A meeting of the Board of Appeals was held in the
Selectmen's Room, Town Office Building, on April 16th, 1937
at 8:00 o'clock P. M. Chairman Maddison and Messrs. Glynn,
Robbins, Kimball, and Associate Member Errol E. Locke were
present. The Secretary was also present.
At 8:00 P. 1-4. hearing was declared open upon the appli-
cation of Alexander W. & Dorothy A. Parks for permission to
alter the building in the rear of 10 Fletcher Avenue into a
single dwelling.
The notice of the hearing was read by the Clerk, Yr.
Robbins,
Mr. & Mrs. Parks appeared in favor of the granting of
the petition.
Mrs. Parks stated that there was a barn in the rear of
their house that was not of much value as it is now, and she
and her husband thought it would improve the neighborhood to
havethe barn remodelled into a house. She said that it was
an eyesore. She said that the barn was 14' in the rear of
the house and 9' from the rear lot line extending from Sher-
man Street. The entire lot has a frontage of about 94 feet
on bletcher Avenue and about 124 feet on Sherman street.
Mr. Glynn asked Pers. Parks what the entire area of the
lot was, including that on which the house and barn are lo-
cated, and she replied that it was about 10,000 feet.
The Chairman asked when the garage was built, and T=ars.
Parks said that they had owned the property over eight years,
and the shed was there when they purchased the property, and
they put on a couple of doors. She said that the beams, studd-
ing, and everything in the barn were in good condition, but
it would be necessary to build a foundation.
PRrs. Parks said that she and her husband intended to
live in the remodelled house themselves, and did not intend to
sell it.
Mr. Glynn asked how man jr rooms they intended to have,
and she said they intended to have five rooms. 11r. Parks said
that there were two apartments in the large house, each con-
taining four rooms and a bath.
No persons appeared in opposition, and the hearing was
declared closed at 8:15 P. M.

Mr. Glynn moved that the petition be denied. This was
seconded by Mr. Kimball, and it was unanimously voted to deny
the petition in the following forms
The Board of Appeals, acting under General Laws, Chap-
ter 40, sec. 27, having received a written petition addressed
to it by Alexander W. & Dorothy A. Barks, a copy of which is
hereto annexed, held a public hearing thereon of which notice
was mailed to the petitioner and to the owners of all property
deemed by the Board to be affected thereby as they appear on
the most recent local tax list, and also advertised in the
Lexington T,inute-T.Zan, a newspaper published in Lexington,
which hearing was held in the Selectmen's room, in the Town
Office Building on april 16, 1937.
One associate and four members of the board of appeals
were present at the hearing. A certificate of notice is
hereto annexed. At this hearing evidence was offered on be-
half of the petitioner tending to show:
That there is a barn on the Sherman Street side of
their house numbered 10 Fletcher Avenue which is not kept in
good repair by the tenant, and which is located about 9 feet
from the rear lot line extending from 'Sherman Street and 14
feet from the rear of the house; that the entire lot has a
frontage on Fletcher Avenue of 94 feet and on Sherman Street
of 124 feet; that the lot on which the barn is 'situated would
have a frontage on Sherman Street of about 35 feet; and would
contain about 2500 feet; that they felt it would be an im-
provement to the neighborhood if the alteration was permitted.
They proposed remodelling the barn and using it for a home
for themselves.
No evidence was offered on behalf of citizens opposing
the granting of the said petition.
At
the close of the hearing the Board in private session
on April
16, 1937 gave consideration to the subject of the
petition
and voted unanimously in favor of the following findings:
1.
That in its judgment the public convenience and wel-
fare will
not be substantially served by the making of the
exception
requested.
2.
''hat the exception requested will tend to impair the
status of
the neighborhood.
3.
That the exception requested will not be in harmony
with the
general purposes and intent of the regulations in the
Lexington
Zoning Sy -law.
4.
That the enforcement of the Lexington mooning By-law
as to the
locus in question would not involve practical
difficulty and unnecessary hardship and the relief requested
may not be granted without substantial detriment to the
' public good _and wi_thoat.substantia.11y_derogating from the
intent and purpose of such Lexington Zoning By-law.
Pursuant to the said findings, the Board hereby denies
the said petition of Alexander W. & Dorothy A. Parks as they
feel that there is no necessity which would warrant the
granting of the permit, and that the frontage on Sherman Street,
as well as the area, is too small for a house, and it would
be harmful to the neighborhood.
the Board hereby makes a detailed record of all its
proceedings relative to such petition and hereby sets forth
that the reasons for its decision are its findings hereinbe-
fore set forth and the testimony presented at the said hearing,
including that herein summarized, and directs that this
record immediately following this decision shall be filed in
the office of the Town Clerk of Lexington and shall be a public
record and that notice of this decision shall be mailed forth-
with to each party in interest.

Gentlemen:
The undersigned hereby petition the Lexington Board
of "ppeals, appointed under General Laws, Ihapter 40, Section
27, to vary the application of section 9B of the Lexington
Zoning By-law with respect to the premises at No. 10 Fletcher
Ave. owned by Alexander tiff. and uorothy A. Parks of Lexington
by permitting the following: The alteration of the building
in the rear of 10 Fletcher Avenue into a single dwelling.

The "'oard of Appeals will hold a hearing on the matter
of varying the application of the Zoninff Law by permitting on
the premises owned by Alexander W. & Dorothy A. Parks, and
located in the rear of 7/10 Fletcher Avenue, the alteration of
the building into a single dwelling, under the Lexington
Zoning Law or in accordance with 'hapter 40, SeCti.on 27A of
the General Laws and amendments.
The hearing will be held at the ;'electmen's boom, Town
Office Building, on hpril 16th, 1937, at 8:00 o'clock P. TP.
