' A regular meeting of the Lexington Board of Appeals was held on Tuesday,
January 25, 1972 at 7:30 p.m. Present were Chairman Nickerson, regular members
Dawes, Sheldon and Wadsworth and associate member Brodhead. A standing room
only audience crowded the selectmen's meeting room of the town office building.
Public hearings were held on the following petitions, notice having been
mailed to the petitioners and to the owners of all property deemed by the Board
to be affected thereby as they appear on the most recent local tax list and
also advertised in the Lexington Minute -man:
Mobil Oil Corporation - permission to erect and maintain a free-standing sign
on the property located at 396 Waltham St.
Mrs. Jack Radlo - variance in order to replace an existing porch with an addi-
tion of same width but which overhang will leave a side yard of 18 ft. instead
of the required 20 ft.
John and Rosina Busa - permission to continue operation of a roadside stand on
the premises at 52 Lowell Street.
Lexington Professional Building Trust, Alfred P. Tropeano, Trustee - petition
to amend the permit of and for the premises at 114 Waltham Street, entered on
June 10, 1954, by deleting that portion of the permit limiting the use of the
offices to "physicians, dentists and other professions", and to amend the permit
' entered on May 12, 1959, extending and enlarging the use for the building by
deleting all references that the use of offices be limited to physicians, den-
tists and other professions and the use of said offices be limited to that set
forth in section 25.40, 25.41 and 25.42.
Norman L. Paul - special permit under section 25.81 to use part of residence at
26 Barberry Rd. as a part-time office forthe practice of medicine. His perman-
ent office is at 51 Brattle St. in Cambridge. Practice is limited to family
psychiatry. Permission specifically for a multiple -family group meeting on
Thursday nights between 7:30 and 10:30 p.m. If the meeting does not occur on
Thursday there may be a substitute meeting on another week day night. There
may be a maximum of 30 people in 12 cars attending.
Following the hearings the Board made the following decisions in open
meeting:
Mobil Oil Corporation - permission unanimously granted to erect and maintain a
free-standing sign in accordance with drawings submitted.
Mrs. Jack Radlo - variance unanimously granted to build a glazed in porch (24'x
14') to replace the present screened in porch leaving a side yard of 18' instead
of 20', all in accordance with plot plan and drawings submitted.
John and Rosins Buss - permission unanimously granted to continue operation of
a roadside stand on the premises for one year with the following conditions:
' 1. Sale of products shall be in conformity with section 25.33 of the zoning by-
law.
2. This permit shall expire on January 25, 1973.
3. Only one sign shall be used and that on the front of the building. The sign

shall be no longer than 20 ft. and no higher than 2 ft., containing the
' words "SUN VALLEY FARMS".
4. No sign shall be erected on Lowell Street.
5. The stand shall be operated from 9:00 a.m. to 8:00 p.m. six days a week,
and from 9:00 a.m.to 7:00 p.m. on Sunday.
6. The lights on the parking area shall be shielded so that they do not
shine at neighboring houses.
7. Sufficient parking space will be available for 20 cars.
8. The premises must be kept in a neat and orderly condition and no empty
boxes, barrels or similar material stored outside the building.
9. Access to the premises shall be from Lowell Street and no traffic shall
be routed over Lillian Road.
10. No increase in the candlepower of the lights shall be allowed.
11. Soft drink vending machine shall be not exposed on the outside of the
building.
Lexington Professional Building Trust, Alfred P. Tropeano, Trustee - granted
subject to the following conditions:
1. No veterinarians, opticians and other offices engaged in retail sales
shall be permitted on the premises.
2. Studios, banks, finance companies, car rentals and similar businesses
shall not be considered among uses falling within the above definition
of permitted offices.
Norman L. Paul - voted 4 to 1 (Mr. Nickerson voting in opposition) in favor
of the following findings:
' 1. That in its judgment the public convenience and welfare will be substan-
tially served by granting the permission requested.
2. That the permission requested will not tend to impair the status of the
neighborhood because no undue noise will be involved and parking will be
kept to a minimum.
3. That the permission requested will be in harmony with the general purposes
and intent of the regulations in the Lexington Zoning By -Laws even though
the number of people attending will be large. This is counter balanced by
there only being one meeting per week.
Pursuant to the said findings above, the Board hereby in a vote of 4 to 1
decides to permit: Special permission to Dr. Norman L. Paul under section
25.81 to use part of his residence at 26 Barberry Road as a part-time office
for the practice of medicine, practice to be limited to family psychiatry,
subject to the following conditions:
1. This permission will expire January 29, 1973.
2. This permission shall be specifically to use this office for a multiple
family group meeting on Thursday nights from 7:30 p.m. until 10:00 p.m.
If the meeting does not occur on Thursday night there may be a substitute
meeting on another week day night.
3. -A maximum of 30 people may attend.
4. Dr. Paul's statement that no off street parking will be allowed will be
accepted by the Board of Appeals providing that all visitors' cars be
parked in his driveway which he states will accomodate six cars.
All pertinent material is on file under the name of each petitioner.
