Bill Kennedy, Jead Gaudet, Bill Hays, Linda Conrad, Don Wilson, Dave Eagle Steve Politi, Al Busa, Bob Hutchinson, Bea Phear Steve Politi called the meeting to order at 9 00 am. and invited Mr Busa to give a history of the Muzzey conversion process He explained that after the first Muzzey proposal for an office park was turned down, the Conversion Committee and the Selectmen chose the Noyes proposal for housing LexHAB was instituted as part of the Muzzey process to create some housing for people in need, who might be just under the limits for being able to buy a unit at Muzzey, but over the limit for Housing Authority subsidy, for example a fmaily with income in the $18 000 range such a town employees He said the Town will have approximately $238,000 to purchase units, up to ten Mr Politi said he thought LexHAB had two categories of responsibilities 1 To look at the unit at Muzzey that are not being sold to the Town and check the income affidavits and ensure they comply There will also be a continuing responsiblity for these units regarding resale and future buyers The Town is hopeful that LexHAB will act as a potential broker for these units from a list of qualified people 2 Responsibility for the units that the Town has access to, including selecting the.specific units (number and location) There is no necessity that they be pain for in cash and it is assumed that LexHAB will procure mortgages, but how many will have to be considered to avoid a deficit position. Money will need to be reserved for legal fees and expenses as well LexHAB will also be setting its own guidelines for the tenants in these units Bob Hutchinson said he had a list of the first 21 applicants for the committee to review and they would be gotten out this week Noyes has the income certifications, and Bob suggested that LexHAB arrange to meet with him at its next meeting Jean Gaudet asked how much discretion LexHAB had in this process Bob said not very much as the question of assets had been excluded as a subject for eligibility however he felt that the committee could exercise moral persuasion and confront those applicants who they felt were not meeting the spirit and purpose of the conversion On the issue of timing, he said that after the sale of the first 309 of units, LexHAB will have 14 days in which to identify up to ten units for the Town, and has 120 days to exercise the purchase and sales agreements At the moment Bob is the temporary Muzzey administrator for the Town He will make Bea Phear available to help LexHAB initially but he expected that LexHAB would need its own staff Jean Gaudet asked how LexHAB stood with the open meeting law in relation to discussion of applicants Bob said they should ask Town Counsel Don Wilson pointed out that the Housing Authority discussions about tenants are required to be in closed sessions Bill Kennedy asked about the developer's schedule Bob said it needed updating and Noyes will have to go for his mortgage after the special eprmit is granted, which is on t-e Selectmen's agenda for December 19 I iI1 !` f Bill Hays asked about the location of responsibility for different functions, for example the Manager is the administrator and representative, but under the land disposition agreement the Town may designate another entity for some things, and some are specifically for the Manager There are different kinds of decisions for the Town to make such as the approval of the condominium documents and the senior center Steve Politi said the Selectmen have not fully thought through how they are going to shift responsibility He said the roles specifically given to the Manager are not continuing, but mostly related to start-up He suggested that Bea walk through the agreement and pull out the various assignments of responsibility Bill Hays asked about the status of liability Bob said it was covered through the Town, and we would specifically add the committee to the Town's policy Dave Eagle nominated Jean Gaudet as chair It was voted unanimously Dave Eagle nominated Bill Kennedy as vice chair It was voted unanimously Bill Hays asked about geographical preference for applicants Steve Politi said he saw no mechanism for favoring Lexington residents, and that there are a number of non-Lexington people on the list, but often they have some town connection or are employees There could be greater leeway in LexHAB's eligibility criteria for the rental units Don Wilson said that the units in Parker school, which are administered by the Housinc Authority without state and federal interference, are running very smoothly He could share those guidelines with LexHAB Jean Gaudet reminded the members to get sworn in Two future meetings were scheduled Th;rsday January 5 at 7 30 pm room G-15 Thursday, January 19, at 7 30 pm room G-15 The meeting adjourned at 10 05 am Respectfully Submitted, Beatrice Phear
