BOARD OF APPEALS MEETING

A joint hearing of the Board of Appeals and the Selectmen
was held at the Town Office Building on Tuesday, October 25,
1932 at 8:10 P.M. Thos e ,present were Messrs. Maddison, Glynn,
Custance and Baldrey. The notice regarding the petition of
Ashley W. Partridge to permit a private garage and stores
at 404 Waltham Street was read and the hearing was opened.
o-5 Mr. Partridge presented plans showing the desired improvement
and -explained that he desired to store his trucks in the
proposed building and make minor repairs on same. No one
appeared in opposition. The hearing was then closed.
The Board of Appeals then withdrew to the Assessors'
Office and considered the petition of Mr. Partridge, and voted
that Ashley W. Partridge be permitted to use the premises at
404 Waltham Street for a private garage for the storage of
not exceeding six automobiles or trucks, the same to be an
accessory use to his business as conducted in adjacent property,
and upon further condition that the building be constructed. by
October 25., 1933. Such permit to be in the following forms

The Board of Appeals, acting under Geheral Laws,
Chapter 40, see. 27, having received a written petition
addresaed to it by Ashley We Partridge, a copy of which is
hereto annexed, held a public hearing thereon of which notice
was mailed to the petitioner and to the owners of all property
deemed by the Board to be affected thereby as they appear on
the most recent local tax list, and also advertised in the
Lexington Times Minute -Man a newspaper published in Lexington,
which hearing was held in the Selectmen's Room in the Town
Office Building on Tuesday the 25th day of October 1932 at
8 o'clock P.M. A majority of the members of the Board of
Appeals were present at the hearing.
After hearing the evidence offered by the petitioner
and such other evidence as was offered, the Board in private
session at a meeting held October 25, 1932 gave consideration
to the subject of the petition and a majority of the Board
voted that in its judgment the public convenience and welfare
will be substantially served by the use of the premises
described in the petition and that such use will not tend to
impair the status of the neighborhood.
The Board therefore determines that the application of
section of the Lexington Zoning By-law
permits the use of the premises described in the petition, '
subject to the following conditions, and instructs the
Inspector of Buildings of Lexington to grant a permit therefor.
That the Building be used for a private garage for the
storage of not exceeding six automobiles or trucks, as an
accessory use to his business conducted on the adjacent_
property, and -upon the further condition that the building
be constructed by October 25, 1933.
The Board therefore determines that the use of the
premises described in the petition is in harmony with the
general purposes and intent of the Lexington Zoning By-law.

The undersigned hereby petition the Lexington Board
of Appeals, appointed under General Laws, Chapter 40,
Section E7, to determine the application of Section
of the Lexington Zoning By-law with respect to the premises
at No. 404 Waltham Street, owned by A. W. Partridge of
Lexington by permitting the following;
Private Garage and Stores as per plan.

The Board of Appeals will hold a hearing on the matter
of determining the application of the Zoning By-law by
permitting a private garage and stores to be located on
Waltham Street on property owned by Ashley W. Partridge of
274 Marrett Road, Lexington, in accordance with the Lexington
Zoning By-law, and in accordance with Chapter 133 of the
Acts of 1924.
The hearing will be held on October 25, 1932 at 8 P.M,
at the Selectmen's Room, Town Office Building,
