HomeMy WebLinkAbout1970-03-09-CONCOM-min.pdf TOWN OF LEXINGTON , MASSACHUSETTS CONSERVATION COMMISSION MINUTES of the Commission meeting March 9, 1970 The meeting was called to order by the Chairman Mr. Brown, at 7 55 p m Mrs Frick and Messrs Mazerall , Smith, Suss- man and Totman were present , as well as Manfred Friedman, visitor Richard Soule , a property owner in the Justin St area, offered his lot #19 (Map 84) to the Town for $1,000 (7500 sq. ft ) He said his friend Ralph Frissore would do the same for his two lots (18A and 18B, same size each) This was later con- firmed by telephone call Options will be drawn up Eldred Street residents would like to meet with the Com- mission, Mr Friedman reported A time could not be set up Visual Aids It was agreed to ask Mr Zaleski what could be made ready for the Wednesday night information meeting To pursue or not? VOTED that letters should be sent all pro- perty owners in areas where conservation easement acquisition will not be pursued in this Town Meeting Article 78 - lots 39A through 48 Article 80 - all property owners not already sent such letters, except owner of Lot 7 (A letter was received from the Burkes, which Mr Brown will answer) Article 81 - all property owners listed Article 94 - all property owners not under agreement Warrant articles were reviewed briefly in numerical order before joining the Planning Board meeting. Meeting with the Planning Board Warrant Articles were discussed in order of priority, as with the Selectmen last week 1. Drummer Boy (Article 93) Agreement has not been reached with the owner because the Planning Board has not yet approved his subdivision plan for the land The owner had not yet sup- plied some information requested and there are some problems related to the proposed road layout and the utility easements. Mr Lund asked how much land would the Conservation Commission be interested in if the subdivision plan is not approved Mr Brown replied all the land southeast of the Edison Co. easement, as shown in the Planning Board map (14 acres) A 3-acres cor- ner was not shaded but could or should be included The question of roads across conservation easements Money damage would be great if an access road were not permitted here Mr Sussman said roads could be permitted where neces- Conservation Commission Minutes 3/9/70 page 2 sary, but that roads or certain road layouts would be inad- visab]eon some easements Mr. Smith read the Conservation Foundation wording Mr. Zaleski said he preferred a more positive specific exception for roads and driveways "with the approval of the Planning Board as to location and design " The Conservation Commission agreed to this 4 2. Heritage Hotels (Article 96) Mr Smith said that the cost to the town would be about the same either for a conservation easement orfbr outright purchase Eight acres along the brook involved Several in the room mentioned receiving complaints that the motel builder was filling too close to the brook Mr. Lund said this was being checked 3. Justin Street (Article 94) The properties of Wilson, Soule and Frissore are or will soon be under agreement for purchase. On other lots the proposed easement would be across back or side yards of houses and will not be pursued in Town Meeting. Article 95 Mrs. Baskin is donating her land-locked property (lot 99A) 4. Busa land (Article 77) This will probably be the only open piece of land between a residential area and a heavily built-up commercial zone. The land is an important water collector from the Bedford Street end of Worthen Road A life estate , which will allow Mrs Busa to farm the land as long as she lives is now being negotiated, with agreement promised by the time the article comes up 5 Juniper Basin (Article 79) This area ( in two parcels of 2 and 8 acres) has been recently renamed to characterize its water content. No agreement reached, but it will be pursued. 6 Green and White off Maple Street (Article 97) An opinion of value will be in in a week or so 7 East of Maple Street (Article 78) Easement over backs of house lots will not be pursued The size of the easement Mr. Stoico will donate will depend somewhat upon whether or not the land is rezoned for apartments. Easement will be given for legal fees only 8 Kendall Road area (Article 80) Will not be pursued at Town Meeting, with the possible exception of Lot 7, still open for discussion bArticle 81. Will not be pursued It was agreed that articles should be taken up in order of priority listed above and that the chair should be so notified in writing. The Conservation Commission agreed to present the motions Vine Brook Land. Mr. Worrell pointed out that the land had already been altered by man and could no longer be termed " in its natural state. " Copies of the report will be distributed later in the week. yi Pond off Carnegie Place Mrs . Frick said she received a mes- 4 sage from Mr. Spagnuolo that he was "going ahead on the pond. " . No certain whether that meant to fill it or to landscape it , 1 she will look into the matter further. Conservation Fund. MOVED and PASSED that an article be sub- mitted for replenishment of the Conservation Fund at the next Town Meeting. A letter about this should be sent the Board of Selectmen at the conclusion of Town Meeting The meeting adjourned at 10 30 p m. Paragraph 4, Page 2 should read as follows The Valleyfield Realty Trust property , discovered to con- tain three acres more in a resurvey , will be purchased by transferring $4350 from the Conservation Fund (balance $4900) and adding it to the amount in the Article. The Board of Selectmen approved use of the Selectmen' s Op- tions and Appraisals Account to cover the costs of opinions of value for the Conservation Commission' s 1970 Warrant Articles. NOTE 2 Item 1 under LEGAL DESCRIPTION as taken from the Conservation Law Foundation model would then read as follows 1. Construction or placing of buildings , signs , bill- boards or other advertising, ultilities or other struc- tures on or above the ground, except roads or driveways with the approval of the Planning Board as to location and design.
