HomeMy WebLinkAbout1941-04-141 SELECTMEV I S MEETING April 14, 1941 A regular meeting of the Board of Selectmen was held in the Selectmen's Room, Town Office Building on Monday evening, April 14, 1941 at 7:30 P. M. Messrs. Rowse, Locke, and Sarano were present. Mr. Giroux arrived at 8:15 P. M. and Mr. Lowse served as Chairman pro -tem until he arrived. The Clerk was also present. At 7:30 P. M. Hearing was declared open upon the appli- cation of the Boston Edison Company and the New England Tele- phone and Telegraph Company for a joint location for the erection of one pole on Lexington Avenue, approximately 45 feet north of Robbins Road. No person appeared in favor or in opposition. Mr. Paxton having previously approved the location, upon motion of Mr. Sarano, seconded by Mr. Lockq it was voted to adopt an order authorizing the location of the pole* Mr. Paxton appeared before the Board at 7:40 P. M. He said the following uses of halls had been requested; American Legion Auxiliary, Cary Hall, May 24th from 11:00 A. M. to 6:00 P. M.; P. T. A., Estabrook Hall, April 17th, 24th and May 1st in the morning to prepare for the large P.T.A. meeting to be held later on. Mr. Locke moved that the uses be granted free of charge. Bir. Saran seconded the motion, and it was so voted. Mr. Paxton said the Legion wanted the Auxiliary use to be considered one of its free uses. Stevens be ' accepted. Mr. Rowse seconded the motion, and it was so voted. Mr. Paxton said that Wilbur Roberts, the cashier on the Food Stamp Plan, was losing out on his retirement be - Wilbur cause of the fact that one half of his salary was being Roberts' paid by the government. Bar. Russell was consulted in the salary matter and he suggested that the Town pay the full amount of Mr. Roberts' salary from the Labor and Materials appro- priation and that when Mr. Roberts received his check from the Federal government, he turn it over to the Town. Mr. Locke moved that this plan be approved. Mr. Sarano seconded the motion, and it was so voted. Mr. Paxton stated that Daniel Gorman requested the use Use of of the grader in order to scrape Sunny Knoll Avenue, grader lar. Locke moved that Mr. Gorman be allowed to hire the grader subject to the usual charge. Mr. Sarano seconded the motion, and it was so voted. Mr. Paxton said that bids had been received on Class #150 Cement Lined Water pipe as follows: 10" 8" 6" R. D. Wood Co. $1.97 ft. $1.471 ft. $1.021 ft.. Pipe U. S. Pipe & Bids Foundry Co. 1.97 ^ 1.47 " 1.021 " Warren Pipe Co. of Masa., Inc. 1.95 " 1.45 " 1.01 " Mr. Rowse moved that the bid of the Warren Pipe Co. of Massachusetts, Inc. be accepted. Mr. Locke seconded motion, and it was so voted. Mr. Paxton discussed the North Lexington W.P.A. sewer project. He said that due to increased activity in private industry and Town departments, many employees had gone off the projects. Between the Oak Street and North Lexington projects, they have only 48 men on and of that number 11 W.P.A. are watchmen, time keepers or supervisors. Of the balance, Sewer proj. there are only about 8 men that are capable of doing a good day's work. With this small number of men, Mr. Paxton thought it logical to concentrate on one job but no matter which job is stopped the citizens in the neighborhood are going to complain. Mr. Ross figured that with his own men it would cost between $700.00 and $800.00 to complete the Hancock Street sewer to the point of excavation. 1 1 1 It would take about one week. Mr. Paxton thought that the Board should authorize the Sewer Department to do this work and have the W.P.A. men put on the Oak Street job. Mr. Beach talked to one of the W.P.A. supervisors who said that he could get q couple of bus loads of men from Cambridge and the only charge would be for transportation, but this would amount to $50.00. Mr. Paxton did not approve of this at all and the Board didn't either. Mr. Rowse asked why the men on the Oak street job couldn't be put on the Hancock Street job to finish it up. Mr. Paxton said that he had had some cave-ins in the water pipe and the water main was in danger. Mr. Rowse asked why the men who were taken off W.P.A. and put to work in Town Departments could not be returned to W.P.A. to finish up the job. Mr. Paxton said it would take three or four weeks to complete the job with W.P.A. labor. It was decided to have the Sewer Department complete the ob to the point of excavation and charge the expense to the 85,000.00 bond issue for Federal Aided Sewer Projects. A letter was received from Mr. W. E. Myers of 65 Bridge Street requesting that the brook running through Bridge Street be cleaned out. Mr. Paxton said that he had looked at the brook and planned to clean it out as soon as the ladd was dry enough. A letter was received from Mr. Jasper A. Lane advising of the expiration of a fire insurance policy in the sum of $5,000. on May 3rd. Mr. Locke moved that the policy be renewed through the same agent. Mr. Sarano seconded the motion, and it was so voted. Mr. Paxton informed the Board that fire insurance policy in the sum of $5,000.00 expired on May 4th through the office of George W. Taylor.& Son, Mr. Locke moved that the policy be renewed through the same company. Mr. Sarano seconded the motion, and it was so voted. Mr. Paxton retired at 8:25 P. M. Cdr. Gordon D. Richards, the Acting Building Inspector, appeared before the Board. Mr.. Richards informed the Board that he was afraid that there was considerable building going on in town for which no permits had been taken out. He said that in other communities the Police Department checked on all new buildings and if the building permit was not posted in a conspicuous place, the owner was asked for it and if he did not have it, he was ordered to stop work. He asked if the Police Department could do that kind of work in this Town. 597 Bridge St. brook Ins. Polic; Police to check on building in Town 598 The Board thought that this was a very important matter and , the Clerk was instructed to request the Police Department to check up on this work as outlined by Mr. Richards and to notify him if no permit ifi forthcoming. It was decided to request the Building By-law Committee to meet with the Board next Monday evening to discuss the matter of inspecition of buildings. The Chairman said he thought that next year the Board should consider hiring-a full time inspector in view of the very active building program in Lexington. Bids on asphalt were received and the Boards. approved buying asphalt from the following companies: Asphalt American-Bitumuls Co. bids Arthur T. Hausler Co. Lake Asphalt & Pet. Co. H. H. Moore 215.00 30.00 185.00 Mr. Sarano moved that the paving breaker be pur- chased from Tractors Inc. at its bid of $170.00. Mr. Locke seconded the motion, and it was so voted. Moore 200.00 25.00 175.00 Mr. Sarano moved that the Jack Hamner be purchased from the from the Public Works Supply Co. at its bid of $170.00. Mr. Locke seconded the motion, and it was'so voted. At 8:35 P. M. Mr. E. S. Caouette appeared before the Board. He said that the agreement submitted by the Towers to the Board of Survey did not have to cover the lots on 1 Follen Road and for clarification of the titles, the Towers would like a letter from the Board stating that the agree- ment did not cover these lots. Mr. Miller discussed the matter with Mr. Wrightington and the latter said that he un- derstood that the agreement did not cover the lots on Follen Road, Mr. Caouette retired at 8:50 P. M. At 10:30 P. M. the Planning Board appeared before the Board of Selectmen. Mr. Rowse asked if the members agreed that the lots on Follen Road were to be excluded from the agreement. Mr. Greeley said that those lots were established by an old lay- out and as his Board understood the Subdivision Regulations, they apply to new lots only and as Follen Road is not a new street, the Subdivision Regulations did not apply to it. The Clerk was authorized to inform the attorney for the Towers that the lots on Follen Road were excluded from the agreement. The Planning Board retired at 10:45 P. M. Follen Rd. Lots At 8:50 P.M Mr. Malcolm H. Clifford appeared before the Board. The Chairman said that with reference to the purchase of a two-way radio for the Police Department, Messrs. Clifford and Sergeant Neal, members of the committee, had discovered certain circumstances which they thought should be reported to the Board of Selectmen. The committee received two bids and decided on the RCA equipment. However, it was understood and assumed that the Police two - Town was dealing with the RCA company direct and not through way radio an agent. The Chairman said that these two men had evidence that a member of the committee was acting as an agent and was going to receive a very large commission on the business. He said that Mr. Paul Mooney was the man who was going to act as the agent. He said that the commission should be given to the Town in money or in additional equipment. He said ethically Mr. Mooney should hot have done this as he was a member of the committee. He read Article 2 Section 1 of the By-laws which says that no member of any board, commission, committee or other Town officer, shall in behalf of the Town make or join in the making of any contract or agreement through or by which he has either directly or indirectly any financial interest other than in common with the citizens of the Town in general. Mr. Irving Strauss, the RCA Sales Engineer, called on Mr. Clifford and inadvertently left some papers on Mr. Clifford's desk which brought out this whole situation. The Chairman talked with Mr. Wrightington about the matter and he said that the papers should be returned. The Chairman said that he thought the whole thing should be held up and the matter taken up with one of the executives of the RCA. 600 Mr. Clifford said that he had this evidence when he appeared before the Board last time, but did not know just what to do about it. After thinking it over however, he. decided to bring the matter out in the open as he him- self had been accused of making some money on the deal and he did not want to have anything more to do with it. Mr. Sarano asked if there was any other equipment that they thought would do as well as the RCA. Mr. Clifford said he thought RCA was the finest equipment there was. The Chairman asked Mr. Wrightington if he believed that one of the executives of the RCA would come over here and talk with the Board and he replied in the affirmative, and he suggested that he write a letter. The Clerk was instructed to forward the papers to Mr. Wrightington. Mr.Rbwsi:moved that the following licenses be granted. Mr. Sarano seconded the motion, and it was so voted. Alice M. Ave. to " A letter was received from the. Town Counsel relative to the Ryder land on Woburn Street which the Town is planning Ryder land to sell to Plowman and McConchie. He said that it.was only i0oburn St. by registration of title that the matter could be cleared up and he wondered if the purchasers would start the pro- ceedings. If they would not do this, he said that there were two alternatives, one was to persuade the U. S. Collector t6 take the responsibility of abandoning his lien and the other was for the Town to start a petition to register title in the Land Court. It was decided to request Mr. Wrightington to proceed with the petition for the registration of the title. A letter was received from Alvin's Inc. requesting that flags be set outside their store at 20 Waltham Street Request on April 19th. The Clerk said that it would be necessary flags 4/19 to drill post holes and to purchase flags if this was to be done. The Chairman said that inasmuch as there was no money appropriated for this location, it would be impossible to grant this request. M loft 1 III Mr. Sarano moved that the Board, acting as the Board of Health, adopt the following order. Mr. Locke seconded the motion, and it was so voted. Lexington, Mass. April 14, 1941. The Board of Selectmen of Lexington, acting as a Board of Health, after receiving a report from Mr. John Lamont, Health Inspector, as to the condition of the premised located at 6 Aerial Street, Lexington, find that the overflowing septic tank located on said premises is a menace to the public health and a nuisance by reason of its filthy conditon, and therefore, the Board adopts the following order under the authority of G. L. Ch. 111, sec. 123 and every other power enabling it to do so. ORDERED that William H. and Mary M. McCall of 6 Aerial Street, Lexington, Massachusetts in the County of Middlesex, the occupant of the property at 6 Aerial Street, Lexington at their own expense remove the nuisance and source of filth thereon consisting of an overflowing septic tank, within two days from the date of the service of this Order. Sarano Lexington Mr. Rowse mooed that the Board grant the petition of the Boston Edison Company to remove and replace a pole on the Cambridge -Concord Highway at, the northeast corner of Blossom Street, Mr. Locke seconded the motion, and it was so voted. A letter was received from Mr. F. T. Alden who has been making some studies and doing work for Mr. Wrightington in the case of P. DeCristofaro against the Town. Mr. Alden said that to date he had spent 39 hours in preparation of the base' b$t `IIe `uA derstood° thAt _he *o uld' have to go to court if the plaintiff is not satisfied with the master's findings. He said that he thought he should get $25.00 per eight-hour day if it was necessary to go to court. The Chairman suggested that the letter be referred to the Town Counsel for his approval of the number of hours and to find out how much more time Mr. Alden would have to put in. I Pole location DeCri s tof a ro case The Chairman said that the Town Engineer had brought to his attention the fact that Leigh V. Farnham would re- ceive no more money after April 17th under the present vote. L. Farnham He said that the doctor expected that Mr. Farnham would be able to return to work about May 1st. He therefore recommended • that his salary of $25.00 be continue for two more weeks. Mr. Rowse moved that the Trustees of Public Trusts be requested to approve two mord payments of $12.50 each from the Bridge Fund for Mr. Farnham. A letter was received from Mr. Paxton stating that upon checking with Mr. Moloy he found that the Town had twelve tables available for banquets and these had a seat - Tables for ing capacity for about sixty persons. He obtained prices banquets from the Jackson Folding Chair Company on new tables but said that it was,his personal opinion that if individuals desired additional tables, it was logical for them to hire them rather than to have the Town invest $125.00 for new tables. The Board agreed with Mr. Paxton and the Clerk was in- structed to write Rev. Crawford 0. Smith of the Baptist Church and tell him that the Selectmen felt that it was up to the people having banquets to hire tables rather than borrow them from the church. A letter was received from the Town Counsel referring to the discussion at the last Town Meeting on the right of the Town to -charge admission to an athletic field at the center playground. General Laws, Chapter 45 relates to both parks and playgrounds. Section 14 expressly authorizes charging admission to structures on a playground but Section Admission 7 provides that land held as a park shall be "forever kept to play- open and maintained as a public park" and this has been ground understood to forbid charging admission to a park. He said that Mr. Scott gave the land both for park and playground purposes. Mr. Wrightington suggested that the Engineering Department determine whether or not the proposed location of! the enclosed field was within the area conveyed by the deed. The Clerk was instructed to ask the Town Clerk if he had any official record of the Town's acceptance of the Scott gift. Mr. Rowse moved that the following discharge of the Abbott Road sewer assessment be signed. Mr. Sarano seconded the motion, and it was so voted. KNOW ALL MEN BY THESE PRESENTS that the Town of Lexington, a municipal corporation in Middlesex County, Abbott Rd. acting by a majority of its Board of Selectmen, hereby Sewer Dis- discharge any lien resulting from betterment assessments charge referred to in an order of the said Board of Selectmen relating to Abbott Road, recorded with Middlesex South District Deeds, Book 6465, Page 150, the public work for which the order was made having been subsequently aban- doned. COMMONWEALTH OF MASSACHUSETTS Town of Lexington At a meeting of the Board of Selectmen of the Town of Lexington held on the 14th day of April, 1941, it is ORDERED: Whereas the Board of Selectmen of the Town of Lexington, having determined and adjudged that common con- venience and necessity require that a town way be laid out in the location hereinafter described and having complied with the requirements of law relating to notice, did on the 17th day of March, 1941 lay out as a town way the way known as Patriots Drive from Edgewood Road, a distance of approx- imately 305 feet accordingly and duly filed their report of such laying out with the boundaries and the measurements of the same in the office of the Town Clerk on the 24th day of March, 1941, and whereas at a town meeting duly called, warned, and held on the 31st day of March, 1941 and adjourned n to the 7th da f y o April 1941, in accordance with the provisions of law applicable thereto, it was VOTED: That the Town accept the layout as a town way of Patriots Drive, from Edgewood Road, a distance of approximately 305 feet in a southwesterly direction, as laid out by the Selectmen, under; the Betterment Act, and shown upon a certain plan on file in the office of the Town Clerk, dated February 27, 1941, and to take by eminent domain the necessary easement therefor, and for the purpose of constructing said street the sum of $1500.00 be appropriated and assessed, said sum to be ap.. propriated from revenue of the current year. The above description is intended to conform to a plan entitled, "Plan of Patriots Drive, Lexington, Mass. Scale 1 Inch = 40 ft., Feb. 27, 1941 John T. Cosgrove, Town Engineer." which plan is on file in the Town Clerks office in said Lexington and a copy of which will be recorded with the Middlesex South District Registry of Deeds with a copy of this order. All trees, if any, upon the land taken are included in this taking. Betterments are to be assessed for this improvement. The area which it is expected will receive benefit or advantage other than the general advantage to the community from such improvement is described as follows; The same being lands now or formerly of Charles M. Blake, Charles M. Blake, and Lulu M. Blake, as shown on a plan en- titled, "Plan of Patriots Drive Lexington, Mass'. Scale 1 inch = 40 feet., February 27, 141, John T. Cosgrove, Town Engineer." The said area comprises the several lots shown upon the plan hereinbefore referred to, which are designated in the schedule hereto annexed and made a part hereof. We estimate the betterments that will be assessed upon each parcel of land to be as shown in the schedule which is hereto annexed and made a part hereof. The above described lines are parallel with and distant 40.00 feet from each other with the exception of the curved intersections at Meriam Street and Edgewood Road. The above description is intended to conform to a plan entitled "Plan of Patriots Drive Lexington, Mass. Scale 1 inch = 40 ft., Feb. 27, 1941 John T. Cosgtove, Town Engineer." which plan is on file in the Town Clerk's office in said Lexington and a copy of which will be re- corded with the Middlesex South District Registry of Deeds with a copy of this order. All trees, if any, upon the land taken are included in this taking. We determine that no damages have been sustained and none are awarded. Mr. 3arano said that the Chamber of Commerce had re- ceived a number of complaints about buses stopping in the middle of the street to discharge passengers. He said that the buses could not pull up to the curb on account of the cars parking at the bus stops.
