Z -{ bnunc o 16rm lit &AVdHfinent x Regional arts councils shall consist of an equal number of members to be appointed from each city nni rn or town within the consortium in the manner herein described r n Members of the local and regional arts councils shall be appointed for a term of two years and any ` O such member shall not be appointed to more than three consecutive terms Members shall have O demonstrated scholarship or creativity in, or distinguished service to, the arts and humanities Upon a vacancy, for any reason, his successor, if any shall be appointed for a term of two years, N and shall serve until the qualification of his successor Members shall not be elected public m O officials Members shall be considered to be special municipal employees for the purposes of Z i two hundred and sixty-eight A For purposes of chapter two hundred and sixty-eight A any = chapterrn co local or regional arts council member who is authorized thereby to make disclosure to his appointing 0 D o' authority, or to seek approval from the local legislative body may, in lieu thereof disclose to, or O r seek such approval from, the Massachusetts arts lottery council, and the Massachusetts arts lottery Z -i council is authorized to receive such disclosure and approve such exemptions Council members shall Z = be classified as officers for purposes of chapter two hundred and fifty-eight, section thirteen O Members shall serve without compensation but shall be reimbursed for their expenses actually and r O necessarily incurred in the discharge of their duties Local and regional arts councils shall r rn annually elect a chairman, secretary and treasurer -< Local and regional arts councils, may establish administrative units, but no such arts council D shall utilize more than five per cent of the monies received from the State Arts Lottery Fund for N administrative purposes, including member expenses fn 60 Subject to rules regulations, rulings or N 9 g guidelines of the Massachusetts arts lottery council, f� D such council may decide the distribution of arts lottery funds or other funds that may be allocable 70 0 to them may also conduct other activities to promote and encourage the arts, may enter into rn = contracts subject to approval of town counsel or city solicitor as to form, and may do and perform -i any and all acts which may be necessary or desirable to carry out such powers and the purposes of D to these sections thirty-five A through thirty-five C inclusive Nothing in the provisions of section rn twenty-seven of chapter ten shall prevent a local or regional arts council or an arts organization, < 1 , —1 or their agents or employees, from encouraging the sale of lottery tickets for the arts nor from -� -n N being licensed as agents to sell lottery tickets for the arts. Notwithstanding the provisions of N section fifty-three A of chapter forty-four of the General Laws, local and regional arts councils y may accept grants contributions, gifts, bequests, devises and other donations from all sources V) Z including governmental bodies and shall deposit such monies and any other revenues, including -{ v revenues derived from council activities, in the revolving fund established under the provisions of D this section Funds received from sources other than the arts lottery fund may be disbursed at the —1 X discretion of the local or regional arts council for the same purposes as arts lottery funds, rn rn including administrative expenses, provided, however that the Massachusetts arts lottery coucil may 60 O r rn V) D 0 by rule regulation ruling or guideline establish further clarification of such purposes as well as < procedures to assure that such funds are so used D Notwithstanding the provisions of section fifty-three of chapter forty-four, any city, town or Z consortium of cities and towns otherwise pursuant to the provisions of chapter forty, section C') four A, shall establish in the city or town treasury, or in one of the cities or towns in the rn consortium a revolving account which shall be kept separate and apart from all other monies by the C) treasurer and in which shall be deposited all ree.eipts from the state arts lottery fund, distributed under the provisions of section thirty-five A, and any other receipts or donations to the local or 5. 13 regional arts councils authorized by law A treasurer of a city, town or regional consortium as custodian may invest such portion of cash as deemed not required until such funds are to be expended 5 and in such investments as are authorized under the provisions of section fifty-five of chapter Y forty-seven All such funds including interest earned thereon, may be expended at the direction of D m the local and regional arts councils, without further appropriation; provided, further that such rn funds as shall not have been expended twelve months after receipt shall be segregated and subject to f C) further appropriation by the mayor, city council, city manager. board of selectmen or town manager L O for the purposes provided in sections thirty-five A to thirty-five C inclusive The city auditor O town accountant, or officer having similar duties, shall submit annually a report of said revolving ( K fund to the mayor, city council, city manager, board of selectmen or town manager for their review m O and a copy of said report shall be submitted to the director of the bureau of accounts and the S Z Massachusetts arts lottery council ZE SECTION 295 Whenever used in any general or special law, the words "arts lottery council" shall C7 m mean the Massachusetts arts lottery council and the words "local arts councils" or 'regional arts O D councils" shall mean the local and regional arts councils established under the provisions of this Z r co act Z S All regulations, rulings, guidelines or determinations made by the arts lottery council or any O local or regional arts council prior to the effective date of this act shall continue in effect f until they are subsequently altered amended modified or revoked r- -ri All duly existing contracts leases or obligations of any kind of the arts lottery council shall -< be the obligation of the Massachusetts arts lottery council and all such contracts, leases or 3 obligations of a local or regional arts council shall continue to be the obligation of such local or N D regional arts council, notwithstanding the provisions of this act rn In N SECTION 296 Notwithstanding any other provisions of this act, members and employees appointed or 700 D employed by the arts lottery council or a local or regional arts council before the effective date m = of this act shall continue such appointment or employment without any loss of rights or benefits --I C existing before the said effective date of this act D N 7D D O to , -n D to Z D -1 70 m m V) 0 1-- << 71 V)
