HomeMy WebLinkAbout1971-10-05BOARD OF APPEALS HEARINGS ' October 5, 1971 A regular meeting of the Lexington Board of Appeals was held on Tuesday, October 5, 1971 at 7:30 p.m. in the selectmen's meeting room, The Bird Room, Cary Memorial Building. Present were Vice Chairman Abbott who presided over these hearings, regular members Sheldon and Wadsworth, and associate members Brodhead and Mabee. Public hearings were held on the following petitions, notice having been mailed to the petitioners and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list and also advertised in the Lexington Minute -man: Donald L. and Diana Gayle Lumsden - for a variance of the Zoning By -Law to maintain the existing dwelling at 6 Lawrence Lane with 27' frontage setback instead of the required 30'. Francis and Marion B. Napoli - to vary the By -Law to permit sub- division of the parcel of land numbered 10 North Hancock Street, the major portion of which is in an RS -one family dwelling district and the remainder of which is in a CN -neighborhood business district, by remov- ing therefrom the portion that is in the CN district, and adding it to the adjoining parcel numbered 6 North Hancock Street which is in the same CN district, and to permit the portion of the land numbered 10 North Hancock Street that is in the RS district with insufficient side yard, frontage and area to be maintained as a legal lot. Edward T. Donahue, 1531 Massachusetts Avenue, Arlington - to vary the Lexington Sign By -Law to allow an existing free standing sign, purported to be in Lexington, to remain at its present location, immedi- ately adjacent to 7 Massachusetts Avenue, Lexington. Old Lexington Restaurant, Inc. - to vary the Sign By -Law to allow two signs on the front of the building at 1733 Massachusetts Avenue. Supreme Council, 33- Ancient Accepted Scottish Rite of Freemasonry and Scottish Rite Masonic Library and Museum, Inc. - permission to erect new facilities at 1162 Massachusetts Avenue, to house and expand the present Library and Museum now located in the building known as 39 Marrett Road and also to build a new facility to include an auditorium to seat 400 people substantially in accordance with plans submitted. Following the hearings the Board made the following decisions: Donald L. and Diana Gayle Lumsden - unanimously granted, so far as may be necessary to permit the existing dwelling to be maintained at 6 Lawrence Lane with frontage setback of 27' instead of the required 30'. Francis and Marion B. Napoli - unanimously granted, so far as may be necessary to subdivide the parcel of land at 10 North Street, creating an area of 3,904 square feet to be added to the parcel at 6 North Hancock Street, leaving the land at 10 North Hancock Street with insufficient side yard, frontage and area to be maintained as a legal lot. October 5, 1971 hearings continued: Edward T. Donahue - unanimously denied. -2 Old Lexington Restaurant, Inc. - considered withdrawn. Nobody appeared on behalf of this petition. A "Certificate of Appropriateness" had been issued by the Lexington Historic Districts Commission for one sign, which would comply with the Lexington Sign By -Law and would not need approval of the Board of Appeals if it was erected as per drawings submitted to the Historic Districts Commission. Supreme Council and Masonic Library and Museum, Inc. - unanimously granted substantially in accordance with plans submitted and subject to the following conditions: 1. The permit is issued for the stated purpose only and no transfer, sale or lease of any part of the property, nor any change in use of the whole or of any part thereof, shall be permitted, except upon a new hearing and approval by the Board of Appeals. 2. No new construction or additions, no expansion of use and no major change of the exterior layout of parking, driveways or landscape features shall be permitted, except upon a new hearing and approval by the Board of Appeals. 3. The library, museum and auditorium shall be open and available to the public under reasonably acceptable terms and conditions, either free or upon the payment of a nominal fee consistent with the non-profit nature of the ownership. 4. The sewer, water connections, drains, driveways and outdoor lighting shall be subject to the Town Engineer's approval. 5. This permission shall also be contingent upon securing a certificate of appropriateness from the Historic District Commission and permission from the Historic District Commission to remove the old house and barn. All pertinent material is on file under the name of each petitioner. The meeting adjourned at 9:30 p.m. Evelyn F. Cole Clerk 1
