The Board of Appeals held a joint hearing with the Board of Selectmen in the Selectmen's Hoom, Town Office Building, on January 26, 1932. All of the members of the Board of Appeals were present. At 8 P.M. joint hearing of the Board of Appeals and Selectmen was declared oven on the application of the Lexington Coal Co. for pernIssion to install underground tanks with a capacity of 50,000 gallons for storage of oil and gasoline at their, property on Bedford Street, North Lexington. the Chairman of the Board of Selectmen being absent, Pr. Madd.ison, Chairman of the Board of Appeals was requested to conduct the hearing. Mr. Wm. Ii. Mulliken was present representing the Lexington Coal Company, and explained that the time has come for fuel oil, and in many instances thea must provide fuel oil as a means of fuel and they felt that they should be allowed to install underground storage tanks for the handling of the fuel oil. He stated that they did not intend to use the full capacity of the 50,000 gallons at the present time. They did not intend to do any construction work except to put up a small building. The only other changes on the property would be the underground tanks. He explained that the grade was such that they could fill the tanks with oil by gravity, and the only structure above ground would be the pumps. In regard to the gasoline, he desired.to store that so that they mai buy it at :wholesale price for their own cars or for the renting of storage space for a tank car lot. Isir. I,iulliken explained that he did not intend to have a retail gasoline business. ;,bout ahalf a dozen persons were present at the hearing but no one objected. (The following order entered by error.) The Board of Appeals, acting under General Laws, Chapter 40, sec. 27, having received a written petition addressed to it by Lexington Coal Company a copy of which is hereto annexed, held a public hearing thereon of which notice was^mailed to the petitioner and to the owners of all property deemed by the Board to be affected thereby as they appear on the most recent local tax list, and also advertised in the Lexington Times -Minute Man, a newspaper published in Lexington, which hearing was held in the Selectmen's Room in the Town Office Building on the 26th day of Janu=ary 1932 at 8 ofelock P.M. All of the members of the Board of Appeals were present. at the hearing. After hearing the evidence offered by the petitioner and such other evidence as was offered, the Board in private session at a meeting held Jan.29, 1932, gave consideration to the subject of the petition and a majority of the Board voted that in its judgment the public convenience and 1 1 welfare will be substantially served by the use of the 6 premises described• in the petition and that such use will not tend to impair the status of the neighborhood. The Board therefore determines that the apalication of section 6 (c) in Cl Districts and Sec. 9 of the Lexington Zoning By-law permits.the use of the premises described in the petition , and instructs the Inspector of Buildings of Lexington to grant a ,permit . therefor. The five. tanks referred to in the petition are to be at least two feet underground in a location approximately as showncbn plan on file with the Town Clerk, four of the tanks to be used for fuel oil only, and one for gasoline and no gasoline to. be sold at retail on the premises. This permit is granted an the .further condition that unless the tanks are installed within one year, this permit shall become null and void. The Board therefore determines that•.the use of the premises.described in the petition is in harmony with the general purposes and intent of the Lexingt m Zoning By-law. A. N. Maddison Roland W.. Gentlemen: The undersigned hereby petition the Lexington Board of Appeals, appointed under General Laws, Chapter 40, Section 27, to determine the application of Section r of the Lexington Zoning By-law with respect to the premises at No. Bedford Street, owned by Lexington Coal Co. of Lexington by permitting the following: Installation of underground oil storage, and gasoline ' tanks having a capacity of approximately 50,000. gallons. The Board of Appeals will hold a hearing on the matter of determining the application of the Zoning Law by permitting the installation of underground tanks for the storage of oil and gasoline in the capacity of 50,000 gallons on the property of the Lexington Coal Company on Bedford Street, Lexingt on, under Section fc 6 (c) in Cl Districts and Section 9 of the Lexingt m Zoning By-law and in accordance with Chapter 133 of the Acts of 1924.
