A regular meeting of the Lexington Board of Appeals was held
on Tuesday, July 14, 1970, at 7:30 p.m. in the Selectmen's temporary
meeting room, The Bird Room, Cary Memorial Building. Present were
Chairman Nickerson, regular members Dawes and Wadsworth and associate
members Reed and Brodhead.
The following petitions were heard:
Charles J. Abate - variance of the Zoning By -Law to maintain
a 15' x 1513n one-story glassed porch addition attached to the
dwelling at 7 Blueberry Lane which would have a side yard of 11.5
feet instead of the required 15 feet.
-.Fred E. and Margaret M. Hastings - to appeal the decision of
Donald K. Irwin, Building inspector of the Town of Lexington, dated
June 5, 1970, refusing to issue a permit to build a single family
frame dwelling on a lot situated on Waltham Street and shown as
lot 17 on the Assessors Plan 49 on the ground thatthe lot is not
a legal building lot for which a building permit can be issued.
Robert L. Lyon - permission to maintain the existing free
standing sign measuring 2 ft. 6 in. x 4 ft. 7 in. as it now stands
' in front of the building at 55 Waltham Street.
Dunkin Donuts - permission to install two 3 ft, high by
2 ft. wi a double face plastic internally illuminated signs, over-
all height 9 ft, to be located at 373 Waltham Street.
Lexington G rd�ens Inc. - permission to erect an addition,
12 ft. 9 in. x 20 ft. 2 in, onto the existing boiler room located
at 93 Hancock Street for the; purpose of installing an anti -pollution
type boiler.
Hartwell Lexington Tru t - additional finding and determination
that the proposed light manufacturing and research use of the building
located on the northeasterly side of Hartwell Avenue on the north-
westerly side of the Boston and Maine Railroad tracks will constitute
a suitable development and will not result in substantial detriment
to the neighborhood.
At the close of the hearings, an executive session was held
during which the above requests were discussed and the following
decisions reached:
Charles J. Abate - granted.
Fred E. and Margaret Hastings - appeal denied and Building
'Robert L. Lyon - granted. Inspector's decision upheld.
Dunkin Donuts - denied.
Lexington Gardens Inc. - granted.
Hartwell Lexington Trust - granted.
The meeting adjourned at 10:30 p.m.
