' A regular meeting of the Lexington Board of Appeals was held on Tuesday,
February 29, 1972 at 7:30 p.m. in the selectmen's meeting room of the town
office building. Present were Chairman Nickerson, regular members Dawes and
Sheldon, and associate members Brodhead and Mrs. Morey.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners, to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list, to
town boards who will or might be affected by decisions made, and also adver-
tised in the Lexington Minute -man:
A. Ben and Marion M. Freitas - variance in order to erect a garage on property
at 45 Lincoln Street which will have a 5 ft. side yard instead of the required
12 ft.
Nancy and Chi -Hua Wang - variance on the property located at 106 Pleasant Street
to allow the present carport to be made into a garage and to construct an addi-
tional room behind the garage leaving a side yard of 14 ft. instead of the
required 15 ft.
Honeywell Inc., Radiation Center - special permission, under section 12.3 of
the zoning by-law to include light manufacturing activity of electronic and
optical mechanical assemblies on the premises at 2 Forbes Road.
Itek Corporation - permission to erect and maintain two single sided, non -
illuminated, free standing signs, one to identify the property of Itek Corp. at
10 Maguire Road, the other to indicate the visitor's parking area.
' Mildred E. Whitney - special permit approving as an accessory use, in accordance
with section 25.81 of the zoning by-law, the use of a portion of her residence
located at 1415 Massachusetts Avenue for the operation of a professional secre-
tarial service, incidental to her residence.
Following the hearings the Board made the following decisions, all unani-
mous, in open meeting:
A. Ben and Marion M. Freitas - granted.
Nancy and Chi -Hua Wang - granted.
Honeywell Inc., Radiation Center - granted.
Itek Corporation - granted.
Mildred E. Whitney - granted, as follows: special permission granted to Mrs.
Mildred E. Whitney to continue to use a portion of her residence located at 1415
Massachusetts Avenue for the operation of a secretarial service, incidental to
her residence with the understanding that this permission is granted contrary to
by-law provisions, and that the term of her operating her business shall be ter-
minated March 1, 1973, and further that she shall make sure that there is no
parking in connection with her business except in her driveway, and that the
business shall not be conducted obviously later than 6 p.m.
This permission is given against our better judgment as regard zoning by-law
regulations and let it be distinctly understood that we will not entertain
another petition as we feel we have been fair and reasonable in allowing Mrs.
Whitney another year (to March 1, 1973) to terminate her business.
All pertinent material is on file under the name of each petitioner.
