The Board of Appeals met at the Selectmen's Room, Town
Office Building, on Friday, January 20, 1933, Messrs.
Maddison, Glynn, Custanoe, Slocum and Baldrey were present.
The Secretary was also present.
The records of the meeting of November 18, 1932 were
approved. The records of the meetings of,January 6 and
10, 1933 were also approved.
In reference to the application of James R. Smith for
permission to maintain an office building on the strip of
land at the corner of Massachusetts Avenue and Tower Street,
on motion of Theodore A. C ustance it was voted unanimously
that Mr. Smith be not allowed to place the building on the
land.
Mr. Baldrey suggested that Mr. Smith put the sign back.
Mr. Glynn offered a motion that the petition of James R.
Smith be granted for the sign subject to a set back of twenty
feet from Massachusetts Avenue, for a period of two years.
Mr, Custance offered a substitute motion "That the Board
' approve the maintenance of the sign in the present location
as now located for a period of not more than two years from
December 31, 1932",
The substitute motion was passed by vote of the Board.
The Board signed the order denying the application for
the office building in the following form:
The Board of Appeals, acting under General Laws,
Chapter 40, sec. 27, having received a written petition
addressed to it by James R. Smith a copy of which is hereto
annexed, held a public hearing thereon of which notice was
mailed to the petitioner and to the owners of all property
deemed by the Board to be affected thereby as they appear
on the most recent local tax list, and also advertised in
the Lexington Townsman, a newspaper published in Lexington,
which hearing was held in the Selectmen's Room, in the
Town Office Building on Friday the 6th day of January 1933
at 8:00 o'clock P.M. All of the members of the Board of
Appeals were present at the hearing,
After hearing the evidence offered by the petitioners
and such other evidence as was offered, the Board in private
' session at a meeting held January 20, 1933 gave consideration
to the subject of the petition and a majority of the Board
voted that in its judgment the public convenience and welfare
will not be substantially served by the use of the premises
described in the petition and that such use may tend to
impair the status of the neighborhood, insofar as it relates
to the locating of an office building located at the junction
of Tower Street and Richard Road which is a part of his
de#elopment and which he desires to locate near the corner
of Massachusetts Avenue and Tower Street,
The Board therefore determines that the application of
section seven of the Lexington Zoning By-law does not permit
the use of the premises described in the petition and instructs
the Inspector of Buildings of Lexington not to grant a permit
therefor.

Lexington Board of Zoning Appeals.
Notice is hereby given that the Board of Appeals of
Lexington, appointed under General Laws, Chapter 40, section
27, will give a hearing in the Selectmen's Room in the Town
Office Building on Friday the 6th day of January, 1933 at
8 o'clock P.M. on the petition of James R. Smith of Arlington
that the Board vary the application of the Lexington Zoning
By-law in accordance with the authority therein contained
by permitting the maintenance of a temporary sign and temporary
office building on the premises at Tower Street and corner
of Massachusetts Avenue, Lexington.

The Board signed the order granting the application for
the maintenance of the advertising sign at the corner of
Mass, Avenue and Tower Street in the following form:

following conditions, and instructs the Inspector of Buildings CrJ
of Lexington to grant a permit therefor. To permit James R.
Smith of Arlington, Massachusetts to maintain'a sign, adver-
tising his development known as Sunnyview Home Development,
in its present location near the corner of Massachusetts
Avenue and Tower Street, for a period to expire December 31,
1934.
The Board therefor determines that the use of the premises
described in the petition is in harmony with the general
purposes and intent of the Lexington Zoning By-law.

Lexington Board of Zoning Appeals.
Notice is hereby given that the Board of Appeals of
Lexington, appointed under General Laws, Chapter 40.,
section 27, will give a hearing in the Selectmen's Room, in
the Town Office Building on Friday the 6th day of January
1933 at eight o'clock P.M. on the petition of James R. Smith
of Arlington that the Board vary the application of the
Lexington Zoning By-law in accordance with the authority
therein contained by permitting the maintenance of a
temporary sign and temporary office building on the premises
at Tower Street and corner of Massachusetts Avenue, Lexington,

In reference. to the application of Pellegrino Ferri of
108 Bow Street for permission to remove the existing garage
on Winn Street to a location on Albemarle Avenue within
twenty feet of the street line, Mr. Custance offered the
' following motion:
"That Mr. Ferri be granted permission to move his garage
from the present location to the location requested on
Albemarle Avenue and thAt he be permitted to maintain the
present structure only and until such.time as the town accepts
Albemarle Avenue."
The Chairman called attention to the fact that to grant
this permit under the General Laws the vote must bi unanimous.
Only two members voted in favor of the motion, and
therefor it was not granted.
On motion of Mr. Custance it was voted to re -consider
the application of Mr. Ferri and the matter was laid upon
the table.
No action was taken on the application of Anna L. Sword.
The Chairman reported that he informed Mr. Burrill the
result of.the action of the Board on his application# The
Secretary was requested to -send the order to Mr. Burrill,
