April 18, 1972
A regular meeting of the Lexington Board of Appeals was held on Tuesday,
April 18, 1972 at 7:30 p.m. in Room G15 of the town office building. Present
Present were Chairman Nickerson, regular members Dawes and Wadsworth, and
associate members Ruth Morey and Irving H. Mabee.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards who will or might be affected by decisions made, and also adver-
tised in the Lexington Minuteman:
Four Star Realty Trust - a variance in order to maintain the residence at
524 Marrett Road, Lexington, Middlesex County, Massachusetts, which resid-
ence does not have adequate setback or side yard as required by the Lexington
Zoning By -Law.
Four Star Realty Trust - a variance to maintain the residence at 17 Middle
Street, Lexington, Middlesex County, Massachusetts, which residence does not
have adequate setback as required by the Lexington Zoning By -Law.
Continental Trust - permission to erect and maintain a sign approximately
three feet high and twenty feet long on the easterly side of the building
located at 703 Massachusetts Avenue. Continental Trust is the owner of the
' property.
Ralph Cataldo - permission to erect a steel framed building approximately
eighty-five feet long and thirty-eight feet wide on the premises located at
61 Bow Street. The building shall be used for the storage of farm equipment
and supplies.
Florence Luongo - permission to erect and maintain a roadside stand on the
property located at 53 Pleasant Street. The petitioner is the owner of the
property.
Amy Samoylenko (The Lexington Mews) - a special permit under Section 25 of
the Lexington Zoning By -Law to operate and maintain a theatre and restaurant
as provided under Section 12.2 of said By -Law. They will be located in the
building to be constructed at 10 Muzzey Street.
Following the hearings the Board made the following decisions, all in
open meeting:

Continental Trust - granted by a vote of 4 to 1, Mrs. Morey voting in opposition.
The following conditions were imposed:
1. A background shall be provided for the sign so it will not project above
the roof line.
2. The sign may be of metal frame with plastic front and be illuminated from
the interior.

' 3. The sign shall not be lighted after 9 p.m.
4. This sign shall be the only one on the structure except the one on the
front of the building.
5. The design, etc. of the sign shall be subject to the approval of the
Historic District Commission.
Ralph Cataldo - granted, subject to the following conditions:
1. No inflammable materials shall be stored in the building.
2. All rubble in the vicinity of the building shall be covered.
3. The fence toward Melrose Street shall be put in good condition.
4. Conditions #2 and #3 shall be complied with by January 1, 1973 and the
building itself shall be started within a period of one year from this
date. (April 18, 1973)
Before acting on this permit, it will be necessary to secure a building
permit from the Building Inspector.
This permit was granted under Section 6 of the Building By -Law, a
request of the Building Inspector.
Florence Luongo - denied by a vote of 4 to 0, the chairman abstaining from
voting.
Amy Samoylenko - (The Lexington Mews) - granted, subject to the following
conditions:
1. Hours of operation shall be from 12 noon to 11 p.m.
' 2. No excessively bright lights or odors shall be permitted.
3. Rules and regulations of the Board of Health must be met.
4. Rules and regulations of the Fire Department must be met.
5. A certificate of appropriateness must be obtained from the Historic
Districts Commission.
6. Construction must be started one year from date. (April 18, 1973)
Before acting on this permit, it will be necessary to secure a building
permit from the Building Inspector.
Also, this must be registered with the Registry of Deeds.
A standing room only audience crowded the room on the ground floor of
the town office building, room G15. People came and went throughout the
entire evening. Members of the Planning Board and a Lexington Minute -man
reporter as well as others were present as the wording of permits and vari-
ances was dictated.
All pertinent material is on file under the name of each petitioner.
The meeting adjourned officially at 11:25 p.m.
