Discussion with Developer Kir' '.oyes distributed copies of the Condominium documents and answered questions Asked how the buyers ' income figures were selected, he said it was primarily on the ad- sce of the Planning Board which recommended using the Mass Housing Finance Agency s income guidelines for first time buyers, with preference given to those who could qualify under the 1982 figures These lower qualifiers must get at least 40% of the units including the first 21 The prices listed in the condo documents for unit sales are for those first 21 bu -ers LexHAB should assume their purchase price will be approximately $5,000 higher per unit thar the listed prices Kirk will reserve one three bedroom unit and a •aried numbei of two bedroom units (depending on the total number purchased) foL _exHAB In realtion to Kirk's sale of three bedroom units, he suggested that Le_ :.2 review these buyers for their appropriateness for that size unit. He said that how the affidavits are tested is up in the air He prefers that fle _-B just reviews and appro^es Don asked about a student who did have low income, but 'as just starting up his profession Kirk thought such a person might not wart to stay at Muzzey after he could afford more, and that some such people might faL_ through the cracks Jean asked Bill Hays to comment on his understanding of LexHAB's ability to set gu_delines Bill referred to section 2 of the legislation which refers to setting guidelines in the property under LexHAB control, but felt that the Land Disposition and Deed give that task to the Town Manager for non-Town owned units Kir: said his construction financing has been committed, and the mortgage bank will be selected tomorroo, He expects Fanny Mae approval by the end of January and zot.ld like to start construction between mid-February and March 1 Bea told the Board that the Town Manager has requested LexHAB to meet with each of the first 21 applicants to discuss their affidavits and make recommendations to the Manage:: Kirk said he is against this Bill Hays stated that for the purpose of these initial sales, the Town Manager is the .uzzey Administrator It is not in our charge to advise him, and if it gets to the point_ of involving us with prospective buyers which might lead to a conflict with the developer this might be beyond our scope Tho Eoard scheduled Saturday January 14 at 10 00 am to go through the building o Bill Hays asked for Kir]c's suggestions in choosing the LexHAB units, and whether the would be better clustered or dispersed Kirk recommended dispersing them aduing that in other mixed income developments he knows of no problems 'He also suggested getting units with ground level access for children The more unusual ;nits are often the hardest to rent, and he suggested getting the "ordinary" ones e way the agreement is structured, LexHAB has 14 days after the sale of the first 21 units to make its selection Kirk is offering to come to LexHAB to trigger the fourteen days at the point when he starts construction since the bank is not as dernand_ng regarding presales as he had thought At the start of construction, Le- HAB will also have to decide on bath and energy options the decision on kitchen 1 carpeting must be done during construction. Kid- is offering fixed, adjustable, and balloon mortgages The entire project is being prequalified, so LexHAB can select any bank Ail the plans draw in the condo documents are drawn 6 inches too small to give a ^.argin of error Kirk has approximately 129 of buyers with four people in the family, and 25% of bu 'ers want a three bedroom unit Noyes left the meeting with h.s staff rules The minutes of the meeting of December 17 were approved as mailed .ffidavit Apiroval There was discussion about the Manager's request that LexHAB review affidavits and meet with potential buyers Lind:.said that meeting with them treats everyone fairly and puts us in a good posture, slowing that the Town scrutinizes however she doesn t know if it would be effective Bill Kennedy felt that we are 'monitoring' , and did not know what purpose the meetings would ;erve Dave felt it was possible to get into a legal wrangle i LexHAB were to refuse a sale Bill Hays thought it was the Manager's job to screen and set policy and without his establishing officially that he was delegating that, there is no standing for LexHAB, and it might be detrimental to LexHAB in carrying out its functions Don pointed out that an answer given one day could be invalid the next day Mr Hutchinson arrived at the meeting and reemphsized his request, feeling that the interview process would get more information and have a moral effect He felt that defending a law suit goes with the risk of making decisions He thinks it would be more effective with the input of LexHAB Bill Hays suggested that Bob go forward with the interviews himself, and invite some members to be I,resent Le :HAB therby discharges its responsiblity to monitor, avoids the problem of being the conferring authority It also would be more efficient in terms of time scheduling Bob thought that a good idea, and asked that members convey any knowledge or perceptions that they have to him. Linda suggested having some prearranged questions She asked what Bob intended to do if someone refused to attend Bob said he would try to reschedule Bob will schedule his meetings with propsective buyers at fifteen minute intervals on Saturday, January 14, starting a 9 00 am Several members of LexHAB thought they could be present He will draft a letter to them, sending a copy to LexHAB.
