HomeMy WebLinkAbout1933-02-17MEETING, FEBRUARY 170 1933. Meeting of the Board of Appeals was held at the Selectmen's Room, Town Office Building on Friday.. February 17, 1933 at 8 P.M. Messrs. Maddison, Custance, Slocum, Glynn and Baldrey k were present. The Secretary was also present. Hearing was declared open upon the application of the A. G. Davis Ice Co. for permission to manufacture ice at 3 Grant Street, Lexington. The Clerk read the notice of the hearing. Mr. Robert L. Innis of Billerica was present. A representative of the Frick Co. whose business it is to install ice plants was present to explain what was intended to be done. He presented prospectus of the building to be located on Grant Street. He explained that the building is to be approximately 98 feet, about fifty feet for the office. and about 25 feet for the general drive. He explained in detail how the operations of the 'plant were performed. There are a series of cis which are filled with water. The air and vegetable matter are removed so that the ice will be clear. The reftigeration chemical will be ammonia. The plant would be in operation twenty-four hours a day and is run automatically. They would employ either two or three men. He stated that you would not hear the noise of the plan outside of the building, and that there would not be any hum to speak of, not as much as from the Edison power plant. He mentioned a manufacturing of ice plant being located at North Cambridge owned by the Metropolitan Ice Co., one at Union Square, Somerville, and the Fresh Pond Ice Co. All of these plants are larger than the proposed one. There is a similar one in Leominster, and a school house is located next to it. Electricity would be the power used at 440 voltage. No persons appeared to object. The Board discussed the matter and decided to notify the Davis Ice Co. to give the Board the plans of the front and side elevations, as the Board has only the rear, also to note on the fm nt elevation that the building iA to be of first class construction front to be of water struck brick and sides are to be of concrete block construction. The Board also decided to visit other plants where ice is manufactured. Mr. Oust ance reported visiting the one at Leominster. In regard to the application of Manuel G. Rose of Walthaan Street for permission to operate a road side stand, it was voted to grant the permit in the following form: BOARD OF APPEALS PERMIT The Board of Appeals, acting under General Laws, Chapter 40, Sec. 27, having received a written petition addressed to it by Manuel G. Rose, a copy of which is hereto annexed, held a public hearing thereon of which notice was mailed to the petitioner and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list and also advertised in the Lexington 1 1 9, It ill 0 61 Minute -Man a newspaper published in Lexington, which hearing was held in the Selectmen's Room, in the Town Office Building on the third day of February, 1933. All the memhers of the Board of Appeals were present at the hearing. A certificate of notice is hereto annexed. At this hearing evidence was offered on behalf of the petitioner tending to show: the location on lot of Marie G. Rose, #756 Waltham Street, at which he d6sired to operate 'a road side stand under the Lexington Zoning By-law. No one appeared in opposition. At the close of the hearing the Board in private session February 17, 1933, gave consideration to the subject of the petition and voted unanimously in favor of the following findings: 1. That in its judgment the public convenience and welfare will be substantially served by the making of the exception requested. 2. That •the.exception requested will not tend to impair the status of the neighborhood. 3. That the exception requested will be in harmony with the general purposes and intent of the regulations in the ' Lexington Zoning By-law, 4. That the enforcement of the Lexington Zoning By-law as to the locus in question would involve practical difficulty and unnecessary haxd9iip and the relief requested may be granted without substantially derogating from the intent and purpose of such Lexington Zoning By-law. Pursuant to the said findings, the Board hereby unanimously decides that the application of the said Lexington Zoning By- law is hereby varied so far as may be necessary to permit Manuel G. Rose to operate a roadside stand on land belonging to Marie G. Rose, #756 Waltham Street, Lexington, said stand to be approximately twenty-five feet from the junction of said lot of Marie G. Rose and land of Carroll and to be set back at least thirty feet from the line of Waltham Street, all as shown on plan of land in Lexington of Marie G. Rose, dated February 17, 1933, for a period of one year beginning February 17, 1933,536utjVeet to the following conditions; Ample parking space is to be provided for parking so that customers will not park their automobiles on Waltham Street; said road side stand shall be kept in a neat condition at all times. The Board hereby makes a detailed record of all its ' proceedings relative to such petition and hereby sets forth that the reasons for its decision are its findings hereinbefore set forth and the testimony presented at the said hearing, including that herein summarized, and directs that this record immediately following this decision shall be filed in the office of the Town Clerk of Lexington and shall be open to public inspection and that notice of this decision shall be mailed forthwith to each party in interest.
