SELECTMENIS MEETING
Aug. 13, 1938.
A special meeting of the Board of Selectmen of Lex-
ington, Massachusetts, held pursuant to the preceding
call of the Chairman, was held on the 13th day of Auguat,
1938.
The meeting was called to order at 8:00 A.M. by the
Chairman, and on roll call the following answered present:
Chairman Archibald R. Giroux, William G. Potter and Albert
A. Ross.
The following were absent: Philip M. Clark and A.
Edward Rowse.
After discussion of the offer of the United States of
America. to aid by way of grant in financing the construction
of additions and improvements to a sewer system, and in
accordance with the vote of the Town Meeting held on
August 8, 1938, under Articles 3, 41 50 6, and 7 , of the
Town Warrant dated July 19, 1938; and no petition having
been received requesting the submission of said articles to
the voters of the Town at large the following Resolution,
numbered two (2)., and entitled to RESOLUTION ACCEPTING THE
OFFER OF THE UNITED STATES TO .TIE TOWN OF LEXINGTON TO AID
BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF ADDITIONS
AND IMPROVEMENTS TO A SEWER SYSTEM" was proposed by Mr.
Potter, and read in full:
RESOLUTION NO. II.
A RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATES
TO THE TOWN OF LEXINGTON 20 AID BY WAY OF GRANT IN
FINANCING THE CONSTRUCTION OF ADDITIONS AND IMPROVEMENTS
TO A SEWER SYSTEM.
Be it resolved by the Board of Selectmen of the Toon
of Lexington.
Section 1. That the offer of the United States of
America to the Town of Lexington to aid by way of grant in
financing the construction of additions and improvements to
a sewer system; a copy of which offer reads as follows:

1. Subject to the Terms and Conditions>(PWA Form No.
230, as amended to the date of this Offer) which are made a

part hereof, the United States of America hereby offers to
aid in financing the construction of additions and improve-
, ments to a sewer system, including the acquistion of nec-
essary land and rights of way therefor, (herein called the
"Project"), by making a grant to the Town of Lexington
(herein called the "Applicant"), in the amount of 45 percent
of the cost of the Project upon campletion, as determined
by the Federal Emerency Administrator of Public Works,
(herein called the Administrator}'), but not to exceed, in
any event, the sum of $162,000.00.
2. The United States of America shall be under no
obligation to furnish any funds to the Applicant by way
of grant until satisfactory evidence of the approval of
the construction of the project by a two-thirds vote of the
qualified voters of the Applicant and the approval of the
Governor afld the State Emergency Finance, Board have been
submitted to the Administrator.
3. By acceptance of this Offer the Applicant covenants
to begin work on the Project as early as possible but in
no event later than 8 weeks from the date of this Offer
and to complete such Project with all practicable dispatch,
and in any event within 18 months from the commencement of
construction.
4. This Offer is made subject to the express con=
' dition that, if the Administrator shall determine at any
time that -the Applicant has paid or agreed to pay, whether
directly or indirectly, a bonus, conmtisalon or fee to any
person, firm or corporation for attempting to procure an
approval of the Applicant's application, or for alleged
services in procuring or in attempting to procure such
approval, or for activities of the nature commonly knan
as lobbying performed or agreed to be performed in connection
with the application, then the Administrator shall have the
right, in his discretion, to rescind this Offer and km -y
agreements resulting herefrom, and, in the event of such
rescission, the United States of America shall be under no
further obligation hereunder.

Section 2. That said Town of Lexington agrees to abide
by all the Terms and Conditions of said Offer, including
the Terms and Conditions annexed thereto and made a part
thereof,

Section 3. That the Supt. of Public Works be and he
is hereby authorized and directed forthwith to send to the
Federal Emergency Administration of Public Works three
,
certified copies of the proceedings of the Board of
Selectmen of Lexington in connection with the adoption
of this Resolution, setting forth this Resolution in full,
and such further documents or proofs in connection with the
acceptance of said offer as may be requested by the Federal
Emergency Administration of Public Works.

The above resolution was seconded by Mr. Ross, ad
was adopted, with the following voting aye: Chairman
Archibald R. Giroux, Albert A. Ross, and William G. Potter.
The Chairman thereupon declared said Resolution carried
and the three members present thereupon signed said Resolu-
tion in Approval thereof.
