So MOVED CONSTRUCTION AGREEMENT Brian Sullivan reported on the on-going negotiations with the construction agreement and NESWC's negotiator, Atty Walter Kelleher He also recommended reconsidering the penalty clause which became effective on June 30th of this year Some of the reasons he gave for reconsideration were the fact that the contract did not come out until early April, and some communities did not have enough time to schedule presentations and review the contract before spring town meeting of this year Brian made a recommendation to soften the penalty fee to a flat rate of $1 per ton for those communities signing after December 31, 1981 After some discussion, it was MOVED to accept the recommendation of the contract subcommittee PRIVATE HAULER TONNAGE Brian Sullivan motioned to set the minimum municipal commitment at 900 tpd, reserving 300 tpd for private haulers and to authorize UOP Inc to sign up to 600 tpd of private trash Seconded and so VOTED Henry Rugo proposed an amendment to the motion. make the availability of the 300 tpd open to the public after the December 31st date The amendment was defeated and the main motion carried Brian also suggested a resolution that municipal tonnage would not be allowed to come into the facility with the private haulers The committee asked Brian to withdraw his resolution to allow some communities more time to come into the project Bob Hutchinson suggested that this be further dis- cussed and acted upon at a subsequent meeting REPORT BY UOP John Phillips reported on UOP's on-going peer meetings with communities NEGOTIATIONS IN PEABODY John Shortsleeve, Director of the Bureau of Solid Waste Disposal, reported that the State is very close to a signed contract with Peabody for an interim/backup/residue landfill The Mayor will be recommending the Bureau's proposal to the City Council within the next 2 or 3 weeks The price during the interim period will be $13 per ton The City will sell bonds to pay for approximately $2 1/2 million worth of improvements to the landfill to bring it into compliance Additionally, when the plant is operating, the state will purchase 600,000 cubic yards for an approximate $1 5 million Brian Sullivan motioned to authorize the State, Bureau of Solid Waste Disposal to execute an ! agreement with the City of Peabody on behalf of NESWC Seconded and so VOTED A community representative requested a roll because he felt that there were a lot of non-members present. Dr Harold Yaffe handed out a one page update on the tipping fee, which at this time is projected at $7 -$11 per ton. He also announced that he recently changed his position with the MITRE Corp to the present position with Roy F Weston, but will continue as a consultant to the Bureau The communities then discussed at length the possibilities of using the residue Chairman Scanlon asked for volunteers at some talk shows and suggested that anyone interested should speak to Brian Hardy Motioned to adjourn at 9 10 PM - so MOVED 1
