BOARD OF -APPEALS MEETING
C=7
JUNE 28, 1932.
A joint meeting of the Board of Appeals end the Board
of Selectmen was held in the Selectmen's Room, Town Office
Building, at 8 P.M. Messrs. Maddison, Glynn, Baldrey and
8usiance were present. The -Secretary was also present.
Hearing was declared open on the application of the
Standard Oil Co.,df New York for permission to -increase the
storage capacity of the gasoline tanks at 789 Mass. Avenue
;y and to install one additional pump.
The Clerk Bead the notice of the hearing,
Mr. Daniels explained that they did not intend to make
any change except to establish the additional pump on the
island on the inside of the property. The pump that is
out near the street is to remain in its present location,
and in the island instead of having one pump in the center,
they would have two pumps, one at each end.
No objection was received to the application, and
the hearing was declared closed. -
The Board of Appeals adjourned to the Engineer's '
Office and the records of the last meeting held June 3,
1932 were read and approved.' The Board then considered
the application of the Standard Oil.Co. of N. Y., Inc.
for additional pump and one additional 1000 gallon storage
tank for gasoline on the property at 789 Mass. Avenue and
it was voted that the petition be granted in the following
form:
The Board of Appeals, acting under General Laws,
Chapter 40, sec. 27, having received a *ritten petition
addressed to it by the Standard Oil Co. of New York, Inc.
a copy of which is hereto annexed, held a public hearing
thereon of which notice was mailed to the petitioner and
to the owners of all property deemed by the Board to be
affected thereby as they appear on the most recent local
tax list, and also advertised in the Lexington Times -
Minute -Man, a newspaper published in Lexington, which
hearing was held in the Selectments Room in the Town Office
Building on the 28th day of June 1932 at 8 o'clock P.M.
A majority of the members of the Board of Appeals
were present at the hearing.
After hearing the evidence offered by the petitioner '
and no other evidence -having been offered, the Board in
private session at a meeting held0June 28, 1932, gave
consideration to the subject of the petition and a majority
of the Board voted that in its judgment the public convenience
and welfare will be substantially served by the use of the
premises described in the petition and that such use will
not tend to impair the status of the neighborhood.
The Board therefore determines that the application of
section 6 (c) in C.1 Districts of the Lexington Zoning By-
law permits the use of the premises described in the
petition, subject to the following conditions, and instructs
the Inspector of Buildings of Lexington to grant a permit
therefor.
1. That the additional pump be located adjacent to the
present pump nearest the building but not nearer the street.
2. That the additional pump and tank be installed within
six months.
The Board therefor determines that the.use of the
premises described in the petition is in harmony with the
general purposes and intent of the Lexington Zoning By-law.
