AUGUST 16, 1932.
Board of Appeals meeting was held in the Conferance
Room, on August 16, 1932 at 8:10 P.M. Messrs. Glynn,
Custance and Baldrey Were present.
The minutes of the last meeting were read and approved.
The Board considered the application of Arthur R.
Witham for permission to use the premises at 317 Marrett
Road as presented at the hearing held August 9, and voted
not to grant a permit for the following reasons: the
garage is partially within a residential zone; the building
in question is of the type intended for accessory use; the
use for a repair shop for automobiles would tend to interfere
with the comfort of adjoining residents; and would tent to
injure the value of adjacent property in the residdntial
zone.
The Board of Appeals, acting under General Laws,
Chapter 40, sec. 27, having received a written petition
addressed to it by Arthur R. WIbham, a copy of which is
hereto annexed, held a public hearing thereon of which
notice was mailed to the petitioner and to the owners
of all prpperty deemed by the Board to be affected thereby
as they appear on the most recent local tax list, and also
advertised in the Lexington Times -Minute -Paan,
a newspaper published in Lexington, which hearing was
held in the Selectmen's Room in the Town Office Building
on the 9th day of August 1932 at 7:50 o'clock P.M. Messrs.
Custance, Baldrey and Glpm of the members -,of the Board of
Appeals were present at the hearing.
After hearing the evidence offered by the_,p�dt3.tioners
and such other evidence as was offered, the Board in private
session at a meeting held August 16, gave consideration to
the subject of the petition and a majority of the Board voted
that in its judgment the public convenience and welfare will
not be substantially served by the use of the premises
described in the petition and that such use may tend to impair
the status of the neighborhood, for the following reasons: -
The garage is partially within a residential zone; the build-
ing is of the type intended for accessory use; the use for
a repair shop for automolbilm would tend to interfere with
the comfort of adjoining residents and would tend to injure
the value of adjacent property in the residential zone.

The Board therefor determines that the application '
of section nine of the Lexington Zoning By-law does not
permit the use of the premises described in the petition and
instructs the Inspector of Buildings of Lexington not to

grant a permit therefor.

Gentlemen:
The undersigned hereby petition the Lexington Board
of Appeals, appointed under General Laws, Chapter 40,
Section 27, to ddtermine the application of Section
of the Lexington Zoning By-law with respect to the premisea
at No. Rear 317 Marrett Road, owned by Mary J. & Anna E.
Marshall of Waltham by permitting the following: repair shop.

The Board of Appeals will hold a hearing on the matter
of determing the application of the Zoning By-law by
permitting a repair shop to be conducted at the rear of
317 Marrett Road near the corner of Waltham Street by Arthur
R. Witham of Lexington, under the Lexington Zoning By -Law
and in accordance with Chapter 133 of the Acts of 19% .
The hearing will be held on August 9, 1932 at the
Selectmen's Room, Town Office Building at 7:50 P.M.
