HomeMy WebLinkAbout1985-01-21-HATC-mou.pdf /1 , .r 4 MEMORANDUM OF AGREEMENT r, by and among the towns of BEDFORD, CONCORD, LEXINGTON, AND LINCOLN Preamble Whereas: - The towns of Bedford, Concord, Lexington and Lincoln recognize the need for and support the concept of cooperative and comprehensive planning;.,on transportation and growth issues; and t _o y II `! • 3t ) .,rrq 'Yr - The Han$coa aretkcontinues to be affected by the impacts of growth as evidenced by increases in traffic volumes; and - The fouretowns wish to retain the characteristics and physical attributes which distinguish their-region as an attractive and desirable place to live and work; and - The communities believe that a formal,mechanism for maintaining communication, cooperation and implementation of goals is necessary; Now therefore, the four towns mutually agree, in accordance with votes of their respective Boards of Selectmen and Planning-Boards, as follows: . Section I. Creation of Hanscom Area Traffic Committee.. The towns of Bedford, Concord, Lexington and Lincoln shall form a permanent committee to- be known as the Hanscom.Area Traffic Committee (hereinafter referred to as the "Committee"). The Committee shall be comprised of a Selectman, a member of tthhe Planning Board, and an at-large member from each town. The Committee may,_by_a unanimous vote of all member towns, admit additional contiguous towns which share its concerns and objectives. The Committee may also invite any person, agency or organization concerned with traffic and growth issues to participate in its deliberations on a non-voting basis. Section II. Purpose and Responsibilities of Committee The purpose of the Committee shall be to foster improvement of traffic conditions on roads in the member towns. The responsibilities of the Committee shall be as follows: a. To review and comment upon any proposed development project or roadway alteration which would affect traffic between and through the member towns; and Memorandum of Agreement Page 2 b. To make recommendations to county, state, federal and regional agencies regarding road related projects in the region; and c. To press for roadway improvement projects or studies which have been mutually agreed upon; and d. To develop and promote measures to balance growth and traffic flow in the member towns. The Committee may make recommendations with respect to a given proposal but may not make binding decisions, commitments or requirements on member towns except as authorized by them in accordance with applicable statutes or regulations. The Committee may recommend consulting services, provided that sufficient funds therefor have been appropriated or committed by member towns or other agencies or organizations. The Committee shall, at its first meeting, adopt rules governing its general operations. Each town shall have one vote. To effect the aforementioned purposes, the member towns agree: To notify county, state, federal, and regional agencies, the Hanscom Field Advisory Commission, local Chambers of Commerce, and relevant boards within their communities of the existence and purposes of the Committee; - To furnish to the Committee at the earliest possible time all pertinent information regarding a proposed project which would affect traffic between and through the member towns, such as the following: applications, preliminary plans 'environmental notification forms, notices of hearings, and environmental assessments or reports. - That the Hanscom Area Traffic Committee representatives shall assure that copies of all reports or recommendations of the Committee are forwarded to the appropriate town boards; - That Boards of Selectmen shall request that any town board which takes an action contrary to a recommendation of the Committee shall report in writing to the Selectmen its reasons for taking such action. Section III. Evaluation of Committee One year after the execution of this agreement, the signatories hereto shall review and evaluate the performance of the Committee and make recommendations concerning its future operation. Amendment of Memorandum This Memorandum of Agreement may be amended or cancelled at any time by mutual agreement of all member Boards of Selectmen, and any member town may withdraw from participation in the Committee upon two months written notice.
