HomeMy WebLinkAbout1955-07-141 5 �L BOARD OF APPEALS HEARINGS July 14, 1955 A meeting of the Board of Appeals was held in the Selectmen's Room, Town Office Building, on Tuesday, July 14, 1955. At 8:00 p.m. hearings were declared open on the following petitions: First National Stores, Inc. - to erect a temporary sign 10' x 20' substantially in accordance with the sketch and plot plan submitted 6t 60 Bedford St. Charles A. Linehan - to remove loam, sand and gravel from that portion of the ridge still remaining along the common boundary between his parcel of land situated on Westview St. and the adjoining land of the Lexington Sand & Gravel Co., as well as further material on his own property which is estimated to be approx. 100,000 yards. John J. Driscoll - to erect a single family dwelling on a parcel of land a ;7acen o of #1 Grove St., said lot having an area of 18,500 sq.ft. instead of 30,000 sq.ft. as required under the Zoning By-law. Nelson Bennett - to construct a swimming pool 28'8" x 15'8" at 213 Fol en Rd. in accordance with the plot plan submitted. Lexin ton Methodist Church - to erect a church at 2592 Mass. Ave. the corner of unit A as shown on the plan submitted being 7'4-1' from the lot line on the southerly side of the property. Mass. Inst. of Technology'- to maintain on the hill west of Laconia St. a tower 601 or less high, and a one-story building 26'6" x 50'; all to be enclosed by a chain link fence surrounding an area 100' x 1001.on the land of Mary Monsignore. At the close of the hearings an executive session was held during which the following decisions were made: First National Stores, Inc. - granted, subject to the condition that the sign shall be removed upon completion of the construction of the building. Charles A. Linehan - granted, subject to the following terms, con- ditions and limitations: (1) that the removal be to and only to a grade of 128 ft. above mean sea level; (2) that the portion of the poral not yet filled shall be filled so that the entire parcel shown on the plot plan filed with the original petition shall be brought substantially to a uni- form grade of 125 ft. above mean sea level; (3) that the material removed shall not be trasported over any public way within the Town, with the ex- ception of Westview St.; (4) that all boulders encountered in the excava- tion of the material or now on the land shall be removed; (5) that all of b1 62 the work be completed by July 1, 1956; (6) that this permit and the work carried on under it shall be subject to such applicable regulations as the Board of Appeals may hereafter adopt; (7) that this permit shall not become effective until Charles A. Linehan has filed with the Board of Appeals a bond in form satisfactory to Town Counsel, and with an approved surety company as surety, in the penal sum of $5,000 to insure compliance with the terms, conditions and limitations of this permit. John J. Driscoll - to erect a single family dwelling on a parcel of land aPiacent to Lot ##1 Grove St., said lot having an area of 18,500 sq.ft. - denied Nelson Bennett - granted, subject to the following conditions: (1) that the water supply for filling the swimming pool shall be connected up solidly to the water supply from the adjoining house or supplied from the street and that the water shall discharge into the swimming pool above water line or .overflow of said pool so as to prevent any back siphonage or contamination of the public water supply; (2) that no water from the discharge of the pool shall become a nuisance to the neighborhood nor be discharged upon a public street. Lexington Methodist Church - Granted Mass. Inst. of Technology - granted, subject to the condition that the use of the premises shall cease by April 25, 1959 and that all of the equipment, buildings and facilities shall be removed from the premises not later than sixty days thereafter.
