HomeMy WebLinkAbout1964-12-01BOARD OF APPEALS HEARINGS December 1, 1964 A regular meeting of the Lexington Board of Appeals was held on Tuesday, November 10, 1964, in the Selectmen's Room, Town Office Building. Present were Chairman Nickerson, regular members Abbott, Hoyt, Ripley and Wadsworth. The following petitions were heard: American Legion, Stanley Hill Post #37 for permission to sell Christmas Trees and decorations at P—o—s—t-E—ea—Cquarters, 3 Fletcher Ave. Bruce Currie for permission to vary the zoning By-law in order to erect a garage at 7 Abbott Rd. one corner of which would result in a 13 ft. sideyard instead of the required 15 ft. Anthonyand Gabrielle Mazza for permission to vary the zoning by-law in order to extend present garage and porch foundations at 12 Green Lane which would result in an 11-1/2 ft. side yard instead of the required 15 ft. Mrs. K. Paul Y hantis for permission to vary the Zoning By-law in order to re of lots 45 and 47 Ledgelawn Ave. by increasing the front- age of lot 47 and decreasing the frontage of lot 45 by 1.6 ft. in order ' to move the line which at present runs through the driveway on lot 47. At the close of the hearings an Executive Session was held dur- ing which the above requests were discussed, and the following decisions reached: American Legion - unanimously granted Bruce Currie - unanimously granted Anthony and Gabrielle Mazza - unanimously denied William F. Fitzgerald - unanimously granted Mrs. K. Paul Yphantis - not acted upon With regard to the Yphantis petition it was decided that the petition had not been properly worded since an insufficient side yard was also involved. As this was an unintentional error it was decided to re -advertise the hearing at no cost to the petitioner. All pertinent material with regard to the above petitions is on file in each individual folder. Following the decisions a discussion was held regarding letters received in reply to an inquiry sent out by the Board as to what other Boards charged for hearings. Replies were received as follows: Arlington - $25.00; Bedford - $15.00; Belmont - $27.00; Concord - $10.00; Needham - Cost of ad and mailing; Stoneham - $15.00; Wakefield $30.00; Winchester - ' None. Since the Lexington charge is at present $20.00 it was considered a good average. Louise M. Macomber, Clerk ANNUAL REPORT - 1964 December 31, 1964 The Board of Appeals reports that hearings were scheduled for 110 petitions during the year 1964. Of these, 4 petitions were withdrawn by the respective petitioners, 15 were yearly renewals, and 91 petitions were brought before the Board for hearing. Of these 59 were granted and 32 denied. A list of these hear- ings and the decisions rendered are on record. The Board is deeply grateful for the assistance ' of Mrs. Ruth Morey and Messrs. J. Henry Duffy, Howard H.
