HomeMy WebLinkAbout1968-03-26F BOARD OF APPEALS HEARINGS March 26, 1968 A regular meeting of the Board of Appeals was held on Tuesday, March 26, 1968, in the Selectmen's Room, Town Office Building. Present were Chairman Nickerson and members Abbott, Dawes, Sheldon and Wadsworth, and the secretary, Mrs. Macomber. The following petitions were called to order at 7:30 p.m.: John Modoono - (Highland Farm) - for permission to continue opera- tion of stand for the sale of evergreens, shrubs, various other plants, and garden supplies on lot abutting 192 Woburn St., also to sell Christmas trees, wreaths, etc. in the appropriate season. Philip A. Fischer - to vary the Lexington Zoning By -Law in order to allow the overhang of the existing building and the new proposed extension at 218 East St. to have a 26 ft. set back from the street instead of the required 30 ft. Peter B. and Dianne N. Carberry - to vary the Lexington Zoning By -Law in order to subdivide the property at 10 Cottage St. into two lots, one of which would have frontage of 92 ft. and an area of 28,800 sq.ft., second of which would have frontage of 5 ft. and an area of 215 sq.ft. The lot comprising 215 sq.ft. would be conveyed to the abutting owners in order to provide access to the rear of their property. ' Outhet Realty Trust - to vary the Lexington Zoning By -Law in order to erect a building on lots 15 and 16 at 30 Gleason Rd. which lot does not have the required area and frontage. Heritage Realty Trust - for a finding and determination that the pro- posed location of building, the proposed major topographical changes, if any, and the planned provisions for waste disposal, surface and ground water drainage, erosion control, parking areas, loading areas, maneuvering areas, driveways, and the location of intersections of driveways and streets are such that the proposed construction of a new building will constitute a suitable development and will not result -in substantial detriment to the neighborhood. Said parcel of land is located at #1 Militia Drive (at Wor- then Rd, near property of First National Stores, Inc.) Itek Corporation - for (1) a finding and determination that the pro- posed corporate facility will constitute a suitable development; (2) variance of the provision of the building by-laws, Art. X, Sec. 2 to permit floor area within fire walls in excess of by-law. G Robert 0. Tillinghast - to vary the Lexington Zoning By -Law under Sec.8(a)l.b. in order to permit one 2 -family unit in rear of 465 and 475 Massachusetts Ave. ' At the close of the hearings an executive session was held during which the followihng decisions were reached:
