HomeMy WebLinkAbout1930-06-062 BOARD OF APPEALS MEETING JUNE 6, 1930. A meeting of the Board of Appeals was held at the Selectmen's Room, Town Office Building, at 8 P.M. Messrs. Maddison, Glynn, Custance, Slocum and Miss Evelyn Small were present. Mr. Roland W. Baldrey, Clerk, being absent, the Chairman appointed Mr. C. Edward Glynn clerk pro -tem. At 8:13 P.M. hearing was declared open on the petition of Frank A. and Mary Napoli for permission to erect a roadside stand on Marrett Road near the Napoli junction of Middle Street. Hearing. A petition signed by 38 people who had no objection to the roadside stand was read by Mr. Thomas Napoli. He also presented a plan of the proposed location of the stand. Nr. Napoli was asked by the Chairman what provision was to be made for the parking of cars. Mr. Napoli stated that there is a frontage of 150' to cane in and purchase the products, and also apple room around the stand; there was room enough to accommodate ten cars when the stumps are cleared away. He also stated that he only planned to sell the products raised on their awn premises. Mr. Napoli stated that the stand was to be placed on concrete blocks, the stand being 20 x 12' and it could be moved away at any time. Mr. Thomas J. Heaney stated that he had no objection to the roadside stand. In reply to Mr. Glynn's question, Mr. Napoli stated that he had 14k acres of land and had been selling his products at the roadside stand for the paast two years. Mr. Frank Napoli stated that he was not satisfied with a temporary stand as the vegetables spoil from the heat and the stand had been broken into twice previously. Mr. J. C. Gramstorff stated that he was an abuttor on Middle Street. He was in favor of the petition saying that it was the only means of livelihood of Mr. Napoli and for the past two years he had conducted a very good stand. Mrs. C. A. Gramstorff also stated that she was in favor of the petition. Mr. Neil McIntosh wrote h' letter:°regarding the situation. Mr. Robert J. Fawcett stated that 12 years ago he came to Lexin-ton and bought a place on Marrett Road which is opposite the Napoli property, and set out 100 trees, and the building Mr. Napoli proposed to erect is directly opposite his premises.. Mr. Fawcett stated that he has three acres of land, 500' on Marrett Road. He intends to put up some houses on his land and objects to having a stand opposite them. He stated that the street is about 30' wide and it would be a menace to traffic. In answer to Mr. Fawcett's statement regarding traffic, Mr. Napoli stated that last year they had no trouble with the cars coming in and out of the stand. Mrs. H. L. Jenks sent in a written protest. The hearing was declared closed at 8:35 P.M. At 8:36 P.M. hearing was declared open on the petition of Salvatore Ricci for a roadside stand on the premises owned by Alfred L. Short on Waltham Street. The Clerk pro -tem read the notice of the hearing as inserted in the Lexine ton Times -Minute Ricci hearing. Man. Mr. Ricci did not appear. Mr. Alfred L. Short stated that he offered the use of his land to Mr. Ricci to sell his products, but he did not own Mr. Ricci's house. This stand was about at the junction of Old County Road and Waltham Street. The Chairman asked Mr. Short if Mr. Ricci sold only the produce he raised on his property. Mr. Short stated that he only intends to sell his market products. Mr. Ricci has about 30 acres of land bgt no land fronting on Waltham Street. At present there is a stand there which was formerly the old "Mohawk Spa" and it has sandwiches advertised on it, but Mr. Short informed the meeting that Mr. Ricci intended topaint it and use it for his roadside stand. At present the same is on Town property, but Mr. Ricci will move it back. The stand is 10' x 12V. Mr. Short thought that automobilists wishing to purchase products could turn into the Old County Road, thus relieving congestion of traffic an Waltham Street. No-one appeared in opposition to the petition and the hearing was declared closed at 8:45 P.M. Hearing was declared open on the petition of Joseph V. Boinay at 8:46 P.M. The Clerk pro -tem read the notice of the hearigg as advertised in the local newspaper. In regard to the Boinay petition, it was decided to pass the following vote: Voted: That inasmuch as no-one appeared in Boinay appli- favor or in opposition to the petition of Joseph V. cation. Boinay for a roadside stand at 100 Pleasant Street, which hearing was called to be held June 6, 1930 at 8:30 P.M. the Chairman be instructed to communicate this fact to Mr. Boinay and suggest that if he desire_ s to be heard in the matter of his petition, the Board will be in session iednesday, June 11, 1930 at 8 P.M. The hearing was declared closed at 8:55 P.M. In regard to the permit granted to Peter and Semonian Martin Semonian to change from a one family house to house. a two family dwelling their house on Woburn Street, the Board decided to pass the following vote: Voted: That notation be made on the permit granted to Peter and Martin Semonian under date of Muly 1, 1929 to alter his house on Woburn Street from a single family to a two family dwelling to the effect that the house as altered does not comply with the above permit, inasmuch as the front of the house has been altered making two separate entrances. Mr. C. Slocum agreed to talk with Mr. Short and see if he could fix up his premises so that Mr. Ricci's stand would not be a traffic hazard. After general discussion on the three applications, the meeting voted to adjourn to Wednesday, June 11, 1930 at 8 p.m. at whixh time the three petitions will be considered again. The meeting adjourned at 10:40 P.M. A true record, Atte
