BOARD OF APPEALS 17EETING '
September 19, 1941
A meeting of the Board of Appeals was held in the
Selectmen's Room, at 8:00 P. ISR. Chairman Glynn and
Messrs. Robbins, Bowker, Kimball, and Locke were present.
The Secretary was also present.
At 8:00 P. Pu. hearing was declared open upon the
application of Chester L. & Kathryn L. Blakely for per-
mission to alter the dwelling located at 509 Bedford
Street, Lexington, so as to accommodate two families.
Dr. Blakely was the only one present at the hearing.
He said that he had a large house of twelve rooms,
at least, and had a small family, consisting of himself
and his wife. He requested permission to change the house
to make a three room apartment upstairs, which would mean
putting in a sink, and he understood that such would be
making it into a two-family house.
The Chairman asked if he was going to use the same
entrances, and Dr. Blakely answered in the affirmative.
He said he wanted a three room apartment with bath on the
second floor. He contemplated no change in the outside. '
He said that he hoped that his wife's sister and her
husband would come to live in the upstairs apartment.
The Chairman asked if there would be any change in the
heating arrangement, and Dr. Blakely replied in the negative.
Mr. Kimball asked if they would still want the second
apartment even if their relatives did not come, and Dr.
Blakely said that they would. He said that he would have
to make a bathroom downstairs.
The Chairman asked how much land they had, and Dr.
Blakely said that he owned eight acres.
The hearing was declared closed at 8:08 P. M.
Dr. Blakely retired.
The minutes of the meeting held on September 5th were
declared approved.
At 8:15 P. M,. hearing was declared open upon the pe-
tition of Marie G. nose for permission to maintain a
roadside stand at 748 Waltham Street, Lexington.
Inasmuch as neither the petitioner nor abutters appeared,
the hearing was postponed until the next meeting of the Board.
Upon motion of Mr. Kimball, seconded by Mr.Locke, it
was unanimously voted to grant the Blakely petition in the

The Board of Appeals, acting under General Laws, Chapter
40, Sec. 27, having received a written petition addressed to
it by Chester L. & Kathryn K. Blakely, a copy of which is
hereto annexed, held a public hearing thereon of which notice
was mailed to the petitioner and to the owners of all property
deemed by the Board to be affected thereby as they appear on
the most recent local tax list and also advertised in the
Lexington Minute -Man, a newspaper published in Lexington,
which hearing was held in the Selectmen's Room, in the Town
Office Building on the 19th day of September, 1941.
One Associate and four members of the Board of Appeals
were present at the hearing. A certificate of notice is
hereto annexed. At this hearing evidence was offered on be-
half of the petitioner tending to show:
That they own a house with approximately twelve rooms,
situated on about S acres of land at the corner of Bedford
Street and Winter Street;
that they wished to set apart three rooms and a bath
on the second floor, as an apartment with separate facilities
for light housekeeping;
that there would be the same entrances to the house as
now existing, and the same central heating plant.
No one appeared in opposition.
At the close of the hearing the Board in private session
on September 19, 1941 gave consideration to the subject of the
petition and voted unanimously in favor of the following
findings:
1. That in its judgment the public convenience and
welfare will be substantially served by the making of the
exception requested.
2. That the exception requested will not tend to impair
the status of the neighborhood.
3. That the exception requested will be in harmony with
the general purposes and intent of the regulations in the
Lexington Zoning By-law.
4. That owing to conditions especially affecting the
said parcel but not affecting generally the Zoning district
in which it is located, a literal enforcement of the pro-
visions of the Lexington Zoning By-law as to the locus in

question would involve substantial hardship to the petitioner
and that desirable relief may be granted without substantially
derogating from the intent or purpose of such Lexington
Zoning By-law.
Pursuant to the said findings, the Board hereby unan-
mously decides that the application of the said Lexington
Zoning By-law is hereby varied so far as may be necessary
to permit Chester L. and Kathryn K. Blakely to maintain
one separate apartment on the second floor of their house
located at 509 Bedford Street, this apartment to contain
the usual facilities for light housekeeping, subject to
the condition that there shall be no change in the entrances
to the house or in the outside appearance of the house;
also subject to the condition that this separate apartment
shall be maintained only so long as the applicants or one
of them reside in a part of the house.
The Board hereby makes a detailed record of all its
proceedings relative to such petition and hereby sets forth
that the reasons for its decision are its findings herein-
before set forth and the testimony presented at the said
hearing, including that herein summarized, and directs
that this record immediately following this decision shall '
be filed in the office of the Town Clerk of Lexington and
shall be open to public inspection and that notice of this
decision shall be mailed forthwith to each party in interest.

27, hereby certify that I sent by postage certificate of

also advertised in the Lexington Minute Man on August 28,
1941, a notice of which the following is a true copy.

Gentlemen:
The undersigned hereby petition the Lexington Board
of Appeals, appointed under General Laws, Chapter 40, Section
27, to vary the application of section 9C of the Lexington
Zoning By-law with respect to the premises at No. 509 Bed-
ford Street, owned by Chester L. & Katherine K. Blakely
of Lexington by permitting the following: Alteration of

The Board of Appeals will hold a hearing on the matter
of varying the application of the Zoning Law by permitting
on the premises owned by Chester L. & Kathryn K. Blakely
and located at 509 Bedford Street, Lexington, the alteration
of the house to accommodate two families, under the Lexington
Zoning Law or in accordance with Chapter 40, Section 27A of
the General Laws and amendments.
The hearing will be held on September 19, 1941 at 8:00
P. M. in the Selectmen's Room, Town Office Building, Lexington.
