' A regular meeting of the Lexington Board of Appeals was held on
Tuesday, ay 7, 1968 in the Selectmen's Room, Town Office Building.
Present wre Chairman Nickerson, members Dawes, Sheldon and Wadsworth,
and assoc ate Morey; also the secretary, Mrs. Macomber. The hearings
were openid at 7:30 p.m. as follows:
The Roman Catholic Archbishop of Boston - for permission to re-
move condition #2 from the Board of Appeals Permit issued on February 28,
1966 which states that the existing house at 1993 Massachusetts Ave.
shall be removed as soon as rights under the life tenancy expire, in
order to comply with the request of the Historic Districts Commission
that the house be allowed to remain.
Earl Kim - to vary the Lexington Zoning By -Law in order to main-
tain existing residence at 27 York St. which has insufficient front set-
back, and to build an addition which would also have insufficient front
setback.
Boerner Lexington Corp. - (1) for variance to use as part of the
required parking area for 394 Lowell St., in a C 1 local business dis-
trict, parcel A-1 which is located in the rear thereof in an R 1 resi-
dential district and as shown on plan filed therewith. (2) for a deter-
mination that complete development of the required parking area for 394
Lowell St. is not currently necessary and for a special permit to limit
development for present actual parking use to an area for 40 cars sub-
stantially as shown on parking plan filed herewith.
Boerner Lexington Corp. - to vary the Lexington Zoning By -Law
in order to add a second floor to the existing business building
numbered 394 Lowell St. in a C 1 local business district and to use the
building for business offices rather than for its former use as a retail
store and other business uses.
Shell Oil Co. - for a variance of the Lexington Zoning By -Law to
permit it to reconstruct its retail automobile service station situated
at the northwesterly corner of Massachusetts Ave. and Maple St. in an R 1
one -family dwelling district and numbered 1095 Massachusetts Ave.; the
service station building now existing on the parcel is to be demolished
and the new service station building and structures are to be located sub-
stantially as shown on plot plan submitted.
Kingston Homes,_ Inc. - to vary the Lexington Zoning By -Law in order
to divide one lot at Maple St. and Ingleside Dr. containing 31,782 sq.ft.
into two lots, one of which would contain 15,544 and the other 16,238
sq.ft. instead of the 30,000 sq.ft. each as required, and both of which
would have insufficient frontage.
At the close of the hearings an executive session was held during
which the above requests were discussed, and the following decisions
reached:
