HomeMy WebLinkAbout1970-07-28 BOARD OF APPEALS July 28, 1970 A regular meeting of the Lexington Board of Appeals was held on Tuesday, July 28, 1970, at 7:30 p.m. in the Selectmen's temporary meeting room, The Bird Room, Cary Memorial Building. Present were Chairman Nickerson, and regular members Abbott, Sheldon, Dawes and Wadsworth. The following petitions were heard: Louis J. Bakanowskv - variance on the front yard setback requirement of 30 feet on the property located at 484 Concord Avenue to allow the corner of a proposed two-car garage to project over the setback line by 5 feet. Kenneth L. and Marjorie C. Warden - permission to build a lean-to greenhouse 13.5 feet x 14 feet on the south side of their residence at 10 Constitution Road and a side yard variance reducing it to 5 feet instead of the required 15 feet. John F. Curran - variance of the Zoning By-Law that requires a structure ( swimming pool) to be erected not less than 15 feet from the lot line to read nine feet from the rear lot line of 5 Lillian Road. Richard and Marie Belliveau - variance of the Zoning By-Law to construct a one-story addition to their residence at 24 Oak Street with a side yard of 8 feet instead of the required 15 feet. Auto Engineering, Inc. - special permit under Sec. 25 of the Zoning By-Law to erect and use for the business of an automobile dealership proposed additions to the existing buildings on the premises at 436 Marrett Road, occupied by the petitioners, and also for variances from Sec. 27 to permit portions of said proposed additions as shown on plans to be located less than 20 feet from the rear lot line of the premises and to permit the areas marked "Employees Parking: and "Parts Receiving Docks on the plans to be paved and used for parking purposes and as parts receiving dock, respectively, although located within 10 feet of the rear lot lines and a special permit under Sec. 35 to erect two signs, 22 feet in height and 7 feet in diameter. Anthony R. Cataldo - permission to process and sell fruits and vegetables at premises located at Gold Ribbon Farm, 1265 Massachusetts Avenue. Walnut Farm Trust - permission to build six enclosed tennis courts with attached club house, parking for 70 cars, lighting for driveway and parking area and sign shown on plan, to be located on Walnut Street adjacent to 25 Walnut Street and bounded by land of Middlesex County. July 2$, 1970 --2 At the close of the hearings, an executive session was held during which the above requests were discussed and the following decisions reached: Louis J. Bakanowsky — denied. KennethL. and Marjorie C. Warden — granted. John F. Curran — denied. Richard and Marie Belliveau — granted. Auto Engineering, Inc. — denied. Anthony R. Cataldo — granted with provisions of permits in July 1962 and July 1969 be complied with. Walnut Farm Trust— granted, with the exception of the sign. The meeting adjourned at 10:15 p.m. R.
