Representative Site Photos
Ms. Carmen Hudson, Campos Hudson Engineering, presented and stated that the property is
within the 100-foot buffer zone to bordering vegetated wetlands and within the 200-foot
riverfront area, and there is a perennial stream on site. The proposal includes replacing the
existing 4600 square foot dwelling with a 2663 square foot dwelling. Part of the gravel and paver
driveway will be removed and replaced with native plantings. The infiltration system proposed is
located partially under the driveway and a positive engineering review has been received.
Ms. Jill Neubauer, Neubauer Ennis Architects, stated the existing house has a basement that is
below the water table and the proposed house would have a crawl space that sits above the water
table, eliminating artificial pressure through the water table. Mr. Chris Shirazi, Leblanc Jones
Landscape Architects, stated the tree replacement to tree removal ratio proposed is 2:1. Mr.
Shirazi stated that the proposed landscaping includes an orchard and vegetable garden as well.
Ms. Ladd asked if the existing bridge is adequate to accommodate flood waters. Ms. Hudson
stated the bridge is in good repair and adequate to withstand flood waters. Mr. Beuttell stated the
large oak tree proposed for removal near the driveway is a great habitat and asks for a plan to
preserve. Mr. Shirazi stated they would commit to preserving this tree. Mr. Whelan noted that
the proposed dwelling was closer to the resource area than the existing dwelling. Ms. Hudson
stated the location of the driveway is proposed to remain the same. Ms. Ladd asked if possible to
shift the proposed dwelling slightly to the left. Ms. Newbower stated due to the sewer easement
on the property, the proposed dwelling location cannot be changed.
Mr. Hamilton stated that a written waiver request will need to be submitted to gain approval to
move the dwelling closer to the resource area. Ms. Hudson noted a request for a waiver from the
Commission was included in the application. Mr. Hamilton stated the Commission has specific
criteria for waiver requests and a separate submission of the waiver request must be submitted.
On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 5-0 by roll call
vote to continue the hearing to the 1/6/2024 meeting, at the applicant’s request.

Mr. Seth Donohoe, Dillis & Roy, presented and stated the property has been given its own street
number due to confusion with the R part of the address by fire equipment responding to a fire on
the site. Mr. Donohoe stated the existing dwelling is within the 50-foot buffer zone and proposed
mitigation includes stormwater management systems in both the front and rear of the dwelling.
The driveway is to remain as is and the proposal does not include any tree removal.
Mr. Donohoe stated the site does have an enforcement order in place as well from the
Commission. Ms. Ladd stated she is reluctant to approve a notice of intent while the enforcement
order is still outstanding. Ms. Karen Mullins stated the wetland delineation was performed
previously by a different consultant and suggests involving the previous consultant in this
process as well.
Mr. Raj Janu, 1367 Massachusetts Avenue property owner, stated he was unaware of the
enforcement order prior to the fire that occurred in his home. Ms. Mullins noted the project will
require a waiver request. Mr. Donohoe stated the proposed mitigation includes two stormwater
systems, and the mitigation for the enforcement order will be kept separate from proposed
mitigation in the Notice of Intent application.
On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 5-0 by roll call
vote to continue the hearing to the 1/6/2024 meeting, at the applicant’s request.

Ms. Nicole Ferrara, LEC Environmental, presented and stated that a forested Bordering
Vegetated Wetland is around the site and an unnamed perennial stream runs offsite. Ms. Ferrara
stated that the existing sunroom and deck will be removed and will be replaced with the
proposed addition. The proposed additions are farther from the resource area than the existing
conditions. Mr. Michael Novak, Patriot Engineering, stated that the area of concern during the
site visit is contained within the drainage calculations.
Ms. Ferrara stated that around 2780 square feet of the restoration is proposed within the 25-foot
buffer zone. Ms. Ferrara stated FENO markers are proposed to demarcate the restoration area
which will have a 3-year annual monitoring period. The proposed mitigation is more than the 2:1
requirement. Ms. Ferrara stated that one more FENO marker will be added along the existing
wooded edge.

Mr. David Sperduto, Wetlands Identification, presented and stated that the wooded area at the
rear of the property appears to be a depression, corresponding to the delineated isolated wetland.
Mr. Sperduto stated there may be an Isolated Land Subject to Flooding which was not evaluated
for. Town staff have been aware of the location having wetlands present.
Mr. Sandy Liang, 38 Greenwood St, asked how this delineation would impact his property and is
interested in cutting trees on his property. Mr. Hamilton stated the Commission could not
provide a definitive answer on what projects would be allowed on Mr. Liang’s property without
a prior wetland delineation at 38 Greenwood Street as well. Ms. Mullins stated that during the
sale of 38 Greenwood St, staff did notify buyers and realtors of the wetlands in the area. Ms.
Mullins suggested Mr. Liang set up a meeting with her to further discuss any restrictions to his
property.
Mr. Chandan Phukan, 34 Greenwood St, asked the difference between types of wetlands. Ms.
Mullins stated the wetlands in this neighborhood are isolated as there is no inlet or outlet for the
wetlands. Mr. Sperduto stated the wetland present at 42 Greenwood Street met the bylaw’s
definition of an Isolated Freshwater Wetland. Mr. Sperduto explained the process of conducting
the wetland delineation on the property. Mr. Hamilton stated Mr. Phukan could not know the
exact bounds of the wetland on his property without having a wetland delineation completed on
site.

vote to close the hearing.

Mr. Robert Marini, NativeTEC, presented and stated the hundred-year floodplain does not reach
the site, however the five-hundred-year floodplain does reach the site. Mr. Marini stated there is
altered hydrology on site. A previous filing for 81 Westview Street had a delineation which was
referenced by the Commission in reviewing the delineation for 75 Westview Street. Ms. Mullins
and Mr. Marini will meet on site to further discuss the delineation as the Commission have
further questions regarding the wetland bounds.

Mr. Richard Kirby, LEC Environmental, presented and stated that a portion of the proposed
ADU is within the 50-foot buffer zone. Mr. Kirby stated the project is still in review by the
Board of Health and will be presented to the Board of Health this week. Mr. Kirby stated that the
homeowner is open to a condition to file another Notice of Intent filing for a comprehensive
plant management and mitigation plan within four months of the issuance of this Order of
Conditions. Ms. Ladd noted that there have been clearings on this property which need to be
addressed as well. Mr. Kirby stated that the Invasive Plant Management Plan would include
mitigation for the prior clearing and/or vegetation removal that occurred on the property.
On a motion by Mr. Beuttell and seconded by Mr. Whelan, the Commission voted 5-0 by roll
call vote to continue the hearing to the 1/6/2025 meeting, at the applicant’s request.

Notification: Eversource ROW 8-3 Vegetation Management Annual Maintenance
Ms. Mullins stated Eversource has submitted their standard notification of annual maintenance.
Ms. Dohan asked when the work in Lexington will be completed. Ms. Mullins stated she will
respond to the notification and will meet with the contractor.
0 Moon Hill Rd Plan Modification Discussion, COC-24-9, CNOI-22-26: Access Path
Ms. Mullins stated that new plans were submitted, buckthorn removal was previously approved
and will be completed, along with native plantings. Ms. Ladd asked if the gravel area will be
reduced by 4 feet. Ms. Mullins stated that the applicant is proposing to reduce the width of the
gravel area. A condition will be included that there will be a 2-year monitoring period prior to
the release of a Certificate of Compliance.

Mr. Beuttell stated the Community Preservation Committee will be voting on Thursday
December 19th on which projects will be recommended for funding.
Ms. Dohan stated that the Greenways Corridor Committee met last week and the question arose
as to when the Commission might approve the land management plan for the parcels on Concord
Ave. Ms. Mullins stated that Mr. Bill Giezentanner forwarded a final draft of the plan and Ms.
Ladd has reviewed this.
A Girl Scout troop reached out with a proposal for Chiesa Farm to address lack of pet waste
cleanup. The troop designed signs to display around Chiesa Farm to remind users to clean up pet
waste. The Commission supports the signage.
Ms. Ladd stated the Citizens for Lexington Conservation noted there are incursions of plantings
by abutting neighbors onto Cotton Farm. The Commission discussed the possibility of installing
a fence at Cotton Farm.
On a motion by Ms. Dohan and seconded by Ms. Ladd, the Commission voted 5-0 by roll call
vote to adjourn the meeting.
