sheldon, George P. Wadsworth and Ruth Morey, as well as sev-
eral interested townspeople.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards who will or might be affected by decisions made, and also adver-
tised in the Lexington Minute -man:
Massachusetts Institute of Technology Lincoln Laboratory for a special permit
under Section 30 of the Zoning By -Law of the Town of Lexington in order that
it may erect on premises, owned by it, at 238 Wood Street, an experimental
radar antenna tower hereinafter described, and at a location shown on a plot
plan (Exhibit A) and sketch (Exhibit B) filed herewith.
This experimental radar antenna tower will consist of a steel structure
66 feet in height with an antenna and pedestal 18 feet high located on top of
the structure. Total height from the ground to the top of the antenna will
be 84 feet. The antenna tower will be located approximately 400 feet back
from Wood Street.
' This installation will be used to determine state -of -the art radar and
signal processing techniques which can be applied to improve airport radar
surveillance. The effort is sponsored by the Federal Aviation Agency. The
MIT Field Station area for the antenna installation has been chosen because:
(1) it is necessary to have high elevation for better radar coverage, and
(2) a fast digital signal processor located at Lincoln Laboratory is required
to demonstrate the techniques proposed.
Although the premises is in an RO District, it has been used as part of
Lincoln Laboratory as a field station in the study of electronics and related
radar for many years prior to the :Zoning By -Law, so that it is a non -conform-
ing use. In experimental work of this kind antenna structures such as the
one proposed are temporary in nature.
YOUVILLE HOSPITAL, Sister Annette Caron, S.G.M., Adminstrator - for special
permission under Section 25.22 of the Lexington Zoning By -Law to build and
maintain at 10 Pelham Road a 150 bed nursing home annex to Youville Hospital
which is also owned and operated by the Grey Nuns Charity, Inc. We would
plan on using the present structures with minimal modification along with the
addition of one new structure. The proposed new structure would be consis-
tent with architectural requirements set down by the town of Lexington. The
new addition will be 205 feet by 85 feet and be three stories in height.
L and B Realty Trust - petition for permission to subdivide the property loca-
ted at 1037-1049 Massachusetts Avenue into two (2) parcels as follows:
1. 1037 Massachusetts Avenue, Lexington, a lot containing 1.4 acres of
' land, having 120.45 feet of frontage instead of the required 125 feet
of frontage; and
2. 1049 Massachusetts Avenue, Lexington, a lot having 50 feet of frontage
instead of the required 125 feet of frontage and 5,100 square feet of

' land instead of 15,500 square feet, all as shown on plan submitted.
Nancy and Chi -Hua Wang - petition for a variance on the property located at
106 Pleasant Street to permit the construction of a tool shed of the dimen-
sion 12 feet by 5 feet by 7 feet high between our fence and house with a
4 foot side yard instead of the required 15 feet.
Ginn and Company - petition for permission to erect identification sign at
entrance to Ginn and Company driveway at 191 Spring Street.
Sign will have two faces perpendicular to Spring Street with letter-
ing "Xerox" and "Ginn and Company" on each face. Sign will be unlighted,
constructed of concrete with aluminum letters on an aluminum panel attached
to concrete, and will enclose Edison Company meter box presently free stand-
ing at the location proposed. Each side of sign will be 10'2" long and 5'6"
high. The two sides will be 5'4" apart to enclose the meter box on two sides.
The third side facing Spring Street will be enclosed by a metal gate for
limited access by the Edison Company and the back will be open for direct
access to the meters. The sign is designed to conceal the meter box which
is a necessary but not an attractive structure. The aluminum panel will be
gray, with white "Xerox" letters and black "Ginn and Company" letters. The
gate will be black. Concrete will be natural color to match building.
Anthony R. Cataldo, Gold Ribbon Farms - petition to renew permit to process
and sell fruits and vegetables at premises located at Gold Ribbon Farms,
1265 Massachusetts Avenue, Lexington, Massachusetts.
Following the hearings the Board made the following decisions, all in
open meeting.
MIT -Lincoln Laboratory - granted, unanimously. (Mrs. Morey would have pre-
ferred postponing the decision, but deferred to other members and made the
vote unanimous.)
Youville Hospital - granted unanimously, to build and maintain at 10 Pelham
Road a 150 bed nursing home annex to Youville Hospital which is also owned
and operated by the Grey Nuns Charity, Inc., substantially in accordance with
drawings by Maguolo and quick, dated August 1972 and located on plot plan
submitted. The building shall be three stories in height, 205' by 85' and
37' high and shall also be permitted a connection to the present structures
from the new building. The building shall be constructed in reasonable con-
formity to the present building as far as materials are concerned and will
be subject to the following conditions:
1. The property shall be utilized as a nursing home annex to Youville
Hospital, Cambridge, Massachusetts.
2. The structure shall be built for a maximum permitted capacity in the
entire complex of 160 beds for nursing home patients.
3. Fifty parking spaces shall be supplied for this new building.
4. All services shall be installed with the approval of the Lexington
Public Works Department.
' 5. All regulations of the Public Health Department must be followed.
6. Approval must be obtained from the Lexington Fire Department before
and doting construction.

' 7. Before a building permit can be issued a "certificate of need"
must be obtained by the proper Massachusetts Authority.
8. Construction must be started within a year from date. (Oct. 3,
1973)
9. Lighting during the night shall be restricted to parking areas and
those necessary for safety.
and - the issuance of this special permit shall not in any manner affect
the requirement that a building permit be obtained. The petitioner shall
have the obligation to record a notice of this conditional special permit
as required by statute.
L and B Realty Trust - denied on a vote of 4 to 1, Mr. Sheldon voting in
favor of granting the petition.
Nancy and Chi -Hua Wang - granted, unanimously, to build and maintain a tool
shed, 8 ft. by 5 ft. by 7 ft. high, on their land at 106 Pleasant Street
with a side yard of 5 ft. instead of the required 15 ft.
Ginn and Company - denied, unanimously.
Anthony R. Cataldo, Gold Ribbon Farms - granted, unanimously, with the fol-
lowing conditions:
1. This permit shall cease one year from October 27. (10/27/73)
2. The premises shall be kept neat and clean.
3. No exterior lighting or signs shall be permitted.
4. No fruits or vegetables shall be sold at retail.
5. No by-products from the use of materials shall be stored outside the
building.
6. Suitable screening of the processing building shall be installed and
maintained (stipulated as condition (1) of July 1969, if not already
done. (1969 stipulation- "sufficiently high screening shall be instal-
led at the rear of the manufacturing building so as to make it reason-
ably invisible from the rear").
7. No trucks shall be permitted to enter or leave the premises after 5 p.m.
or before 7 a.m., unless for emergency purposes.
All pertinent material is on file under the name of each petitioner in
the Board of Appeals' office.
