This Conservation Commission meeting was held remotely via Zoom, an online meeting
platform. Public Participation via calling in or using your computer was encouraged.

Approve CLC Interpretive Bird Sign Location at Dunback Meadow
Ms. Roberta Hodson, Citizens for Lexington Conservation, presented and stated that the
proposed sign would provide information of the bird species present on site and the migratory
patterns of these birds for the users of Dunback Meadow. Ms. Hodson stated the sign is proposed
to be installed in the spring. Mr. Duke Bitsko, Commissioner, asked if any additional birds can
be added to the panels. Ms. Hodson stated the QR Codes on the sign can be scanned by users to
listen to audio explaining more information about the types of birds on site. Mr. Kevin Beuttell,
Commissioner, asked what type of installation is proposed. Ms. Hodson stated the stewards will
install this sign and it will be similar to other signs installe d on conservation areas in town.
On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 6-0 by roll call
vote to approve the location of the interpretive bird sign at Dunback Meadow.

Ms. Katie Enright , Howard Stein Hudson, presented and stated that the site is comprised of three
existing office buildings and existing parking lots. The proposed buildings will be replacing
existing pavement and existing office buildings. Ms. Enright stated that there is a drainage
easement on site and the proposal includes a connection into the exist ing Militia Drive drainage
system. She also stated that the project team has been working with the Planning Board and does
not expect any major changes to the drainage system to occur.
Ms. Mullins stated that all projects undergoing planning approval for the MBTA Zones are
undergoing a peer review process rather than a review by Town Engineering due to the
complexity of these proposals. Mr. Whelan asked that all previous comments and responses
between the applicant and the peer reviewer, Mackenzie Engineering, be uploaded to the record
for review. Mr. Austin Chartier, Mackenz ie Engineering Group, stated a third peer review is
being completed and is expected to be issued within the week.
Ms. Lisa Newton, 15 Ledgelawn Avenue, stated that the North Lexington Brook floods and
asked if the calculations include the runoff of flooding from the brook into the stormwater drain
connection. Ms. Newton also stated that it is proposed to take snow offsite by fossil fuel trucks
and asked the Commission’s opinion on if keeping snow onsite would be more beneficial. Mr.
Hamilton stated the Commission does not have the authority to dictate snow removal and that
often piles of snow carry pollutants, so it can be beneficial to remove them from sensitive areas.

Mr. Michael Novak, Patriot Engineering, presented and stated that LEC had been engaged to
review an offsite wetland and that a secondary plan from 2002 was incorporated into the latest
plan. Mr. Novak stated that the proposal includes an addition and three-car garage connected to a
reconfigured driveway which falls within the 100-foot buffer zone to Bordering Vegetated
Wetlands.
Mr. Beuttell stated that disturbance occurred at 4 Percy Road and stabilization is not to the
commission’s satisfaction and that a scheduled site visit to review this is recommended.

Ms. Nicole Ferrara, LEC, presented and stated that there is an isolated wetland on site and a
bordering vegetated wetland offsite. Ms. Ferrara stated that the proposal includes an addition off
the rear of the existing dwelling along with a deck built off of the addition and leading to a
pervious paver patio . A retaining wall is included in the proposal along with an access path to
allow for entry into the backyard. Ms. Ferrara stated that three trees are proposed to be removed
due to the proximity of the roots to the proposed patio and addition.
Mr. Michael Novak, Patriot Engineering, stated that the new patio will be kept pervious and that
a new lawn line has been designated. Ms. Ferrara stated that the proposed mitigation includes an
estimated 2,000 square feet of buffer zone restoration and native plantings on site.

Mr. Michael Novak, Patriot Engineering, presented the site plans and stated that the site is within
the 200-foot Riverfront Area. Mr. Novak stated the proposal includes razing the ex isting
greenhouse and constructing a new greenhouse on site. Mr. Novak stated that a retaining wall is
proposed to prevent work within the 25-foot buffer zone.
Mr. Richard Kirby, LEC Environmental Consultants, stated the proposal is within degraded
Riverfront Area and that the proposal includes improvement of the Riverfront Area through
restoration of the green area onsite. Ms. Ladd stated there are existing trees within the green area.
Mr. Kirby stated that there are trees onsite growing out of historic fill on the site that need to be
reviewed by the Commission to decide if removal of the trees would be recommended.
Ms. Dohan asked if any clean water can be collected to water the plants. Mr. Novak stated they
will review if rain barrels can be inc luded in the proposal.
Ms. Julie Sibert, 30 Ingleside Road, asked why there is a break in the buffer zone between
abutting properties on the restoration plan. Mr. Kirby stated that the portion of the plan in
question is a wooded area not owned by the applicant. Ms. Sibert stated tree cutting has occurred
in this area without abutter notification. Mr. Kirby stated the restored land will be permanently
demarcated.
Mr. Lance Pan, 22 Ingleside Road, stated that water floods into their property from the site and
asked if a service ditch will be considered to address the flooding issues. Mr. Novak stated he
would need to discuss this with the owners to see if the concern can be addressed.
Mr. Bill Martin, 24 Ingleside Road, stated there is a significant amount of runoff from the
greenhouse onsite and was told by the property manager that all runoff would be accounted for in
the proposal. Mr. Martin also asked what the proposed height of the greenhouse is. Mr. Novak
stated he does not recall the proposed he ight and he estimates it to be around 20-25 feet.

Ms. Mary Trudeau, Wetlands Consultant, presented and stated that the property line was
corrected since the previous hearing. Ms. Trudeau stated that the wetland line will need to be
reviewed prior to closing the hearing and has not been reviewed due to snow cover on site.

Ms. Meg Buczynski, Activitas, presented and stated that no changes have been made to the
design since the previous meeting. Additional test pits were done onsite to address the
groundwater onsite. Ms. Buczynski stated that the higher the site is raised, the greater the
footprint of work will be onsite and further erosion and other impacts to the resource area could
occur. Ms. Buczynski also stated that the existing vegetation line is being maintained as
unmaintained meadow area within the proposed work.
Mr. Beuttell stated that there seems to be mo re room for additional stormwater management
without further impacts to the resource area. Mr. Beuttell stated he does not support the proposal
as is. Ms. Buczynski stated that the benefit is minor if they were to shift the location of the
system and stated that providing more meadow area would be most beneficial.
Mr. Bitsko asked what vegetation is proposed on the slope. Ms. Buczynski stated the 3:1 slope is
grass. Mr. Bitsko stated making the slope into meadow and moving the system 10 feet would
help meet the standards. Mr. Beuttell asked for clarification to be added to the plans as to where
the access zone would be. Ms. Ladd asked if a gate will be included in the rear of the courts for
entrance to maintain the back portion of the lawn. Ms. Buczynski stated that a gate will be
included at the rear of the courts and the exact location is being determined.
On a motion by Ms. Ladd and seconded by Mr. Hnatko, the Commission voted 7-0 by roll call
vote to close the hearing.
