HomeMy WebLinkAbout1971-11-09BOARD OF APPEALS HEARINGS ' November 9, 1971 A regular meeting of the Lexington Board of Appeals was held on Tuesday, November 9, 1971 at 7:30 p.m. in the new selectmen's meeting room, Town Office Building. Present were Chairman Nickerson, regular members Abbott, Dawes, Sheldon and Wadsworth. Also present were associate members Reed, Emery, Mabee and Mrs. Morey. The photograph for the Annual Town Report was taken by an officer of the police department. Public hearings were held on the following petitions, notice having been mailed to the petitioners and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list and also advertised in the Lexington Minute -man: Viola T. Norlin - for permission to continue the operation of the Manor Nursery School at 118 Burlington Street. Follen Church Society - for permission, as required under Section 25.34 of the Lexington Zoning By -Law, to sell Christmas trees on the premises at 764 Massachusetts Avenue during December 1971. Village Artisans - for permission to erect a sign 7 feet long by 19 inches wide on the brick facing of the building at 17 Depot Square. John and Rosins. Busa - for permission to continue operation of a roadside stand dh the premises at 52 Lowell Street. Mary R. Carney - for permission to vary the Lexington Zoning By - Law in order to erect a garage on property at 80 School Street which will have a 7�' side yard instead of the required 10'. Robert Modoono - for permission to continue to operate a stand for the sale of evergreens, shrubs, various other plants, annuals, peren- nials, and garden supplies on lot abutting 192 Woburn Street; also to sell Christmas trees, wreaths, etc. in the appropriate season. Following the hearings the Board made the following decisions, all unanimous: Viola T. Norlin - granted; permit expires November 10, 1972. Follen Church Society - granted for December 1971 and December 1972. Village Artisans - granted, subject to the following conditions: 1. The sign shall be subject to the Historic Districts Commission's approval. 2. The sign over the door for which Village Artisans has a permit from ' the Historic Districts Commission shall not be installed. 3. The sign at present installed on the inside of the door shall be removed. 4. The building may be illuminated on the exterior by floodlights, already installed, between the hours of 5 and 11 p.m. in the winter time. ' November 9, 1971 hearings continued: -2 John and Rosins. Busa - granted for three months with the following conditions: 1. Sale of products shall be in conformity with Section 25.33 of the Lexington Zoning By -Law. 2. This Permit shall expire on February 10, 1972. 3. Only one sign shall be used and that on the front of the building. The sign shall be no longer than 20 ft. and no higher than 2 ft., containing the words "Sun Valley Farms." 4. No sign shall be erected on Lowell Street. 5. The stand shall be operated from 9:00 a.m. to 8:00 p.m. six days a week, and from 9:00 to 7:00 on Sunday. 6. The lights on the parking area shall be shielded so that they do not shine at neighboring houses. 7. Sufficient parking space will be available for 20 cars. 8. The premises must be kept in a neat and orderly condition and no empty boxes, barrels or similar material stored outside the building. 9. Access to the premises shall be from Lowell Street and no traffic shall be routed over Lillian Road. 10. No increase in the candlepower of the lights shall be allowed. 11. Soft drink vending machine shall be not exposed on the outside of the building. Mary R. Carney - granted; the garage will be 16'10" wide by 22' deep, ' one story in height, of materials similar to those of the house and located as indicated on the plot plan by Miller and Nylander dated October 15, 1971. Robert and John Madoono - granted for one year, subject to the fol- lowing conditions: 1. All provisions of Sections 25.33 and 40 (formerly Sec. 14 (f), pg. 74, Zoning By -Law of 1966, shall apply to this permission. 2. No parking on driveways shall be permitted within 10 feet of the rear of the properties on Webb Street. 3. No flood lights shall be permitted. 4. The hours of operation shall be from 8:00 a.m. to 7:00 p.m. five days a week, one-half day on Saturdays, except seven days a week during the Christmas season. 5. Specifically the sale of hardware and lawn tools, etc. are expressly prohibited. 6. No signs such as requested previously shall be permitted. 7. No trucking will be permitted in and out before or after the hours specified in condition No. 4. No trucks shall be allowed to arrive and stay over night, especially with motors running. 8. This permit shall expire on November 10, 1972. All pertinent material is on file under the name of each petitioner. ' The meeting adjourned at 11:05 p.m. Evelyn F. Cole Clerk
