HomeMy WebLinkAbout1958-02-041 BOARD OF APPEALS HEARINGS February 4. 1958 A meeting of the Board of Appeals was held on Tuesday, February 4, 1958 in the Selectmen's Room, Town Office Building. Present were Chair- man Nickerson, Messrs. Ripley, Redman, Ballard and Norris. At 8:00 p.m. hearings were declared open upon the following petitions: William E. Maloney-- to permit 4 lots, numbered 2, 31 h, and 5. Mass. ve.,ex on, o be divided into 3 lots; the center lot to be made from parts of two existent 50 ft. lots and to have approximately 65 foot frontage; also to have the building line of the resulting 3 lots set back 20 ft. from the street instead of the required 30 ft. Minola M. Black - to subdivide 10 lots, located on Minola Rd. and Slocum R3. n o ots, 6 of which will not meet requirements of the Lex- ington Zoning By-law Mildred Heywood - to vary the Zoning By-law in order to build a 2 room addition ro her residence at 72 Waltham St. to be used by church for sales- room and reading room; also to build said addition to the street line. Dr. Charles Mooney - to have permission to occupy the proposed addi- tion to exist g building, 1.145 Mass. Ave., as a physician's office. At the close of the hearings, an executive session was held during which the following decisions were made: William E. Maloney - granted Minola M. Stone Clerk 157 BOARD OF APPEALS HEARING Dr.Charles T.Mooney A meeting of the Board of Appeals was held in the Selectmen's Room, Town Office Building, Lexington, on February 4, 1958. Chairman Nickerson, Messrs. Ripley, Redman, Ballard and Norris were present. The clerk was also present. At 8:.55 p.m., hearing was declared open upon the petition of Dr. Charles T. Mooney for permission to occupy the proposed addition to existing building, 1145 Mass. Ave., Lexington, as a physician's office. Notice of the hearing was read by Mr. Nickerson. Notices of this hearing had been mailed to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tau list. Mr. Nickerson asked Dr. Mooney if he had submitted drawings of what he wished to do. Dr. Mooney explained the plans he had submitted to Mr. Nickerson and the rest of the Board. Mr. Nickerson asked if the construction would be consistent with that of the present building. Dr. Mooney replied that it would. Mr. Nickerson referred to the plans and stated that the addition would be a one story addition 10'3" x 25' and narrowing to 516" at the back to preserve the 10' side yard. He asked if the 10' side yard would be preserved. Mr. Farfaras, the builder, answered that Dr. Mooney would have the required 10' side yard and explained using plans. Mr. Nickerson asked if there would be a request for another sign. He stated that there was one sign now. Dr. Mooney said he had one sign on the lawn and there was no re- quest for further signs. Mr. Nickerson asked that the office hours were. Dr. Mooney said his office hours were 2-4 p.m. and 7-8 p.m. 5 days a week except Tuesdays and Saturdays when they were 2-4 p.m. only. Mr. Nickerson asked Dr. Mooney if he calculated that this addition would attract additional patients to his office. Dr. Mooney said he didn't necessarily think so. He explained that now he was able to see only one patient at a time, but with the new addition he could see three patients at once. He explained by pointing out on the plans Dr. Mooney -2- G that he could have patients in each of the two proposed treatment rooms and another patient in the proposed consultation room. In this way he could take care of his patients more quickly. ' Mr. Nickerson explained that the Board was concerned with the park- ing of cars of the people who came to see Dr. Mooney because the Doctor's house was on such a prominent corner. Dr. Mooney said he did not think there would be a large increase in his patients. Mr. Nickerson said that he thought with a substantial office and a commodious waiting more patients would be attracted. Dr. Mooney explained that at present he had a back -log of patients but by building the addition he would be able to take care of his present patients more rapidly. Mr. Nickerson said that the parking situation was impossible as it stood at present and the Board could be nasty and deny the petition to Dr. Mooney. However he felt that the parking situation could be remedied to get more cars off Massachusetts Ave. Mr. Ballard referred to the plans and asked if there was any other building back of the house. He also asked if the driveway was wide enough to turn around in at present. Dr. Mooney said he had a circular driveway at the front of his house. ' Mr. Ballard asked if there was an opportunity for helping the park- ing situation on Massachusetts Ave. Dr. Mooney explained the parking situation to Mr. Ballard with refer- ence to the plan submitted. Mr. Nickerson asked if there was any possibility that the people coming to see the Doctor would use this circular driveway to park their cars. He also stated that in the future no doctor will get a permission to use his house as an office if he is situated on the main street. We are trying to see what can be done to take care of this situation. Dr. Mooney said that if he could buy the lot next door he could use that for parking. He said that the architect had suggested that he cut the trees down on his front lawn and pave the whole front area, but this would spoil the looks of his house. It is his residence as well as his office. Mr. Nickerson asked Dr.'Mooney if he inferred that he would be will- ing to consider some remodeling of the parking situation. He referred to the plan stating that Dr. Mooney might be able to improve the parking situa- tion, he has 35' that would enable all the patients to park. Mr. Nickerson asked how much space there was from the house to the line. Mr. Ballard asked if there was any possibility of parking at the rear of the house. Dr. Mooney -3- Dr. Mooney replied that there was a 101 drop at the end of the driveway. There used to be a garage at the end of the driveway but this had been demolished. Mr. Farfaras said that at the front of the house there was an area 75t long which could be black -topped. Mr. Ballard asked if the circu3ar driveway were made to accommo- date two cars in width would that not solve the parking situation. Dr. Mooney said he thought it would. Mr. Nickerson agreed that he thought it would take care of this situation. Dr. Mooney said that if this could be done, he had no objections. Mr. Nickerson asked if there were any further questions. There were none. Mr. Nickerson asked if there were any persons in favor of this petition. Mr. Sidney Williams, 1123 Mass. Ave., registered himself and his wife Georgia in favor. Mr. Nickerson read a petition in favor signed by 12 people. Mr. Nickerson read a letter from the Planning Board registering oppo- sition. He read another letter from Mr. and Mrs. Wheaton registering oppo- sition. none. 1 Mr. Nickerson asked if there were any further questions.
