HomeMy WebLinkAbout1955-10-1871 BOARD OF APPEALS HEARINGS October 1$, 1955 A meeting of the Board of Appeals was held in the Selectmen's Room, Town Office Building, on Tuesday October 18, 1955• At 8:00 p.m. hearings were declared open on the following petitions: Mary E. Dacey - to operate a kindergarten for ten children, 4 and 5 years of age, five mornings a week from 9 a.m. to 11:45 .m. at Winchester Dr. Persis L. Ballou - to operate a scheduled play group for not more than ten children at er residence 2013 Mass. Ave., said group to be operated in the forenoon, not more than three days a week. Mrs. Harry W. Cram - to operate a pre-primary school for not more than ten children etween the ages of 2 and 5-1/2 years at 759 Waltham St. five days a week from 9 a.m. to 4:30 p.m. the year round. Benjamin J. Gott - to erect a single family dwelling on Lot 19 located on Sylvia St., which will be set back from the street 20 feet instead of 30 feet as required under the zoning by-law. Garrett B. Fuller - to relocate the lot line between Lot l and Lot 2 on Hayes Ave. John Bresnihan - to erect a two -car garage on Lot #44 at the corner of WoodSt. and Holt n Rd. which will be set back from Holton Rd. 14 feet instead of 20 feet as required by the Zoning By-law. Alexander MacMillan - to convert the building at 23 Sylvia St. into a two-family ouse, substantially in accordance with the plans sub- mitted, such renovations to be satisfactory to the Building Inspector. First Congregational Society in Lexington - This case was taken to Court and the variance declared null and void. A new hearing was held on October 18, 1955 for a special permit under paragraph 7, Sec. 5 (a) sub -paragraph f. The decision on this hearing was held over to November 1, 1955. A meeting was called for November 1, but owning to the inability of the original members of the Board b meet on this date, it was post- poned until November 14. At the meeting of the Board held on November 14 three members having voted in favor and two in opposition the petition of the First Congregational Society (Unitarian Church) for permission to use the parking area shown on plan of land submitted and to remove loam from said parking area was automatically denied. At the close of the hearings an executive session was held during which the following decisions were rendered: Mary E. Dacey - granted, subject to the following conditions: (1) that not more than 10 children shall be in attendance at any one time. 72 (2) that toilet facilities be installed adjacent to the room to be used by the children, such toilet facilities to be subject to the approval of the Building and Plumbing Inspectors of the Town of Lex- ington. (3) This Permit shall expire Oct. 18, 1956. Persis L. Ballou - granted, subject to the following conditions: (1) that an assistant be employed at all times; (2) that the children be properly supervised at all times; (3) the outdoor play area shall be properly fenced in; (4) this permit shall expire June 30, 1956.
