SELECTMENIS MEETING
AUG. 280 1939.
A special meeting of the Board of Selectmen was held
in the Selectments Room, Town Office Building, at 4:45 P.M.
Chairman Giroux, Messrs. Potter and Sarano were present.
The Assistant Clerk was also present.
The Board signed an order for the extension of a water
main in Sheridan Street, as follows:
ORDER OF TAKING
By the Town of Lexington of Easement for the
Construction of a Water Main.
SHERIDAN STREET
(From the present end a distance of approx-
imately 90 feet southerly).
WHEREAS, at a meeting duly called and held on March 2 0,
1939, the town meeting of Lexington pursuant to an article
in the warrant 6f -the meeting for which due notice was given,
duly adopted by unanimous vote the following vote and made
an appropriation therefor.-

"Voted: That the Selectmen be authorized to install
water mains in such accepted or unaccepted streets, as may
be applied for during the year 1939 in accordance with
authority contained in the By-laws of the Town, subject to
the assessment of betterments, and to take by eminent domain
any necessary easements therefor, and for the purpose of
said installation the sum of $4,000.00 be appropriated, this
money to be provided by the transfer of $1,000, from the
Water Assessment Fund, and the transfer of $3,000.00 from
the Water Department Available Surplus Account."
AND WHEREAS, the right of way and easement hereinafter
described and taken are necessary for the establishment and
maintenance of the said water main;

Order,
NOW, THEREFORE, the Board of Selectmen of the Town of
Lexington, acting as a Board of Water and Sewer Commissioners,
for and in behalf of the said town, by virtue of the authority
conferred upon them by the foregoing vote and of every other
power them thereto enabling, hereby adopt this order of
taking by eminent domain, for the said public improvement
for the purpose of constructing and maintaining a water main
in Sheridan Street, from the present end a distance of
approximately 90 feet southerly as aforesaid, the following
easement, namely:
The right to enter upon the land shown as Sheridan Street
on a plan entitled, "Plan of Proposed Water Main in Sheridan

Joseph A. Ross, Supt. Water Dept." and owned by Janes L. '
Douglass and construct therein a line of water main with all
necessary connections, shut -offs, and appurtenances substan-
tially as shown on a plan of Joseph •A. Ross, Supt., Water
Department, dated Augus t 28, 1939, to be recorded herewith.
The easement covered by this taking includes the right on
the part of the Selectmen of the said town or other duly
authorized agents of the town to enter upon, dig up, open
and use the land embraced within the said way as may be
reasonably necessary for the purpose of initially. con-
structing and thereafter maintaining, operating, inspecting,
repairing and replacing from time to time the said water
main, (The said town being always bound to see that the
ground after the comp7stion of the work in each case is
cleared of all surplus material and surface left in as
smooth and good condition as at the time of entry).
Betterments will be assessed for this improvement in
accordance with the provisions of Chapter 80 of the General
Laws. The area which it is expected will receive advantages
other than the general advantage to the community from such
improvement comprises the several lots shown upon the plan
of Joseph A. Ross, Supt. Water Department, above referred
to, which are designated in the schedule hereto annexed and
made a part hereof. '
We estimate the betterments that would be assessed upon
each said parcel of land to be as shown in the said schedule.
We determine that no damages have been sustained and
none are awarded.
To have and to hold the said easement to the Town of
Lexington, its successors and assigns, to its and their
own use and behoof forever agreeable to the p^ ovisions of
the said Chapter 79 of the General Laws and all pertinent
acts in amendment thereof or supplemental thereto.
IN WITNESS NHEREOF the undersigned being a majority of
the Board of Selectmen of Lexington aforesaid have hereunto
subscribed our names this twenty-eighth day of August, 1939.

Commitment of Water Liens in the amount of $105.24
was signed by the Board.
Letter was received from Mr. Raymond recommending an
order for extra work on Contract 3 of the North Lexington
Sewerage System to cover the cost of three items as follows;
Item 1. removal of surplus material near the site of the
pumping station; Item 2. provision of a watchman on Bedford
Street for the period May 17th to 20th inclusive; Item 3,
for 14 inch steel pipe to be laid at a later date. The
letter stated that the aggregate price of the three items
for this extra work is $286.61. Metcalf & Eddy recommended
approval of the change order. The Board voted to approve
the order, and signed the same.
Letter was received from the Supt. of Public Works in
which he recommended that the Board approve a borrowing in
the amount of $4,000. for Chapter 90 maintenance work, in
anticipation of reimbursement from the State and County.
It was voted to authorize the Town Treasurer to request
bids on a loan in the amount of $4,000. for Chapter 90
maintenance work, in anticipation of reimbursement from the
State and County, the notes to be dated Sept. 6th, 1939 and
payable August 30, 1940.
Letter was received from the Supt -of Public Works rel-
ative to an old water main which runs from the location of
Commitment

Loan
the old pumping station lot on Lincoln Street to a point
Water near the junction of Marrett Road and middle Street and which
main was a part of the old water works system before it was taken
replaced, over by the town. The letter stated that three dwellings are
being served from this main, two on Lincoln Street and one
on Middleby Road. The letter stated that it has been found
that this main is leaking, causing a loss to the Town of
approximately $8. for each day. Mr. Raymond recommended
that the situation be remedied as promptly as possible and
requested permission to do so by having the two dwellings
on Lincoln Street connected to the Lincoln Street main and
reimbursing the owners for the cost of this work, which will
be about $25.00 apiece, and by laying a pipe from the Lincoln
Street main in Middleby Road for a distance of about 240 feet
to take care of the dwelling on Middleby Road. Mr. Ra-ymond
stated that the cost of laying the pipe in Middleby Road
and providing a service would be about $825.00, making the
total cost of the work suggested approximately $875. He
stated that there were funds available in the Water Main-
tenance account to take care of the matter and requested that
the Board approve the work.
The Board voted to approve Mr. Raymond's recommendation
and to have the work done in accordance with his suggestion.
The meeting adjourned at 5:00 P.M.
