BOARD OF APPEALS MEETINGowti
JUNE 70 1935.
A meeting of the Board of Appeals was held in the
Selectmen's Room, Town Office Building, at 8:00 P.M.
Messrs. Maddison, Kimball, and Robbins were present.
The Secretary was also present.
The hearing was declared open upon the application
of Grace J. Palmer for permission to sell antiques at
377 Bedford Street., Lexington.
The notice of the hearing as printed in the Lexington
Minute -Man was read by the Clerk.
Mr. and Mrs. Palmer and Neil McIntosh appeared before
the Board.
Mr. McIntosh informed the Board that Mrs. Palmer's
application was similar to the one that was before the
Board last fall and which was granted to a woman from
Concord. He thought that Mrs. Palmer's business would
be a credit to the Town. He stated that he could not
rent his house at 377 Bedford Street unless the person
could do some kind of business. He has owned the
house for eight years and has had only one tenant live '
there without conducting a business. He thought that
at some future time he would have to come before the
Planning Board to see if the Zoning Law might be varied
so that the property in question might be in a business
district.
Mrs. Palmer stated that she was in business in
Lexington Center next to Seltzer's store and was not
planning to give it up at present, but planned to live on
Bedford Street and conduct a business while she was at
home, when there was no business at the center shop.
Mrs. Palmer planned to carry on the business in the two
front rooms of the house and use the barn for storage.
The Chairman inquired what the facilities were for
parking. Mr. McIntosh stated that the house set back
about fifty or sixty feet from the highway, and that there
was ample room for parking on the side of the house and
in the rear. He said that it would not be necessary
to use the road for parking at any time.
The Chairman advised Mrs. Palmer that heretofore the
Board had granted the privilege for a yearly term and had
restricted the petitioner to a sign not to exceed six
square feet in area. I

Mrs. Palmer stated that she wished to have a spinning
wheel in front of the house or a small sign on a tree, but
thought a spinning wheel would be better.
Mr. McIntosh asked the Chairman if there would be any
objection to putting chairs outside. The Chairman
advised him that that was just what the Board had always
objected to, that the Board thought it too much of a
business in a residential district. He stated that the
Board would object to a miscellaneous display of articles.
He also advised Mrs. Palmer that she would have to make an
application for a hearing every year.
The Chairman then advised Mrs. Palmer that she would
be given a decision as soon as it was possible to arrange
a meeting of the full Board.
No one appeared in opposition.
The records of the last meeting of the Board were
approved.
No one appeared in opposition.
The Chairman instructed the Secretary to write
Mr. Charles T. Johnson and Mr. Floyd A. Bradstreet, who
wrote in opposition to the petition of Roy C. Peterson to
operate a roadside stand on the new Concord turnpike, and
advise thein that the decision on the petition had been
postponed pending Legislative action.
At 9:00 P.M. hearing was declared open on the
application of James R. Smith for permission to maintain
the existing sign at the corner of Blass. Ave. and Tower
Street. Mr. Smith did not apy)ear. Inasmuch as no one
appeared in favor or in opposition of the petition, no
action was taken.
At 8:30 P.M. hearing was declared open on the
application of the Lexington Estates Trust for permission
to maintain a real estate office on Winthrop Road.
The notice of the hearing as printed in the Lex-
ington MinuteMan was read by the Clerk.
Mr. Philip D. Clarke appeared before the Board, and
stated that it was desired to maintain the present real
estate office for a two year period, if possible. The
Chairman advised him that the Board did not have the right
to grant a permit for longer than one year.
The Chairman advised Mr. Clake that the Board would
take the matter under advisement until a meeting of the
full Board might be held, and Mr. Clarke retired.
No one appeared in opposition.
The Chairman instructed the Secretary to write

The 'hairman suggested that a meeting of the Board
be held on Monday evening, June 10th at 8:00 P.M., and
the other members agreed to attend.
The meeting adjourned at 9:07 P.M.
